AMENDMENTS TO STATE CIVIL SERVICE RULES

Rule VII

Resolved, That, subject to the approval of the Governor, civil service rule VII be and hereby is amended in the last paragraph thereof, in relation to the grading of engineering positions, and promotions therein, by striking out the words "When there is no promotion list and no one eligible for promotion in the respective groups or grades, original appointments shall be made from eligible lists established as the result of open competitive examination at the lowest salary in which the vacancy exists.", and substituting in lieu thereof, "When there is no promotion list and no one eligible for promotion in the respective groups or grades, original appointments shall be made from eligible lists established as the result of open competitive examination, such appointments being made at the lowest salary of the grade in which the vacancy exists, except that those serving in group E at a salary higher than the lowest salary in group B, grade 1, upon original appointment to the latter group and grade may receive that salary in the grade, which is next above their present salary."

AMENDMENTS TO STATE CIVIL SERVICE
CLASSIFICATION

State Charitable and Reformatory Institutions

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class be and hereby is amended under the heading, "In the State Charitable and Reformatory Institutions" by striking out the words "assistant engineer or assistant engineer and electrician", it now having been determined that competitive examinations for said positions are practicable; provided, however, that positions the incumbents of which have served for a period of less than three years shall be brought within the competitive class only on the expiration of three years of continuous service, or on the prior separation of the incumbent from the position.

Department of Labor, Office of the Industrial Commissioner Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class, Department of Labor, office of the Industrial Commissioner, be and hereby is amended by adding thereto the words, “legal assistant to the manager of the State Insurance Fund", it having been determined that competitive or non-competitive examination for said position is not practicable.

Commissioners of the Land Office

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Commissioners of the Land Office be amended by striking out the words "three appraisers" and substituting in lieu thereof the words "two appraisers", thus eliminating from the exempt class one obsolete and unfilled position.

Board of Port Wardens

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Board of Port Wardens be and hereby is amended by striking out the following unfilled and obsolete position: clerk-typist, provided, however, that this exemption shall not remain in force for a period longer than three months after the termination of the existing war with the German empire and its allies."

Tax Commission

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Tax Commission be and hereby is amended by striking out the words "four stenographers to director and assistant directors, income tax bureau", and substituting in lieu thereof the word, three stenographers to director and assistant directors, income tax bureau", thus transferring the position of stenographer filled as the result of competitive promotion examination to the competitive class. (Adopted January 13, 1922. Approved by the Governor, January 25, 1922.)

Transit Commission

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Transit Commission be and hereby is amended by striking therefrom the following unfilled and obsolete position, "the messenger to the chairman".

University of the State of New York

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the University of the State of New York, Department of Education, be and hereby is amended by adding thereto the words one mechanical assistant and laborer", it having been determined that competitive examination for said position is not practicable. (Adopted January 13, 1922. Approved by the Governor, January 25, 1922.)

County Court, Bronx County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class, Bronx County, under the heading "In the County Court", be and hereby is amended by striking out the words "private secretary", and substituting in lieu thereof the word secretary", for the purpose of conforming with title established by the Board of Estimate and Apportionment, effective January 1, 1922.
