The sum of five million dollars ($5,000,000), or so much thereof as may be necessary, is hereby appropriated to the New York state department of labor out of any moneys in the general fund to the credit of the state purposes account not otherwise appropriated, for services and expenses in connection with the emergency employment intervention program, established pursuant to the provisions of this

act, including, but not limited to, contracts with other governmental units, private industry and public and private educational organizations and apportionment to state departments and agencies for the administration and operation of retraining programs for dislocated workers. Moneys hereby appropriated shall be utilized in a manner consistent with the relevant guidelines and standards established by the federal job training partnership act, public law 97300, to ensure that matching requirements established by such act are fulfilled for the federal grant year beginning prior to April first, nineteen hundred eighty-three and the federal grant years beginning on or after April first, nineteen hundred eighty-three. Notwithstanding the provisions of section 5 of section 1 of chapter 525 of the laws of 1983, the agency is authorized after March first, nineteen hundred eighty-five to reapportion any amount of an apportionment otherwise due an eligible county if the agency determines that it cannot obligate such amounts within the state fiscal year beginning April first, nineteen hundred eighty-four for training programs within such eligible county. Notwithstanding the provisions of section 4 of chapter 525 of the laws of 1983, this act shall take effect April first, nineteen hundred eighty-three and shall cease to be in effect April first, nineteen hundred [eighty-five] eighty-six ..(re. $2,000,000)

By chapter 50, section 1, of the laws of 1984, as amended by chapter 257, section 1, of the laws of 1984:

For services and expenses related to youth employment and training programs including on-the-job training, counselling and remediation for disadvantaged youth. Programs shall emphasize improvement in participant's basic educational skills, vocational skills, skills, jobseeking capabilities and work maturity. For the purposes of this program the terms including, but not limited to 'economically disadvantaged', 'service 'service delivery. delivery areas' and 'private industry councils' shall be defined as set forth in the federal job training partnership act PL97-300. These monies, subject to the limits of the appropriation and the approval of the director of the budget, shall be apportioned to employment and training providers on a competitive basis ensuring adequate geographic distribution representing urban and rural communities, based on factors including but not limited to the number of economically disadvantaged youth, the youth unemployment rate and the high school dropout rate. The employment and training providers for program operation shall be designated no later than June first, nineteen hundred eighty-four. The state education department shall be responsible for advising the department of labor regarding educational program components. The department of labor shall submit to the governor and to the legislature report that includes an evaluation of factors such as changes in dropout rates, participants' educational competencies as measured by ac

Notwithstanding any inconsistent provision of law, wages and income earned by participants in the youth employment and training program authorized by this chapter, who are receiving assistance under the home relief, veterans assistance, or aid to dependent children program pursuant to the social services law, shall be exempt and disregarded in determining need for such assistance in accordance with federal law and regulations governing the aid to dependent children program. No more than five percent of the total monies available pursuant to this appropriation shall be retained by the department of labor for administration including program monitoring and fiscal auditing, provided further that all remaining monies shall be made available by the department of labor for employment and training programs. Sixty percent of the monies available for employment and training programs pursuant to this appropriation shall be allocated to four urban and four rural service delivery areas for the purposes of providing in-school youth employment and training programs for disadvantaged youth 16 and 17 years of age, who agree to meet certain school attendance and performance standards. Preference shall be given to students who are at risk of dropping out of school. Participating youth may be employed for a maximum of 1,000 hours per year for up to one year, with wages subsidized at fifty percent out of monies appropriated herein. The service delivery areas shall provide services and participant assistance equivalent to fifty percent of the amount made available pursuant to this program. Forty percent of monies available for employment and training programs shall be awarded to organizations including but not limited to public agencies, private business firms, labor unions and not-forprofit corporations for the purposes of providing youth employment and training programs for disadvantaged, out-of-school youth 16 through 18 years of age. Preference shall be given to youth. Participating youth may be employed for a maximum of 1,000 hours per year for up to one year (re. $1,000,000)
