Resolved (if the Assembly concur), That a respectful message be sent to His Excellency the Governor, requesting the return of Senate bill No. 20, entitled "An act to amend chapter 590 of the Laws of 1865, entitled An act to incorporate the Porous Plaster Company of the city of New York.'

On motion of Mr. Robertson and by unanimous consent, the rules were suspended in order that said resolution be considered immediately.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

On motion of Mr. Bixby, the Senate adjourned.

TUESDAY, FEBRUARY 10, 1880.

The Senate met pursuant to adjournment.

Prayer by the Chaplain.

The journal of yesterday was read and approved.

Mr. Lynde presented a petition of stockholders of the Ogdensburgh and Lake Champlain Railroad Company for authority to issue bonds for the purpose of canceling the preferred stock of said company; which was read and referred to the committee on railroads.

Mr. Schroeder presented petitions (6) of citizens of Kings county in favor of providing separate institutions for the detention and reformation of convicted women; which was read and referred to the committee on the judiciary.

The President presented the preamble and resolutions of the Chamber of Commerce of the city of New York relative to the construction of an island on Robbins' Reef in New York Harbor.

Mr. Sessions moved that said resolution be laid on the table. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Hogan, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows:

"An act to amend the Code of Civil Procedure."

"An act to amend chapter 590 of the Laws of 1872, entitled 'An act to regulate processions and parades in the cities of the State of New York."

"An act to amend the Code of Civil Procedure."

"An act making appropriation for continuing work upon the new capitol during the winter and spring of the year 1880."

Mr. Pitts offered the following:

Whereas, The City Hall in city of Albany was destroyed by fire on the morning of the 10th inst., and there is no place provided for holding the courts of record in said city.

Resolved (if the Assembly concur), That the trustees of the

Capitol be and hereby are authorized to allow the unoccupied parts of the old Capitol to be used by said courts and the transaction of the business of said courts.

On motion of Mr. Pitts, and by unanimous consent, the rules were suspended in order that said resolution be considered immediately.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

The Assembly sent for concurrence the following entitled bills: "An act to exempt the town of Guilford, Chenango county, from the provisions and operations of chapter 175 of the Laws of 1870, entitled 'An act creating a board of town auditors in the several towns of this State, and to prescribe their powers and duties,"" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

"An act to extend the charter of the Central City Railway Company, organized under and in pursuance of chapter 483 of the Laws of 1859," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

"An act to amend chapter 686 of the Laws of 1872, entitled An act to amend an act entitled 'An act to erect the village of Middleburgh into a separate road district,' and the several acts amendatory thereof,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

The Assembly returned the bill entitled "An act to incorporate the fire department of the village of Medina."

Ordered, That the Clerk deliver said bill to the Governor.

Mr. Robertson introduced a bill entitled "An act relating to legal proceedings in which the mayor, aldermen and commonalty of the city of New York are parties of record or in interest," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Robertson, and by unanimous consent, the rules were suspended, and said bill was ordered to a third reading.

Mr. Wagner introduced a bill entitled "An act in relation to the enlargement of the bridge across the Erie canal at Fultonville," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.

Mr. McCarthy introduced a bill entitled "An act to provide for the establishment of a system of graded schools in the village of Cortland," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on villages. Mr. Braman introduced a bill entitled "An act further to amend section 2 of chapter 139 of the Laws of 1870, as amended by chapter 402 of the Laws of 1874, entitled 'An act to annex parts of the towns of Bethlehem and Watervliet in the county of Albany to the city of Albany, and to exempt such parts thereof from certain taxes, and to annex a part of the city of Albany to the town of Watervliet," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

Mr. Wendover introduced a bill entitled "An act to amend chapter 857 of the Laws of 1872, entitled 'An act to amend an act entitled 'An act to incorporate the Poughkeepsie Bridge Company for the purpose of constructing and maintaining a bridge, appurtenances and approaches to the same over the Hudson river at a point or points between the city of Poughkeepsie and the town of Lloyd, Ulster county, on said river, passed May 10, 1871,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

Mr. Stevens introduced a bill entitled "An act relating to the Central New York Institution for Deaf Mutes at Rome, New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

Mr. Williams introduced a bill entitled "An act making appropriations for the several Judicial District Libraries," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Jacobs introduced a bill entitled "An act to amend chapter 123 of the Laws of 1854, entitled 'An act to promote medical science," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public health.

The bill entitled "An act relating to legal proceedings in which the mayor, aldermen and commonalty of the city of New York are parties of record or in interest," was read the third time and passed.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

Assembly, "An act making an appropriation to carry out the provisions of chapter 134 of the Laws of 1878, and chapter 306 of the Laws of 1879, entitled respectively An act in relation to infectious and contagious diseases of animals,' and to provide for liquidating and discharging all obligations incurred thereunder by the agents of the State."

"An act to reappropriate certain moneys in the treasury for the improvement of the Champlain canal."

After some time spent therein, the President resumed the chair, and Mr. Williams, from said committee, reported in favor of the passage of the first named bill, which report was agreed to, and the same ordered to a third reading.

Mr. Williams, from the same committee, reported in favor of the passage of the last named bill, with amendments, and have amended the title by adding thereto the words " and of the Glens Falls feeder," which report was agreed to, and the same ordered engrossed for a third reading.
