CHAPTER LXXI.

AN ACT TO CONFER THE JURISDICTION AND POWERS HERETOFORE EXERCISED BY THE CHIEF JUSTICES OF THE SEVERAL COUNTIES OF THIS STATE, UNDER AN ACT APPROVED JANUARY 13, 1862, ENTITLED "AN ACT TO AMEND SECTION FIFTH OF AN

ACT ENTITLED AN ACT TO PROVIDE FOR THE ORGANIZATION OF THE STATE LUNATIC ASYLUM,' AND OTHER PURPOSES, UPON THE PRESIDING JUSTICES.

SECTION 1. Be it enacted by the Legislature of the State of Texas, That the jurisdiction, powers, and duties conferred upon and exercised by the chief justice in this State, under the provivisions of an act entitled "An act to amend section fifth of an act entitled An act to provide for the organization of the State Lunatic

Asylum,' ," and for the care and maintenance of the same, shall hereafter be conferred upon and exercised by the presiding justices of the several counties of this State; and they are by virtue of this act fully invested with the jurisdiction, duties and powers heretofore conferred upon chief justices, any law or usage to the contrary notwithstanding; and said presiding justices shall receive the same fees heretofore provided by law for such services.

SEC. 2. That this act take effect and be in force from and after its passage.

CHAPTER LXXII.

AN ACT SUPPLEMENTARY TO AN ACT ENTITLED AN ACT PRESCRIBING THE TIMES OF HOLDING THE DISTRICT COURTS IN THE

SEVERAL JUDICIAL DISTRICTS IN THE STATE," approved auguST 10, 1870.

SECTION 1. Be it enacted by the Legislature of the State of Texas, That the District Courts of the county of San Jacinto be holden on the fourth Mondays in September, January and May, and may continue in session one week.

SEC. 2. This act take effect and be in force from and after its passage.

Approved August 15, 1870.

CHAPTER LXXIII.

AN ACT TO MAKE APPROPRIATION TO PAY FEES OF JUSTICES OF THE PEACE AND PEACE OFFICERS IN CRIMINAL PROSECUTIONS BEFORE JUSTICES OF THE PEACE.

SECTION 1. Be it enacted by the Legislature of the State of Texas, That the sum of five thousand dollars, or so much thereof as may be necessary, be and the same is hereby appropriated out of any money in the treasury, not otherwise appropriated, for the purpose of paying the fees of justices of the peace and peace officers, arising under the provisions of an act entitled "An act to organize

the courts of justices of the peace and County Courts, and to define their jurisdiction and duties."

SEC. 2. That this act take effect and be in force from and after its passage.

CHAPTER LXXIV.

AN ACT SUPPLEMENTAL TO AN ACT TO PROVIDE FOR DISTRICTING THE STATE OF TEXAS INTO JUDICIAL DISTRICTS, APPROVED JULY 2, 1870, AND SUPPLEMENTAL TO AN ACT PRESCRIBING THE TIME OF HOLDING THE TERMS OF THE DISTRICT COURT, APPROVED AUGUST 10, 1870.

SECTION 1. Be it enacted by the Legislature of the State of Texas, That the county of Delta be and the same is hereby attached to the Eighth Judicial District, and shall constitute and form a part thereof.

SEC. 2. That the terms of the District Court shall be holden in said county of Delta on the fourth Mondays of December, April and August, of each year, and may continue in session one week.

SEC. 3. This act shall take effect and be in force from its passage.

CHAPTER LXXV.

AN ACT SUPPLEMENTARY TO AN ACT ENTITLED AN ACT TO PROVIDE FOR DISTRICTING THE STATE OF TEXAS INTO JUDICIAL DISTRICTS, APPROVED JULY 2, A. D. 1870.

SECTION 1. Be it enacted by the Legislature of the State of Texas, That the county of San Jacinto be and the same is hereby attached to and made a part of the Thirtieth Judicial District of the State of Texas.

SEO. 2. Be it further enacted, That this act take effect and be in force from and after its passage.

CHAPTER LXXVI.

AN ACT DEFINING THE HOMESTEAD AND OTHER PROPERTY EXEMPT FROM FORCED SALE IN THIS STATE.

SECTION 1. Be it enacted by the Legislature of the State of Teras, That the homestead of a family, not to exceed two hundred acres of land (not included in a city, town or village,) or any city, town or village lot or lots, not to exceed five thousand dollars in value at the time of their destination as a homestead, and without reference to the value of any improvements thereon, shall not be subject to forced sale for debts, except for the purchase money thereof, or for taxes, or labor and materials expended thereon.

SEC. 2. There shall also be reserved to every family in this State, free and exempt from forced sale for debts, the following property: All household and kitchen furniture; all implements of husbandry; all tools and apparatus belonging to any trade or profession, and all books belonging to private or public libraries; five milch cows and calves; two yoke of work oxen; two horses and one wagon; one carriage or buggy; one gun; twenty hogs; twenty head of sheep; all provisions and forage on hand for home consumption; all saddles, bridles and harness necessary for the use of the family; and to every citizen not a head of a family, one horse, bridle and saddle, all wearing apparel, all tools, apparatus and books belonging to his private library.

SEC. 3. That all laws and parts of laws contravening the provisions of this act, be and the same are hereby repealed; this act to take effect and be in force from and after its passage. Approved August 15, 1870.

AN ACT FOR THE RELIEF OF PERSONS FORMERLY IN BONDAGE.

Be it enacted by the Legislature of the State of Texas, as follows:
