The Assembly returned the Assembly bill (No. 1185, Senate reprint No. 1468, Rec. No. 131) entitled "An act to amend the Farms and Markets Law to conform to the State Departments Law, in relation to the organization of the department and repealing article two of the State Boards and Commissions Law, relating to the State Fair Commission, and section one hundred of the Executive Law, relating to the State Superintendent of Weights and Measures, and to amend the State Departments Law, in

in relation to organization, and repealing certain sections thereof," with a message that it has concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

A message from the Assembly was received, in the words following:

IN ASSEMBLY, March 18, 1927. Pursuant to concurrent resolution of the Senate and Assembly, the Senate returned the Assembly bill (No. 715, reprint No. 2101, Rec. No. 178) entitled "An act to amend chapter five hundred and forty-one of the Laws of nineteen hundred and sixteen, entitled 'An act relating to the preparation of assessment-rolls for the townships and tax districts therein in the county of Nassau, and the collection of taxes in such towns and tax districts, and to repeal certain local acts and parts of acts relating to assessments and taxation in such county,' in relation to additional assessors, deputy assessors, and assessment districts.'

The vote upon the final passage of said bill having been reconsidered, on motion of Mr. Wallace said bill was recommitted to the committee on internal affairs of towns, counties and public highways, with instructions to report the same forthwith, amended as follows:

Page 3, line 5, insert an opening bracket before the word "and". Page 3, line 6, insert a closing bracket after the word "assessors".

Page 3, line 7, insert an opening bracket before the word "of", and insert a closing bracket after the word "assessors".

Said bill, as amended, was read the third time and passed, having been printed and upon the desks of the members in its final form at least three calendar legislative days prior to its final passage. By order

Also, Senate bill (No. 731, Int. No. 674) entitled "An act to amend the Penal Law, relative to penalty for wilful or malicious injury to certain articles in libraries, galleries, museums or exhibitions," with a message that it has concurred in the passage of the same.

Also, Senate bill (No. 856, Int. No. 785) entitled "An act to amend the Conservation Law, generally."

Also, Senate bill (No. 867, Int. No. 797) entitled "An act to amend the Town Law, in relation to compensation of inspectors of election in a county having a population of more than one hundred and forty thousand and less than one hundred and fifty thousand inhabitants."

Also, Senate bill (No. 1038, Int. No. 935) entitled "An act to amend the State Departments Law, in relation to construction, alteration, improvement and repair of buildings of certain state institutions," with a message that it has concurred in the passage of the same.

Ordered, That the Clerk deliver said bills to the Governor.
Mr. Knight moved that the Senate do now adjourn.

The Senate met pursuant to adjournment.

The journal of March 18th was read and approved.

Mr. Hewitt introduced a bill (Int. No. 1500) entitled "An act to provide for the completion and publication of the tabulation of the State enumeration of nineteen hundred and twenty-five, and making an appropriation therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill (Int. No. 1501) entitled "An act to amend the Public Works Law, in relation to contractor's bonds under contracts for public improvements within the supervision, direction and control of the Superintendent of Public Works," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Also, a bill (Int. No. 1502) entitled "An act to amend chapter five hundred and ten of the Laws of nineteen hundred and twenty

six, entitled 'An act to provide for the elimination of existing railroad crossings at grade within the jurisdiction of the transit commission, and to repeal inconsistent acts, including chapter one hundred and nine of the Laws of nineteen hundred and six, chapter seven hundred and seventy-seven of the Laws of nineteen hundred and eleven, chapter seven hundred and nineteen of the Laws of nineteen hundred and seventeen, and superseding certain provisions of the Greater New York charter,' in relation to programs for the elimination of grade crossings," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Hewitt, from the committee on finance, to which was referred the Senate bill introduced by Mr. Hewitt (No. 1695, Int. No. 1464) entitled "An act making an appropriation for fire prevention and safety measures at certain State hospitals and State charitable and penal institutions," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Hewitt, from the committee on finance, to which was referred the Senate bill introduced by Mr. Hewitt (No. 1380, Int. No. 1230) entitled "An act appropriating one million dollars as and for the first annual installment which the State of New York has heretofore undertaken, by chapter seven hundred and sixtyone of the Laws of nineteen hundred and twenty-six, to make available in aid of the construction by the port of New York authority of a certain bridge across the Hudson river between Fort Lee and Fort Washington," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Hewitt, from the committee on finance, to which was referred the Senate bill introduced by Mr. Freiberg (No. 1498, Int. No. 1330) entitled "An act to create a commission for the purpose of making a study and a comprehensive survey of the port of Buffalo and the Niagara frontier district to determine the feasibility of the creation and establishment of a port authority to be known as the Buffalo and Niagara frontier port authority, which port authority shall have power and authority over the development, control and operation of port facilities within the district, reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.
