On motion of Mr. Van Valkenburgh,

Resolved, That so much of the Governor's message as relates to the State Institution for the Blind, be referred to the committee on ways and means.

On motion of Mr. Pitts,

Resolved, That the papers on file relating to the claim of Jacob Swobe, for canal damages, be taken therefrom and referred to the committee on claims.

On motion of Mr. Pitts,

Resolved, That the papers on file relating to the claim of Anthony

Mason, for damages in the enlargement of the Eric canal, be taken therefrom and referred to the committee on claims.

Mr. Weed offered for the consideration of the House a resolution, in

the words following, to wit:

Resolved, That James J. Hart be appointed as messenger of the Assembly for the session.

Ordered, That said resolution be referred to the committee on expenditures of the House.

Leave of absence was granted Messrs. Maxwell and Phillips, until Tuesday morning next.

Mr. D. P. Wood offered for the consideration of the House a preamble and resolution, in the words following, to wit:

Whereas, The present disagreement between the New York Central Railroad Company, and the Hudson River and Harlem Railroad Companies, is working a serious inconvenience to the traveling public, and is likely to be productive of great damage to the owners of freight, and to change the line of transit for both passengers and freight outside this State; therefore,

Resolved, That the railroad committee be, and they hereby are directed and required to make an immediate investigation of the facts of the case, and at the earliest day practicable, to report the same to this House, together with such a bill as in their judgment the facts established upon such investigation, require for the protection of the public. And said committee are hereby authorized and empowered to send for persons and papers for the accomplishment of such investigation.

The rule being suspended by unanimous consent,

Mr. Speaker put the question whether the House would agree to said resolution, and it was determined in the affirmative.

A message from the Senate was received and read, requesting the concurrence of the Assembly to a resolution in the words following, to wit:

Resolved, (if the Assembly concur,) That our Senators be instructed, and Representatives in Congress be requested, to use their best exertions to promote the passage of a bill imposing a suitable tariff for protection to American labor, and interests-agricultural, manufacturing and commercial, and articles that come in competition with domestic products and manufactures.

Ordered, That said resolution be referred to the committee on Federal relations.

Mr. E. B. Clarke presented a petition of citizens of Otsego county, for State aid, to complete the Albany and Susquehanna railroad, which was read and referred to the committee on ways and means.

Mr. Travis presented seven petitions, in favor of granting the Metropolitan Transit Company the right to construct their proposed railroad, which were read and referred to the committee on railroads.

Mr. Weed presented a petition of citizens of Clinton county, for State aid to the Whitehall and Plattsburg railroad, which was read and referred to the committee on ways and means.

Mr. Gibbs presented a petition of citizens of Delaware county, relative to the construction of the New York and Oswego Midland railroad, which was read and referred to the committee on ways and means.

Mr. Candee presented a petition of citizens of Onondaga county, on same subject, which was read and referred to the same committee. Mr. Hoppin presented a petition of citizens of Madison county, on same subject, which was read and referred to the same committee.

Mr. E. B. Clarke presented a petition of citizens of Otsego county, for increase of salary of school commissioners, which was committed to the committee of the whole.

Mr. Suffern presented a petition of citizens of Rockland county, on the same subject, which was committed to the same committee.

Mr. Crandall presented a petition of citizens of Allegany county, on same subject, which was read and referred to the same committee.

Mr. Gurley presented two petitions of citizens of Troy, for an increase. of salary of Capital Police, which were read and referred to the committee on the affairs of cities.

Mr. Wooster presented the petition of Maria T. Levere, for release of real estate, which was read and referred to the committee on the petitions of aliens.

Mr. Burrows presented the petition of Isaac Holloway, for relief, which was read and referred to the committee on claims.

Also, the petition of Moses H. Johnson, for relief, which was read and referred to the same committee.

Mr. Blauvelt presented the petition of the Dry Dock Painters' Association of the city of New York, for an act of incorporation, which was read and referred to the committee on charitable and religious societies. Mr. Hoppin presented a petition of citizens of the town of Madison, Madison county, relative to the Utica and Clinton railroad, which was read and referred to the committee on railroads.

Mr. Archer, from the committee on colleges, academies and common schools, to which was referred the bill entitled "An act to authorize the trustees of school district No. 16, in the town of Newstead, Erie county, to borrow money," reported in favor of the passage of the same, with amendments; which report was agreed to.

On motion of Mr. Prince, and by unanimous consent, the rules were suspended so far as they relate to said bill, and the same was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.
