The Senate met pursuant to adjournment.

Prayer by the Chaplain.

The journal of yesterday was read and approved.

Mr. Lord presented a petition of citizens of Yates county for separate institutions for the confinement and reformation of female convicts and paupers; which was read and referred to the committee on the judiciary.

Mr. Robertson, from the committee on the judiciary, to which was referred the bill introduced by Mr. Robertson (introductory No. 271), entitled "An act further to amend chapter 270 of the Laws of 1850, entitled An act to authorize the appointment of commissioners to take the proof and acknowledgment of deeds and other instruments and to administer oaths in other States and Territories,'" reported in favor of the passage of the same without amendment, which report was agreed to and said bill committed to the committee of the whole.

Mr. Robertson, from the committee on the judiciary, to which was referred the bill introduced by Mr. Woodin (introductory No. 263), entitled "An act to amend an act, passed April 4, 1866, entitled 'An act to extend the operation and effect of the act passed February 17, 1848, entitled An act to authorize the formation of corporations for manufacturing, mining, mechanical or chemical purposes,"" reported in favor of the passage of the same without amendment, which report was agreed to and said bill committed to the committee of the whole.

Mr. Baker, from the committee on canals, to which was referred the bill introduced by Mr. Lord (introductory No. 253), entitled “An act authorizing the construction of a bridge over the Erie canal at Kent street, in the village of Palmyra," reported in favor of the passage of the same without amendment, which report was agreed to and said bill committed to the committee of the whole.

Mr. Baker, from the committee on canals, to which was referred the bill introduced by Mr. Wagner (introductory No. 215), entitled "An act in relation to the enlargement of bridge across the Erie canal at Fultonville," reported in favor of the passage of the same with amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Baker moved that the committee on canals be discharged from the further consideration of the bill entitled "An act to amend chapter 290 of the Laws of 1879, entitled An act to amend chapter 149 of the Laws of 1874, entitled 'An act to amend an act passed April 27, 1872, entitled 'An act to amend chapter 657 of the Laws of 1871, entitled An act to amend an act passed February 17, 1848, entitled 'An act to authorize the formation of corporations for manufacturing, mining, mechanical or chemical purposes,' passed April 20, 1871, and to legalize the formation and acts of certain corporations formed according to the provisions of chapter 374 of the Laws of 1877," and that the same be referred to the committee on the judiciary.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Baker, from the committee on canals, to which was referred the Assembly bill entitled "An act to abolish the use of weigh-locks on the canals," reported in favor of the passage of the same with amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Wagner, from the committee on railroads, to which was recommitted the bill introduced by Mr. Lynde (introductory No. 143), entitled An act to authorize the Ogdensburg and Lake Champlain Railroad Company to issue bonds and to execute a mortgage to raise funds to provide for the retirement of its preferred stock and other purposes," reported in favor of the passage of the same without amendment, which report was agreed to and said bill committed to the committee of the whole.

Mr. Lynde, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act to amend chapter 353 of the Laws of 1878, entitled 'An act in relation to the term of office of the clerk and assistant clerk of the board of supervisors of Kings county, and of the engineers of the county court-house in said county," reported in favor of the passage of the same with amendments, which report was agreed to and said bill committed to the committee of the whole.

Mr. Woodin, from the committee on cities, to which was referred the Assembly bill entitled "An act to divide the third and seventh wards of the city of Utica, and to create the 11th and 12th wards therein," reported in favor of the passage of the same without amendment, which report was agreed to.

On motion of Mr. Woodin, and by unanimous consent, the rules were suspended and said bill was ordered to a third reading.

Mr. Schroeder, from the committee on engrossed bills, reported as correctly engrossed the biils entitled as follows:

"An act to authorize the exchange of preferred stock for common stock of corporations."

"An act to legalize and confirm the official acts of Jonathan O. Spink of the town of Orangeville, Wyoming county, as justice of the peace."

"An act to amend chapter 777 of the Laws of 1870, entitled An act to incorporate the village of Walden, in the county of Orange." And, also, as correctly re-engrossed,

An act giving the consent of the State of New York to the purchase of or acquisition by the United States of two sites for range lights in Cold Spring Harbor (Queens county), Long Island, New York, and ceding jurisdiction over the same."

"An act to amend chapter 259 of the Laws of 1879, entitled 'An act to amend chapter 22 of the Laws of 1858, entitled 'An act to enable the electors of the town of Watervliet to vote by districts for the election of town officers.""

Mr. Robertson presented the annual report of the Trustees of the New York State Library.

Ordered, That said report be laid on the table and printed.

The President presented the report of acting Superintendent of Bank Department relative to expenses of Savings Banks of the State in response to resolutions of the Senate.

The Assembly sent for concurrence the following entitled bills: "An act in relation to and reducing the number of justices of the peace, creating judicial districts, and providing for local inferior courts in the city of Brooklyn," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to authorize the sale of lands in the town and village of Saratoga Springs, for unpaid State, county and municipal taxes, including water rates and special assessments," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on villages.

"An act to amend section 10 of title 8 of chapter 77 of the Laws of 1870, entitled 'An act to amend the act to combine into one act the several acts relating to the city of Albany,' passed April 12, 1842, and the several acts amendatory thereof, and also to repeal the act to establish a capital police district and to provide for the government thereof, passed April 22, 1865, and the several acts amendatory thereof, so far as they relate to the city of Albany," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

'An act to amend chapter 126 of the Laws of 1873, entitled An act to organize a board of school commissioners in and for the city of Troy,' and the several acts amendatory thereof," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Baker, and by unanimous consent, the rules were suspended and said bill was substituted for Senate bill No. 80, same title now in order of third reading.

"An act to amend chapter 479 of the Laws of 1867, entitled ' An act to amend the charter of the village of Dunkirk,'" which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Sessions, and by unanimous consent, the rules were suspended, and said bill was read the third time and passed.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths being present, as follows:

A message was received from the Assembly in the words following; IN ASSEMBLY, February 18, 1880.

Pursuant to concurrent resolution of the Senate and Assembly, the Governor returned the Assembly bill entitled "An act to amend chapter 34 of the Laws of 1858, entitled 'An act to make school district No. 9 in the town of Pomfret a union free school district.'" The vote upon the final passage of said bill having been reconsidered, on motion of Mr. Ingersoll, and by unanimous consent, the same was amended as follows: Amend by striking out all of section 2 as it now reads and make a new section 2, to read as follows: "Section 2. The annual election for members of said board of education shall be on the second Wednesday of October, and the polls for said election shall be open from 12 o'clock noon until 8 o'clock in the afternoon," and as amended, passed and ordered to be sent to the Senate for concurBy order,

Mr. Schroeder, by request, introduced a bill entitled "An act to amend an act entitled 'An act to amend the charter of the city of Brooklyn, and the various amendments thereof,' passed June 28, 1873," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Mr. Halbert introduced a bill entitled "An act to repeal articles 2 and 3 of chapter 16 of title 1 of part 1 of the Revised Statutes, so far as they are applicable to the county of Broome, and to provide for highway labor, and the election of highway commissioners in said county and for levying of taxes therein for highway purposes," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

Mr. Halbert introduced a bill entitled "An act authorizing the appointment of commissioners to select a site for a State House for the Blind," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance. Messrs. Varnum and Benedict, a committee on the part of the Assembly, appeared in the Senate and announced that Hon. James W. Husted had been duly elected Speaker pro tempore of the Assembly.

The Assembly bill entitled "An act to amend chapter 555 of the Laws of 1864, entitled An act to revise and consolidate the general acts relating to public education,'" was read the third time and passed.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths being present, as follows:
