AGREEMENT. THE GOVERNMENT OF THE UNITED STATES and THE IMPERIAL RUSSIAN GOVERNMENT having judged that it would be mutually useful to regulate the position of Corporations or Stock Companies and other Commercial Associations, industrial or financial, the undersigned, by virtue of the authority which has been vested in them, have agreed as follows: 1.-Corporations or Stock Companies, and other industrial or financial commercial organizations, domiciled in one of the two countries, and on the condition that they have been regularly organized in conformity to the laws in force in that country, shall be recognized as having a legal existence in the other country, and shall have therein especially the right to appear before the courts, whether for the purpose of bringing an action or of defending themselves against one. 2. In all cases the said Corporations and Companies shall enjoy in the other country the same rights which are or may be granted to similar companies of other countries. 3. It is understood that the foregoing stipulation or agreement has no bearing upon the question whether a Society or Corporation organized in one of the two countries will or will not be permitted to transact its business or industry in the other, this permission remaining always subject to the regulations in this respect existing in the latter country. This Agreement shall go into force on the 25/12 of June 1904, and shall only be discontinued one year after its denunciation shall have been made by one of the parties to the agreement. August 10, 1908. BY THE PRESIDENT OF THE UNITED STATES OF AMERICA. A PROCLAMATION. Whereas a Naturalization Convention between the United States of America and the Oriental Republic of Uruguay was concluded and signed by their respective Plenipotentiaries at Montevideo on the tenth day of August, one thousand nine hundred and eight, the original of which Convention, being in the English and Spanish languages, is word for word as follows: Naturalization Convention between the United States of America and the Oriental Republic of Uruguay The President of the United States of America and the President of the Oriental Republic of Uruguay, desiring to regulate the citizenship of those persons who emigrate from the United States to Uruguay, or from Uruguay to the United States, have resolved to conclude a convention on this subject and for that purpose have appointed their Plenipotentiaries, to wit: The President of the United States: Edward C. O'Brien, Envoy Extraordinary and Minister Plenipotentiary of the United States in Uruguay; The President of Uruguay: Antonio Bachini, Minister for Foreign Affairs of Uruguay; Who, after the mutual communication of their respective full powers, found in good and due form, have agreed upon the following articles: ARTICLE I. Citizens of the United States who may be or shall have been Convención de Naturalización celebrada entre los Estados Unidos de América y la República Oriental del Uruguay. Estados Unidos de América y el Presidente de la República Oriental del Uruguay regularizar la ciudadanía de las personas que emigran de los Estados Unidos al Uruguay, ó del Uruguay á los Estados Unidos, han resuelto celebrar una convención á este respecto y para ese objeto han designado sus Plenipotenciarios, á saber: El Presidente de los Estados Unidos á Edward C. O'Brien, su Enviado Extraordinario y Ministro Plenipotenciario en el Uruguay; El Presidente de la República Oriental del Uruguay, al señor Antonio Bachini, su Ministro Secretario de Estado en el Departamento de Relaciones Ex teriores; Quiénes, después de la mútua comunicación de sus respectivos plenos poderes, hallados en buena y debida forma, han convenido en los siguientes artículos: ARTÍCULO 1. Plenipotentiaries. hubieren naturalizado en la República del Uruguay por su propio pedido ó por su propio consentimiento, serán considerados por los Estados Unidos como ciudadanos de la República del Uruguay. Recíprocamente, los Uruguayos que se naturalicen ó se hubieren naturalizado en los Estados Unidos, por su propio pedido ó por su propio consentimiento, serán considerados por la República del Uruguay como ciudadanos de los Estados Unidos. ARTÍCULO II. Si un uruguayo, naturalizado en los Estados Unidos, renueva su residencia en el Uruguay, sin intención de regresar á los Estados Unidos, podrá tenérsele como habiendo renunciado á su naturalización en los Estados Unidos. Recíprocamente, si un Americano, naturalizado en el Uruguay, renueva su residencia en los Estados Unidos, sin intención de regresar al Uruguay, podrá tenérsele como habiendo renunciado á su naturalización en el Uruguay. La intención de no regresar podrá tenerse como existente cuando la persona naturalizada en un país reside más de dos años en el otro, pero esta presunción puede destruirse por testimonio en contrario. ARTÍCULO III. Queda mútuamente convenido que la palabra ciudadano usada en esta convención, se tendrá como el significado de una persona á quien corresponde la nacionalidad de los Estados Unidos ó del Uruguay. ARTÍCULO IV. El ciudadano reconocido por una parte, que regrese al territorio de la otra, queda sujeto a juicio y penalidad legal por cualquier acción castigada por las leyes de su país primitivo que hubiese cometido antes de su emigración, pero no por el hecho mismo de la ways the limitation established by the laws of his original country, or any other remission of liability to punishment. ARTICLE V. The declaration of an intention to become a citizen of the one or the other country has not for either party the effect of citizenship legally acquired. ARTICLE VI. The present convention shall remain in force for ten years from the date of the exchange of ratifications; and unless one of the contracting parties shall notify the other of its intention to terminate it one year before the expiration of that period, the said treaty shall continue in force from year to year until the expiration of one year after official notice shall have been given by either of the contracting governments of a purpose to terminate it. ARTICLE VII. The present treaty shall be submitted to the approval and ratification of the respective appropriate authorities of each of the contracting parties, and the ratifications shall be exchanged at Montevideo as soon as possible. In witness whereof, the respective Plenipotentiaries have signed the foregoing articles, and have affixed their seals.
