SIR: In obedience to the resolution of the House of Representatives of the 14th instant, I have the honor to transmit the accompanying documents, numbered from 1 to 20, giving the information required by the resolution in relation to the payments made to James D. Doty out of the appropriations for the erection of public buildings in the Territory of Wiskonsan.

TREASURY DEPARTMENT, March 7, 1837. SIR By the 13th section of the "act establishing the Territorial Goyernment of Wiskonsan," the sum of twenty thousand dollars is appropriated, to be applied, by the Governor and Legislative Assembly, to defray the expenses of erecting public buildings at the seat of government. I have the honor to submit to you a copy of the act of the Territorial Assembly providing for the erection of those buildings, and also a copy of the bond given to the Territory by James D. Dety, as the treasurer of the commissioners, which officer is authorized by said act to receive the amount of the above-mentioned appropriation. I beg leave to recommend that an

advance be authorized to be made to Mr. Doty of the amount of the ap

propriation.

No. 2.

An act to establish the seat of government of the Territory of Wiskonsan, and to provide for the erection of public buildings.

Section 1. Be it enacted by the Council and House of Representatives of the Territory of Wiskonsan, That the seat of government of the Territory of Wiskonsan be, and the same is hereby, located and established at the town of Madison, between the third and fourth of the four lakes, on the corner of sections thirteen, fourteen, twenty-three, and twentyfour, in township seven north, of range nine east.

Section 2. Be it enacted, That, until the public buildings at the said town of Madison are completed, that is to say, until the 4th day of March, in the year 1839, the sessions of the Legislative Assembly of Wiskonsan Territory shall be held at the town of Burlington, in the county of Des Moines, provided the public buildings are not sooner completed.

Section 3. Be it enacted, That there shall be three commissioners, elected by joint ballot of the Council and House of Representatives, whose duty it shall be to cause the necessary public buildings to be erected at the town of Madison, for the accommodation of the Assembly and other officers of the Territorial Government. The said commissioners, or a majority of them, shall agree upon a plan of said buildings, and shall issue proposals, giving due notice thereof, and contract for the erection of said buildings without delay. They shall elect one of their number treasurer, whose duty it shall be to draw from the Treasury of the United States such sum or sums of money as have been, or may hereafter be, appropriated by Congress towards the erection of the public buildings for the use of said Territory, and shall pay the same, upon the orders of a majority of the said commissioners, to such persons as they may direct. The said treasurer, before he receives the said sums, shall execute a bond to the said Territory, with two or more sureties, to be approved of by the secretary of the Territory, in the penal sum of forty thousand dollars, conditioned for the faithful execution of the duties of his office, and that he will annually render to the Legislative Assembly a true account of all moneys received and paid out by him. And they shall agree upon one of their number to be acting commissioner, whose duty it shall be to superintend daily, in person, the building of said buildings; and the said acting commissioner shall have power, at all times, when he may think proper, to call the board of commissioners together, for the purpose of transacting any business on this subject; and said board shall, in all contracts, reserve the privilege of suspend ng any contract made by them, for the purpose of carrying into effect the object above named, until the matter in dispute shall be settled, if any there shou'd be. The said commissioners shall receive such compensation for their services as may hereafter be allowed by law.

Section 4. Be it enacted, That this act be in force from and after the

Know all men by these presents, that we, James Duane Doty, James Morrison, and John B.Teny, are held and firmly bound to the Territory of Wiskonsan in the penal sum of forty thousand dollars, to the payment of which sum, well and truly to be made, we do bind ourselves, and our and each of our heirs, executors, and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this twenty-sixth day of January, in the year of our Lord one thousand eight hundred and thirty

seven.

The condition of the above obligation is such, that whereas the said James Duane Doty has been duly elected treasurer, pursuant to the third section of the act, entitled "An act to establish the seat of government of the Territory of Wiskonsan, and to provide for the erection of publie buildings," approved December 3, 1836: now, if the said James Duane Doty shall and does faithfully execute the duties of his said office of treasurer and annually render to the Legislative Assembly a true account of all moneys received and paid out by him, then the above obligation shall be null and void, and of none effect; otherwise, be and remain in full force and virtue.

The aforesaid bond and security are approved of by me, in pursuance of the authority vested in me by the 3d section of the act establishing the seat of government of Wiskonsan Territory, approved December 3, 1836. JOHN S. HORNER,

I certify that the foregoing bond is a true copy of the original filed in my office. And I furthermore certify, that James Duane Doty, Esq. J. F. O'Neill, and Augustus H. Bird, were elected commissioners to superintend the erection of public buildings at the seat of government of Wis konsan Territory, as appears by the proceedings of the Legislative As sembly.

In testimony whereof, I have hereunto affixed the "great seal of [L. S.] the Territory," at Belmont, this twenty-ninth day of December, one thousand eight hundred and thirty-seven.

Pay to James D. Doty, treasurer of the board of commissioners, for erecting public buildings in Wiskonsan Territory, or order, out of the ap propriation named in the margin, twenty thousand dollars, on account of his expenditures, and for which sum he is to be charged and held ac ountable. For so doing, this shall be your warrant.

Given under my hand and the seal of the Treasury, this seventh day of March, in the year one thousand eight hundred and thirty-seven, and of independence the sixty-first.

ASTOR, GREEN BAY, August 1, 1838. SIR: By an act passed at the last session of Congress, $20,000 are appropriated for the completion of the public buildings at Madison, the seat government of Wiskonsan, and to be expended by the commissioners camiler and according to the act passed by the Legislative Assembly on the

December, 1836, entitled "An act to establish the seat of government of the Territory of Wiskonsan, and to provide for the erection of yable buildings."

A copy of this act, together with my bond, was forwarded to your Detment in 1836, and upon them I drew the $20,000 which have been pended. By the 3d section of that act, it is made the duty of the treas

to draw from the Treasury of the United States such sum or sums money as have been, or may hereafter be, appropriated by Congress For this object. I do therefore make application for the above sum of 90,000.

The contract has been let for the completion of the buildings, and the extractor is entitled to a payment according to the contract.

Warrants on the land office at this place, Mineral Point, and St. Lou's will be acceptable to the contractor.

TREASURY DEPARTMENT, November 17, 1838

SIR: I have the honor to submit for your consideration a report submitted by the First Auditor, in relation to the charge on the Treasury books against J. D. Doty, Esq., the agent of the Territory of Wiskonsan, in relation to the erection of public buildings authorized by Congress Judge Doty has applied for an advance of the appropriation made at the late session of Congress for completing those buildings. He has given the security required by the act of the Territorial Legislature, referred to in the act of Congress, as appears by a certified copy of his bond now on, file in this Department. By a statement furnished by him, it appears that, he has advanced to the contractor funds to meet the expenditures for the erection of the buildings.

Under these circumstances, I respectfully recommend that the advance asked for be authorized.

TREASURY DEPARTMENT,

First Auditor's Office, November 17, 1888. SIR: By the 13th section of an act of Congress, entitled "An act es tablishing the Territorial Government of Wiskonsan," approved 201 April, 1836, there is this language: "And twenty thousand dollars, to be paid out of any money in the Treasury, not otherwise appropriated, is hereby given to the said Territory, which shall be applied by the Governor and Legislative Assembly to defray the expenses of erecting publis buildings at the seat of government." And it appears, upon reference to an act of the Territorial Legislature, entitled "An act to establish the seat of government of the Territory of Wiskonsan, and to provide for. the erection of public buildings," approved the 3d of December, 1836, that the said Legislature provided for the appointment or election of three commissioners to superintend the erection of said buildings, and for the appointment of one of their number as treasurer, whose duty it was made to draw the said appropriation from the Treasury of the United States.

He was required by said act to execute a bond to the Territory, to be approved by the secretary of the Territory, in the penal sum of forty thousand dollars, for the faithful execution of the duties of his office, an
