A quorum of all the Senators and Members of the Assembly not being present and voting, the President of the Senate announced that the joint assembly had made no choice for Senator in Congress to succeed Chauncey M. Depew, whose term of office expired on the 4th day of March, 1911.

On motion of Mr. Wagner, the joint assembly took a recess until 5 o'clock P. M. to-day.

The Senate having retired, Mr. Speaker announced that the Senate and Assembly had been in joint assembly for the election of a Senator in Congress, that a majority of the Senators and Members of Assembly not being present and voting no choice had been made and that the joint assembly had taken a recess until 5 o'clock P. M. to-day.

On motion of Mr. A. E. Smith, the House took a recess until 4:45 o'clock P. M.

The House again convened.

The Senate sent for concurrence the following entitled bills: "An act to amend the County Law, in relation to the salary of the surrogate of Oneida county" (No. 439, Rec. No. 102), which was read the first time and referred to the committee on the judiciary.

"An act to release to the next of kin and heirs-at-law of Philip

Grimes all the right, title and interest of the people of the State of New York in and to the personal and real property and estate whereof Catherine Grimes, widow of Philip Grimes, late of the city of Albany, New York, died seized and possessed" (No. 821, Rec. No. 103), which was read the first time and referred to the committee on ways and means.

"An act to release the interest of the State of New York in the property and estate of Emma Augusta White, deceased, to the heirs and next of kin of Benjamin F. White, deceased, and Mary White, deceased" (No. 551, Rec. No. 104), which was read the first time and referred to the committee on ways and means.

By unanimous consent, Mr. Walker introduced a bill entitled "An act to improve the water-front facilities of the city of New York, in relation to the receipt, delivery and shipment of freight” (Int. No. 1269), which was read the first time and referred to the committee on affairs of cities.

Also, "An act to amend the Transportation Corporations Law by adding thereto an additional article, ten-a, providing for the incorporation of freight terminal companies" (Int. No. 1260), which was read the first time and referred to the committee on railroads.

By unanimous consent, Mr. Foley introduced a bill entitled "An act constituting the charter of the city of New York" (Int. No. 1261), which was read the first time and referred to the committee on affairs of cities.

Mr. A. E. Smith moved a call of the members of the House. Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative.

Mr. A. J. Levy, from the committee on the judiciary, to which was referred Assembly bill introduced by Mr. McElligott (No. 1103, Int. No. 988), entitled "An act to amend the Decedent Estate Law, in relation to the rights of a surviving husband in the personal estate of his wife."

Also, Assembly bill introduced by Mr. A. J. Levy (No. 556, Int. No. 539), entitled "An act to amend chapter fifty-seven of the Laws of eighteen hundred and eighty-three, entitled 'An act for the preservation of public records, maps and papers,' in relation to the compensation of persons employed in such work.”

Also, Assembly bill introduced by Mr. W. R. Herrick (No. 365, Int. No. 358), entitled "An act to amend the Civil Service. Law, in relation to taxpayer's action."

Also, Assembly bill introduced by Mr. Goldstein (No. 968, Int. No. 877), entitled "An act to amend the Judiciary Law, in relation to salaries of clerks to justices of Appellate Division of the second department and to salaries of clerks to justices of the Supreme Court in the second judicial district," reported in favor of the passage of the same without amendment, which report was agreed to, and said bills placed on the order of second reading.

No. 254), entitled "An act to amend chapter fifteen of the Laws of nineteen hundred and nine, entitled 'An act in relation to the civil service of the State of New York and the civil divisions and cities thereof, constituting chapter seven of the Consolidated Laws,' as amended by chapter two hundred and sixtyfour of the Laws of nineteen hundred and ten, in relation to the power of removal," reported in favor of the passage of the same without amendment, which report was agreed to, and said bill placed on the order of second reading.

Mr. A. J. Levy, from the committee on the judiciary, to which was referred Senate bill introduced by Mr. Wainwright (No. 554, Rec. No. 48), entitled "An act to legalize all marriages heretofore solemnized by certain police justices and acting police justices of the village of Port Chester, Westchester county."

Also, Senate bill introduced by Mr. Stilwell (No. 404, Rec. No. 87), entitled "An act to amend ‘An act in relation to legislation, constituting chapter thirty-two of the Consolidated Laws,' in regard to the publication of laws passed by the Legislature, in four newspapers in the county of New York," reported in favor of the passage of the same without amendment, which report was agreed to, and said bills placed on the order of second reading.

Mr. Goldberg, from the committee on taxation and retrenchment, to which was referred Assembly bill introduced by Mr. Merritt (No. 1238, Int. No. 1071), entitled "An act to amend the Tax Law, in relation to the levy and collection of a poll tax."

Also, Assembly bill introduced by Mr. Goldberg (No. 504, Int. No. 493), entitled "An act to amend the Tax Law, in relation to tax districts."
