Mr. Baucus introduced a bill entitled "An act to extend and increase the corporate powers of the Saratoga, Mt. McGregor and Lake George Railroad Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

Mr. Daly, by request, introduced a bill entitled "An act to provide for the appointment of Commissioners of Lunacy in the various counties in this State," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public health.

Also, a bill entitled "An act amend chapter 1 of title 10 of chapter of the Laws of 1881, entitled 'An act to establish a penal code," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Grady introduced a bill entitled "An act relating to banking institutions," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

Mr. H. A. Nelson introduced a bill entitled "An act to enable the several cities and towns of the State which have not already done so to refund the money expended in furnishing substitutes, or in commutation by men who were drafted into the military service of the United States, and held to service in the several drafts under the conscription act of the United States, entitled 'An act for enrolling and calling out the national forces and for other purposes,' approved March 3, 1863, and the acts amendatory thereof, while the option of commutation by the payment of $300 remained, and for the relief of the men who entered the service under said drafts," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs.

On motion of Mr. Roberts, and by unanimous consent, the Senate then went into executive session, and after some time spent therein, the doors were opened and the Senate resumed legislative business.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to repeal title 7, chapter 20, part 1, volume 1 of the Revised Statutes, concerning the importation into this State of persons held in slavery, their exportation, their services, and prohibiting their sale."

"An act to change the name of the Marine Court of the city of New York to the "City Court of New York."

"An act to release all the estate, right, title and interest of the people of the State of New York in and to certain real estate in the village of Norwich, in the county of Chenango and State of New York, of which Johanna Holmes died seized unto Catharine Hayes, James Hayes, and the heirs at law of Joanna Hayes, deceased, grandchildren and only devisees under the last will and testament of Johanna Holmes, deceased."

After some time spent therein, the President resumed the chair, and Mr. Pitts, from said committee, reported in favor of the passage of

the above named bills, which report was agreed to, and the same ordered engrossed for a third reading.

Mr. McCarthy offered the following:

Resolved (if the Assembly concur), That there be printed 1,500 copies of the Sixteenth Annual Report of the State Board of Charities, 1,000 copies in paper covers, and 500 copies bound in muslin, for the use of the Board.

Ordered, That said resolution be referred to the committee on public printing.

Mr. A. Lansing offered the following:

Resolved (if the Assembly concur), That the trustees of the State Museum be requested to report to the Legislature, within ten days, what additional accommodations are necessary for the proper preservation and exhibition of the collections belonging to the State; also, what further measures should be taken for maintaining and conducting said. museum in a condition of greatest efficiency and of rendering it of the greatest value to the citizens of the State; and also plans for completing the publication of the natural history of the State.

By unanimous consent,

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to amend the Code of Civil Procedure."

After some time spent therein, the President resumed the chair, and Mr. H. A. Nelson, from said committee, reported in favor of the passage of the above-named bills, which report was agreed to, and the same ordered engrossed for a third reading.

On motion of Mr. Fitzgerald, and by unanimous consent, the Senate, open executive session, confirmed the nomination of certain notaries public.

On motion, the Senate resumed legislative business.

Mr. Jones, from the committee on public printing, to which was referred the resolution to print extra copies of the Annual Report of the Canal Appraisers, reported in favor of the adoption of the following resolution:

Resolved (if the Assembly concur), That 250 copies of the Annual Report of the Canal Appraisers be printed, with paper covers, for the use of the Appraisers.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, as follows:

After some time spent therein, the President resumed the chair, and Mr. Thomas, from said committee, reported in favor of the passage of the first-named bill, with amendments, which report was agreed to, and the same ordered engrossed for a third reading.

Mr. Thomas, from the same con.mittee, reported in favor of the passage of the last-named bill, which report was agreed to, and the same ordered engrossed for a third reading.

On motion of Mr. Daly, and by unanimous consent, the Senate, in open executive session, confirmed the nomination of certain notaries public.

Resuming legislative business,

Mr. Browning offered the following:

Whereas, Section 2, chapter 295, of the Laws of 1882, making an appropriation for the New Capitol, provides that no portion of said appropriation shall be expended upon material or work for a main tower, the east front approaches or grounds, the porticos east, west, north or south, the east or west staircases or other staircases; and Whereas, It appears by the reference made by the Governor in his annual message to the Legislature that a portion of said appropriation was used for the east front and roof and the carrying up of the main tower in apparent violation of section 2, chapter 295, Laws of 1882; therefore,

Resolved, That the committee on finance be authorized and directed to inquire if the commissioners of the New Capitol in using any portion of the moneys appropriated for the continuance of the work upon the New Capitol, appropriated by chapter 295, Laws of 1882, violated any of the provisions of said act.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

The Assembly returned the concurrent resolution providing for the preparation and printing of 800 copies of the Clerk's Manual, with a message that they had concurred in the passage of the same.

The Assembly returned the following entitled bills with messages that they had concurred in the passage of the same :

"An act making an appropriation for continuing work upon the New Capitol during the winter and spring of 1883."

"An act authorizing the board of supervisors of the county of Montgomery to borrow money on the credit of the said county, and to provide for the payment thereof."

Ordered, That the Clerk deliver said bills to the Governor.

No. 27, entitled "An act to incorporate the Empire Security and Improvement Company," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Boyd, from the committee on miscellaneous corporations, to which was referred the bill introduced by Mr. Koch, Int. No. 106, entitled "An act to amend chapter 316 of the Laws of 1860, and supplementary the act entitled 'An act to incorporate the Hebrew BenevoTent Society of the city of New York,' passed February 2, 1832,” reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

No. 143, entitled "An act to amend the Code of Criminal Procedure," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.
