BY THE PRESIDENT OF THE UNITED STATES OF AMERICA.

A PROCLAMATION.

Whereas a Naturalization Convention between the United States of America and the Republic of Honduras was concluded and signed by their respective Plenipotentiaries at Tegucigalpa, on the twentythird day of June, one thousand nine hundred and eight, the original of which Convention, being in the English and Spanish languages, is word for word as follows:

consent, will be considered by the United States as citizens of the Republic of Honduras. Reciprocally, Honduraneans who may or shall have been naturalized in the United States upon their own application or with their own consent, will be considered by the Republic of Honduras as citizens of the United States.

ARTICLE II

If a Honduranean, naturalized in the United States of America, renews his residence in Honduras, without intent to return to the United States, he may be held to have renounced his naturalization in the United States. Reciprocally, if a citizen of the United States, naturalized in Honduras, renews his residence in the United States, without intent to return to Honduras, he may be presumed to have renounced his naturalization in Honduras.

The intent not to return may be held to exist when the person naturalized in the one country, resides mores than two years in the other country, but this presumption may be destroyed by evidence to the contrary.

ARTICLE III

It is mutually agreed that the definition of the word "citizen,' as used in this Convention, shall be held to mean a person to whom the nationality of the United States or of Honduras attaches.

ARTICLE IV

A recognized citizen of the one party, returning to the territory of the other, remains liable to trial and legal punishment for an action punishable by the laws of his original country and committed before his emigration, but not for the emigration itself, saving always the limitation established by the laws of his original country, and any other remission of liability to punishment.

ARTÍCULO II

Recíprocamente, si un ciudadano de los Estados Unidos, naturalizado en Honduras, renueva su residencia en los Estados Unidos, sin intención de regresar á Honduras, se podrá considerar que ha renunciado á su naturalización en Honduras.

Podrá entenderse que existe la intención de no regresar al país respectivo cuando la persona naturalizada en uno de ellos resida por más de dos años en el otro; pero esta presunción podrá ser desvirtuada por prueba en contrario.

ARTÍCULO III

Es convenido por ambas Partes que la palabra "ciudadano," usada en esta Convención, se entenderá que significa una persona á quien sea inherente la nacionalidad de los Estados Unidos ó de Honduras.

ARTICLE V

The declaration of intention to become a citizen of the one or the other country has not for either party the effect of naturalization.

ARTICLE VI

The present Convention shall go into effect immediately on the exchange of ratifications, and in the event of either party giving the other notice of its intention to terminate the Convention it shall continue to be in effect for one year more, to count from the date of such notice.

La declaración del propósito de hacerse ciudadano de uno ú otro de los dos países, no surtirá para ninguno de ellos los efectos de la naturalización.

ARTÍCULO VI

Esta Convención entrará en vigor inmediatamente después del canje de las ratificaciones, y durará hasta un año después de la fecha en que una de las Partes Contratantes hava comunicado á la otra su intención de darla por terminada.

La presente Convención será sometida á la aprobación y ratificación de las autoridades competentes de cada uno de los países signatarios, y las ratificaciones serán canjeadas en Washington ó Tegucigalpa dentro de veinticuatro meses contados desde esta fecha.

En fe de lo cual, los Plenipotenciarios de Estados Unidos de América y de Honduras, han firmado esta Convención en dos ejemplares, que autorizan con sus respectivos sellos, en la ciudad de Tegucigalpa, á veintitrés de junio de mil novecientos ocho.

ARRANGEMENT.

Le Gouvernement des Etats-Unis d'Amérique et le Gouvernement IMPÉRIAL de Russie ayant jugé utile de régler réciproquement la situation des sociétés par actions (anonymes) et autres associations commerciales, industrielles ou financières, les soussignés, en vertu de l'autorisation qui leur a été conférée, sont convenus de ce qui suit:

1.-Les sociétés par actions (anonymes) et autres associations commerciales, industrielles ou financières domiciliées dans l'un des deux pays et à condition qu'elles y aient été validement constituées conformément aux lois en vigueur, seront reconnues comme ayant l'existence légale dans l'autre pays et elles y auront notamment le droit d'ester en justice devant les tribunaux, soit pour intenter une action, soit pour s'y défendre.

2. En tout cas les dites sociétés et associations jouiront dans l'autre pays des mêmes droits qui sont ou seront accordés à des sociétés similaires de tout autre pays.

3.-Il est entendu que la stipulation qui précède ne concerne point Effect, la question de savoir si une pareille société constituée dans l'un des deux pays sera admise ou non dans l'autre pays pour y exercer son commerce ou son industrie, cette admission restant toujours soumise aux prescriptions qui existent à cet égard dans ce dernier pays.

Le présent arrangement entrera en vigueur le 25/12 Juin 1904 et il Duration. ne cessera ses effets qu'un an après la dénonciation qui en serait faite part ou d'autre.
