towns and school districts therein," with a message that it has concurred in the passage of the same with the following amendinents: Between lines 10 and 11, page 3, insert "Section 2." Subdivision five of section two hundred thirty-nine of said chapter, as last amended by chapter five hundred five of the laws of nineteen hundred twenty-four, is hereby further amended by adding a new paragraph in italics to be known as paragraph (c) and to read as follows:

(v) The stock or bonds hereafter issued, prior to May first, nineteen hundred twenty-nine, by any city, the stocks or bonds of which have been authorized investments for the moneys of savings banks under paragraph (a) or (b) at any time since January first, nineteen hundred twenty-five, provided said city has a population as shown by the last decennial federal census of not less than one hundred thousand inhabitants and that at the time of the issuance of said stocks or bonds such city shall have the power to levy taxes for their payment without any limitation of the rate or amount of such taxes.

Renumber Section 2 of present bill and make it Section 3. Mr. Campbell moved that the Senate concur in said amendments. The President put the question whether the Senate would concur in said amendments, and it was decided in the affirmative.

The President put the question whether the Senate would agree to the final passage of said bill as amended, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly returned the Assembly bill (No. 714, Senate reprint No. 1567, Rec. No. 177) entitled "An act to amend chapter five hundred and forty-one of the Laws of nineteen hundred and sixteen, entitled 'An act relating to the preparation of assessmentrolls for the townships and tax districts therein in the county of Nassau, and the collection of taxes in such towns and tax districts, and to repeal certain local acts and parts of acts relating to assessments and taxation in such county,' in relation to the collection of

taxes by town receivers," with a message that it concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

At one o'clock and twenty-five minutes Mr. Knight moved that the Senate stand in recess until three o'clock and thirty minutes. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

THREE O'CLOCK AND THIRTY MINUTES

The Senate again met.

Mr. A. J. Kennedy introduced a bill (Int. No. 1519) entitled "An act to amend the Labor Law, in relation to the hours of labor of sales-ladies in candy stores and ice cream parlors," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on labor and industry.

Also, a bill (Int. No. 1520) entitled "An act conferring jurisdiction on the Court of Claims to hear and determine the claim of Nicholas Lauer against the State for damages sustained by him by reason of unlawful and violent act of officers, agents and employees of the State while acting within the scope of their duties or employment," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on general laws.

The Assembly sent for concurrence a resolution, in the words follows:

Resolved (if the Senate concur), That a respectful message be sent to the Governor requesting the return to the Assembly of Assembly bill (No. 1519, Rec. No. 219) entitled "An act to amend the Town Law, in relation to petitions to extend lighting districts in the town of Hempstead, county of Nassau. and providing that such petitions may be signed by a majority of the resident owners of the real property to be included in such proposed extension," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly with the message that the Senate has concurred in the passage of the same.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur), That the Clerks of the Senate and Assembly be authorized to purchase 10,000 copies of the New York Red Book of 1927, to be distributed as follows: Fifty copies. to each Senator, forty copies to each member of Assembly and the balance to State officials, libraries and institutions. The expense of such copies shall be paid from the appropriation available for "miscellaneous documents" and shall not exceed the sum of $7,500.

Ordered, That said resolution be referred to the committee on finance.

The Assembly sent for concurrence a resolution, in the words following:

By Mr. Cuvillier:

Whereas, The President of the United States, the Secretary of War and thirty-two Governors have sent their sons to Citizens' Military Training Camps; and the Federation of Women's Clubs have endorsed them; and organized labor and organized capital are a unit in support of them; and

Whereas, It would be of great advantage to the youth of the State of New York to attend these Citizens' Military Training Camps for their moral, physical and well being and to fit them for the future defense of the country;

Therefore, be it Resolved (if the Senate concur), That it be the sense of the Legislature that the parents of the State of New York be urged to send their boys to these training camps, for the future. welfare of the State.

Ordered, That said resolution be referred to the committee on military affairs.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor requesting the return to the Assembly of Assembly bill (No. 320, Rec. No. 40) entitled "An act to amend the Public Health Law, in relation to tuberculosis hospitals in Orange county," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly with the message that the Senate has concurred in the passage of the same.

The President put the question whether Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly with the message that the Senate has concurred in the passage of the same.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur). That a respectful message be sent to the Governor requesting the return to the Assembly of Assembly bill (No. 655, Rec. No. 270) entitled "An act to amend the Stock Corporation Law, generally," for the purpose of amendment.

The President put the question whether Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly with the message that the Senate has concurred in the passage of the same.

Mr. Pitcher, from the committee on civil service, to which was referred the Senate bill introduced by Mr. Dick (No. 1232, Int. No. 1112) entitled "An act to amend the Civil Service Law, in relation to the definitions of 'prior service' and 'total service,' in connection with the retirement of State officers and employees," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Pitcher, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Byrne gave notice that at some future time he will move to suspend Senate rules numbered 1, 4, 8, 9, 11, 14, 18, 19, 22, 30, and 43, for the purpose of reading, passing and transmitting to the Assembly out of its regular order the Senate bill (No. 1614, Int. No. 1397) entitled "An act to amend the General Municipal Law, in relation to examiners of accounts of municipalities."

Mr. Antin moved that the committee on the judiciary be discharged from the consideration of Senate bill (No. 124, Int. No. 124) entitled "An act to amend the General Municipal Law, in relation to payment of awards by boards of child welfare," and that said bill be amended, reprinted and recommitted to the committee on the judiciary.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Wales offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor requesting the return to the Senate of the Senate bill (No. 1029, Int. No. 926) entitled "An act to amend the Village Law, in relation to licensing certain occupations," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request its concurrence therein.

The Assembly returned the above resolution with a message that it has concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Baumes moved that the committee on finance be discharged from the consideration of Senate bill (No. 1583, Int. No. 1051) entitled "An act to amend the State Departments Law, in relation to the department of correction."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Baumes moved that said bill be recommitted to the committee on finance with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

No. 1052) entitled "An act to amend the Prison Law, in relation to parole," having been announced for third reading, Mr. Baumes moved that said bill be recommitted to the committee on codes with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Baumes, from the committee on codes, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The Assembly bill (No. 571, Rec. No. 204) entitled "An act to amend the Tenement House Law, in relation to protection from fire," having been announced for third reading, Mr. Mastick moved that said bill he recommitted to the committee on affairs of cities with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Whitley, from the committee on affairs of cities, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.
