It was shown by the defendants that the rags, after the sale at auction, were removed and re-assorted by the purchaser; the good separated from the damaged; and, it is contended, that the defendants should be called on to pay only what per cent. of damage was thus finally shown to exist. The answer to that view is, that the plaintiffs were not bound, and perhaps had not the opportunity to open, re-assort and manipulate the rags. It is their right to be compensated for the damage to them as they were at the time and place of delivery. If, in their damaged condition at the time, they were worth less in the market than they would have been worth if not damaged, the difference in value is the measure of the carrier's liability. The plaintiffs have made a further claim of $59.96, for alleged overcharge for freight; but that claim does not appear to be comprehended in the submission herein, and I, therefore, cannot consider it. There should be an award in favor of the plaintiffs against the defendants for the sum of three thousand four hundred and ninety-one dollars and sixty-eight cents, ($3,491.) Award accordingly.
