Notwithstanding the provisions of subdivision 4-a of section 18-a of the public service law: all moneys committed or expended from the appropriation shall be reimbursed by assessment against gas corporations and electric corporations as defined in section 2 of the public service law, and the total amount which may be charged to any gas corporation and any electric corporation shall not exceed 0.88 cents per one thousand cubic feet of gas sold and 0.0088 cents per kilowatt-hour of electricity sold by such corporations in their intrastate utility operations in calendar year 1990.

The director of the budget shall not issue a certificate of approval with respect to the commitment and expenditure of moneys hereby appropriated until the chairman of the authority shall have submitted, and the director of the budget shall have approved, a comprehensive financial plan encompassing all moneys available to and all anticipated commitments and expenditures by the authority from any source for the operations of the authority for the period covered by this appropriation. Copies of the approved comprehensive financial plan shall be immediately submitted by the director of the budget to the chairmen and secretaries of the legislative fiscal committees.

Notwithstanding any other provision of law, the commissioner of health shall not enter into any contracts with utilization review agents without the approval of the director of the budget.

ADMINISTRATION AND EXECUTIVE DIRECTION PROGRAM

Notwithstanding any other provision of law, no pharmaceutical insurance contracts for the elderly pharmaceutical insurance coverage program pursuant to article 19-K of the executive law, shall be entered into without the approval of the director of the budget.
