Falls and the adjacent lands on both the American and Canadian sides, as an International park, to insure the preservation of the Falls as one of the great natural wonders of the world; and also to enter into a treaty to regulate the amount of water which may be drawn for any purpose by the citizens of either country from the Niagara river above the said Niagara Falls; and, be it further

Resolved, That copies of this resolution be forwarded to the President of the United States and to each United States Senator in Congress from this State.

Mr. Grady moved that said resolution be referred to the committee on finance.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Cassidy moved that the committee of the whole be discharged from the further consideration of Senate bill No. 129, entitled "An act providing that no moneys shall be paid by life insurance, railroad, gas and electric light or power, telephone, banking, public service and transportation corporations and trust companies, to persons engaged in promoting or opposing legisla tion, unless a separate record thereof is kept by said corpora tions and a report of such payments made annually to the Secretary of State" (Int. No. 14), and that the same be recommitted to the committee on codes for a hearing.

By unanimous consent, the motion was withdrawn.
Mr. Raines moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Whereupon, the Senate adjourned.

Mr. Saxe (by request) introduced a bill entitled "An act to establish and maintain a convalescent and recreation seashore colony of the city of New York" (Int. No. 156), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Marks introduced a bill entitled "An act to amend the Code of Civil Procedure relating to the number of jurors to be drawn for each term of court of record in New York county" (Int. No. 157), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on codes.

Mr. Carpenter introduced a bill entitled "An act to divide the Second Judicial District into two judicial districts, to be known as the Second Judicial District and the Ninth Judicial District, and to increase the number of the justices of the Supreme Court in the First Judicial District and also in the said Second and Ninth Judicial Districts hereby constituted" (Int. No. 158), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Cassidy introduced a bill entitled "An act to authorize the town board of the town of Tyrone, county of Schuyler, to consolidate election districts in such town" (Int. No. 159), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

Also, a bill entitled "An act to provide for the repairing and improving of the harbor and breakwater, in Seneca lake, at Watkins, on the Chemung canal, and making an appropriation therefor" (Int. No. 160), which was read the first time, and by unani

Mr. Raines introduced a bill entitled "An act to amend chapter 909 of the Laws of 1896, entitled 'An act in relation to the elections, constituting chapter 6 of the general laws,' relating to recounting and recanvassing the votes and judicial investigation of ballots cast at elections heretofore and hereafter held" (Int. No. 161), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Stevens introduced a bill entitled "An act to amend the Banking Law so as to require trust companies to keep a lawful money' reserve (Int. No. 162), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

Mr. Keenan introduced a bill entitled "An act to amend chapter 615 of the Laws of 1895, entitled 'An act providing for the payment of $500 to the executor or administrator of a volunteer fireman who dies from injuries incurred in the performance of his duties" (Int. No. 163), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Coggeshall introduced a bill entitled "An act making an appropriation to the Central New York Institution for DeafMutes, at Rome, to enable it to extinguish its debt incurred for the support and education of its deaf and dumb pupils and for the paving of the street fronting its property" (Int. No. 164), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill entitled "An act making an appropriation for paying the State's proportion of the cost and expense of eliminating certain grade crossings in the city of Utica" (Int. No. 165), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Coggeshall, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on finance, retaining its place on the order of third reading.

Mr. Cooper introduced a bill entitled "An act to provide for the erection of a suitable monument in commemoration of the soldiers of the Tenth Regiment, New York State Volunteers Infantry (National Zouaves), who were engaged in the battle of Second Bull Run or Manassas Plains, State of Virginia, August 30, 1862, and making an appropriation therefor" (Int. No. 166), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill entitled "An act to amend chapter 704 of the Laws of 1901, being an act, entitled 'An act to make the office of the clerk of the county of Kings a salaried office and regulating the management of said office'" (Int. No. 167), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Also, a bill entitled "An act to amend chapter 137 of the Laws of 1886, entitled 'An act to incorporate the State executive committee of the Young Men's Christian Associations of the State of New York' in respect to trustees and the election thereof " (Int. No. 168), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Malby, from the committee on finance, to which was referred the bill introduced by Mr. Malby, Int. No. 86, entitled. "An act making appropriations to the State Commissioner of Excise for the payment of refunds on surrender of liquor tax certificates" (No. 86), reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

Mr. Elsberg, from the committee on codes, to which was referred the bill introduced by Mr. Marks, Int. No. 115, entitled "An act to amend section 1024 of the Code of Civil Procedure relating to qualifications of a referee" (No. 115), reported in favor of the passage of the same with some amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Elsberg, from the committee on codes, to which was referred the bill introduced by Mr. Marks, Int. No. 80, entitled "An act to amend subdivision 5 of section 3228 of the Code of Civil Procedure, relating to costs" (No. 80), reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

Mr. Elsberg, from the committee on codes, to which was referred the bill introduced by Mr. Page, Int. No. 110, entitled "An act to amend section 791 of the Code of Civil Procedure relative to actions by receivers" (No. 110), reported in favor of the passage of the same, which report was agreed to and said bill restored to its place on the order of third reading.

No. 107, entitled "An act to amend subdivisions 2 and 3 of section 15 of article 2 and section 121 of article 4 of chapter 300 of the Laws of 1904, entitled 'An act to revise and consolidate the several acts relative to the city of Niagara Falls' in relation to aldermen" (No. 107), reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.
