The said engrossed bill, entitled "An act to empower the commissioners of highways of the town of Watervliet to open a highway in said town," was read the third time.

Resolved, That the bill do pass.

The said engrossed bill, entitled "An act relative to the collection of taxes in the town of Franklinville in the county of Cattaraugus," was read the third time.

Resolved, That the bill do pass.

Ordered, That the clerk deliver the said bills to the Senate, and request their concurrence in the same.

The House then again resolved itself into a committee of the whole, on the engrossed bill from the Senate, entitled "An act to incorporate the Newburgh whaling company;" and after some time spent thereon, Mr. Speaker resumed the chair, and Mr. Seymour, from the said committee, reported, that the committee had gone through the said bill, made amendments thereto, and agreed to the same; which he was directed to report to the House, and he read the report in his place, and delivered the same in at the table, where it was again read and agreed to by the House, and the amendments ordered to be engrossed, and the bill ordered to a third reading.

The House then resolved itself into a committee of the whole, on the engrossed bill from the Senate, entitled "An act respecting the loan officers of the city and county of New-York ;" and after some time spent thereon, Mr. Speaker resumed the chair, and Mr. Hiram Bennett, from the said committee, reported progress.

Thereupon,

Ordered, That the committee of the whole be discharged from the further consideration of the said bil!, and that the same be referred to the committee on ways and means.

The House then resolved itself into a committee of the whole, on the bill entitled "An act relative to the oath of office of justices of the peace;" and after some time spent thereon, Mr. Speaker resumed the chair, and Mr. Kemble, from the said committee, reported, that the committee had gone through the said bill, and agreed to the same without amendment; which he was directed to report to the House, and he read the report in his place, and delivered the same in at the table, where it was again read, and agreed to by the House. Ordered, That the bill be engrossed.

The House then resolved itself into a committee of the whole, on the bill entitled "An act to incorporate the Hebrew benevolent society of the city of New-York ;" and after some time spent thereon, Mr. Speaker resumed the chair, and Mr. Otis, from the said committee, reported, that the committee had gone through the said bill, and agreed to the same without amendment; which he was directed to report to the House, and he read the report in his place, and delivered the same in at the table, where it was again read, and agreed to by the House.

Ordered, That the bill be engrossed.

The House then resolved itself into a committee of the whole, on the bill entitled "An act to incorporate the New-York annual conference ministers' mutual assistance society;" and after some time

spent thereon, Mr. Speaker resumed the chair, and Mr. Per Lee, from the said committee, reported, that the committee had gone through the said bill, and agreed to the same without amendment; which he was directed to report to the House, and he read the report in his place, and delivered the same in at the table, where it was again read, and agreed to by the House.

Ordered, That the bill be engrossed.

'The House then resolved itself into a comınittee of the whole, on the bill entitled " An act to divide the town of Pembroke in the county of Genesee ;" and after some time spent thereon, Mr. Speaker resumed the chair, and Mr. T. Smith, from the said committee, reported, that the committee had gone through the said bill, and agreed to the same without amendment; which he was directed to report to the House, and he read the report in his place, and delivered the same in at the table, where it was again read, and agreed to by the House.

Ordered, That the bill be engrossed.

And then the House adjourned until eleven o'clock to-morrow morning.

The House met pursuant to adjournment.

The petition of sundry inhabitants of the town of Elba in the county of Genesee, praying for the incorporation of a bank, to be located at Albion in said county, was read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

Four several petitions of sundry inhabitants of the counties of Monroe, Livingston, Genesee, Chautauque and Cattaraugus, praying for the incorporation of a company to construct a rail-road from Rochester to the Allegany river, were read, and referred to the committee on rail-roads.

Three several petitions of sundry inhabitants of the county of Jefferson, praying for the incorporation of a bank, to be located at Sacket's-Harbor, were read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

The petition of sundry inhabitants of the county of Wayne, pray. ing for the incorporation of a bank, by the name and style of the Bank of Lyons, to be located at the village of Lyons in said county, was read, and referred to the cominittee on the incorporation and alteration of the charters of banking and insurance companies.

The petition of sundry inbabitants of the town of Fabius in the county of Onondaga, praying for the incorporation of a bank, by the

name and style of the Homer Bank, to be located in the village of Homer in the county of Cortland, was read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

The petition of sundry inhabitants of the counties of Erie and Chautauque, praying for the incorporation of a company to construct a rail-road from the village of Buffalo in the county of Erie, to the Pennsylvania line, through the villages of Fredonia and Westfield, was read, and referred to the committee on rail-roads.

The petition of sundry inhabitants of the towns of Greenbush, Sandlake, Schodack and Nassau in the county of Rensselaer, praying for the incorporation of a bank, by the name and style of the Greenbush Bank, to be located in the village of Greenbush in said county, was read, and referred to the committee on the incorporation and alteration of the charters of banking and ir.surance companies.

The petition of sundry inhabitants of the county of Cortland, praying for the incorporation of a bank, by the name and style of the Homer Bank, to be located in the village of Homer in said county, was read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

The petition of Fidler and Taylor and others, inhabitants of the city of Albany, praying for the incorporation of a bank, by the name and style of the Brewers' Bank, to be located in said city, was read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

The remonstrance of sundry inhabitants residing on the west side of the Skaneateles lake in the county of Onondaga, against being included within the bounds of the incorporation of said village, was read, and committed to the committee of the whole when on the bill to which it relates.

The petition of the surrogates of the counties of Genesee, Orleans, Niagara, Cattaraugus, Ontario and Seneca, praying for an alteration of the Revised Statutes relative to wills and testaments, the distribution of estates, the rights, powers and duties of executors and administrators, and of surrogate's courts, was read, and referred to the committee on the judiciary.

The memorial of the trustees of Clinton Academy in the county of Suffolk, relative to the distribution of that portion of the Literature fund assigned to the First Senate district, was read, and referred to the committee on colleges, academies and common schools.

Two several petitions of sundry inhabitants of the town of Willet in the county of Cortland, and the town of Lisle in the county of Broomo, praying for the incorporation of a bank, to be located in the village of Cortland in the county of Cortland, were read, and referred to the committee on the incorporation and alteration of the charters of banking and insurance companies.

The petition of sundry inhabitants of the county of Allegany, praying for the incorporation of a company to construct a rail-road from the city or county of New York, by the way of the village of Owego in the county of Tioga, to that part of Lake Erie lying between the mouth of the Cattaraugus creek and the Pennsylvania line, was read, and referred to the committee on rail-roads.

Mr. Tilford, from the committee on the erection and division of towns and counties, to which was reserred the several petitions praying for a division of the town of Deerfield in the county of Oneida, reported a bill, entitled “An act to divide the town of Deerfield in the county of Oneida ;" which was read the first time, and by unanimous consent was also read a second time, and committed to a committee of the whole house.

Mr. Otis, from the committee on the judiciary, in pursuance of a resolution of yesterday, relative to the recording of mortgages on personal property, reported a bill, entitled “ An act relative to the recording of mortgages of personal property;" which was read the first time, and by unanimous consent was also read a second time, and committed to a committee of the whole house.

Ordered, That the usual number of copies of the said bill be printed for the use of the Legislature.

Mr. Tilford, from the committee on the erection and division of towns and counties, to whom was referred the petition of sundry inhabitants of Alabama and Elba in the county of Genesee, for the erection of a new town from parts of said towns, reported; and offered the following resolution :

[See Document No. 57.] Resolved, That the petitioners be allowed to withdraw their petition and papers.

Mr. Speaker put the question whether the House would agree to the said resolution, and it was determined in the affirmative.

A communication from Jonas Earll junior, was read, in the words following, to wit:

Mr. Varian, from the committee on engrossed bills, reported, that the committee have examined the engrossed bill entitled "An act relative to the oath of office of justices of the peace;" the engrossed bill entitled "An act to divide the town of Pembroke in the county of Genesec;" the engrossed bill entitled "An act to incorporate the Hebrew benevolent society of the city of New-York ;" and the engrossed bill entitled "An act to incorporate the New-York annual conference ministers assistance society;" and find the said bills severally correctly engrossed.

Ordered, That the said bills be laid upon the table.

The engrossed bill from the Senate, entitled "An act to incorporate the Newburgh whaling company," with the engrossed amendments, was read the third time.
