Mr. Gibbs presented a memorial from the Chamber of Commerce of the State of New York relative to the Adirondack forests; which was read and referred to the committee on finance.

Mr. Gibbs introduced a bill entitled "An act to authorize the establishment of the Adirondack reservation," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill entitled "An act to provide for the purchase of the island known as Riker's island, in the county of Queens, by the commissioners of public charities and correction of the city of New York; to provide for the annexation thereof to the city and county of New York, and to provide funds for such purchase," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Mr. Otis, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows:

"An act to regulate the defense of suicide by life insurance companies in cases of insanity."

"Au act to amend chapter 941 of the Laws of 1867, entitled 'An act to amend and consolidate the several acts relating to the charter of the village of Churchville, in the county of Monroe.'

"An act to ratify the contract entered into on behalf of the State of New York by and between the agent and warden of the Auburn State prison and Edward M. Moore."

On motion of Mr. Ellsworth, the Senate adjourned.

Mr. Thacher presented a memorial from the mayor and health officer of the city of Albany, relative to the sanitary condition of the Albany basin; which was read and referred to the committee on canals. Also, a petition of citizens of Albany for the reconstruction of a foot-bridge over the Erie canal at the foot of North Erie street in said city; which was read and referred to the committee on canals.

Mr. Otis presented a petition of citizens of Queens and Suffolk counties for an amendment to the game laws; which was read and referred to the committee on game laws.

The President presented the Annual Report of the New York Infant Asylum; which was laid upon the table and ordered printed.

Mr. Gibbs, from the committee on cities, to which was referred the bill introduced by Mr. Campbell, Int. No. 144, entitled "An act to make provision for a public park in the Seventh ward of the city of New York, including therein all necessary alterations of the map or plan of said city, the acquisition of land for such park, and the payment of all expenses connected therewith from money to be raised by bonds, taxes and assessments for local improvements," reported in fa vor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gibbs, from the committee on cities, to which was referred the bill introduced by Mr. Daly, Int. No. 178, entitled "An act to alter the map of the city of New York by changing the name of a public place heretofore laid out thereon from Stuyvesant square and Cooper park," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gibbs presented a memorial of the citizens of New York for the preservation of the Adirondack forest; which was read and referred to the committee on finance.

Mr. Gibbs, from the committee on cities, to which was referred the bill introduced by Mr. Daggett, Int. No. 92, entitled "An act to provide for furnishing an increased supply of water for the city of Brooklyn," reported in favor of the passage of the same, which report was agreed to and said bill committed to the committee of the whole.

Mr. Gibbs, from the committee on cities, to which was referred the bill introduced by Mr. Murphy, Int. No. 126, entitled "An act to alter the map of the city of New York by laying out thereon a public park at Coenties slip, and to provide for the regulation and control thereof," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gibbs, from the committee on cities, to which was referred the Assembly bill, entitled "An act to amend section 955 of title 5 of chapter 16 of chapter 410 of the Laws of 1882, entitled 'An act to consolidate into one act and to declare the special and local laws affecting public interests in the city of New York, and the acts amendatory thereof,"" reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gibbs, from the committee on cities, to which was referred the Assembly bill, entitled "An act to amend chapter 294 of the Laws of 1869, entitled 'An act to incorporate the fire department of the city of Binghamton,'" reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Fassett, from the committee on commerce and navigation, to which was referred the bill introduced by Mr. Otis, Int. No. 176, entitled 'An act to enable railroad companies incorporated under the Laws of the State of New York, to own boats and operate ferries," reported. in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Fassett, from the committee on commerce and navigation, to which was referred the bill introduced by Mr. Daggett, Int. No. 175,

entitled "An act to amend chapter 193 of the Laws of 1882, entitled 'An act relating to the People's Ferry Company,' passed May 20, 1882, and to limit and determine the powers thereby vested in and conferred upon the People's Ferry Company," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Titus, Int. No. 74, entitled "An act to amend chapter 205 of the Laws of 1883, entitled 'An act to abolish the office of Canal Appraiser and the State Board of Audit, and to establish a board of claims and define its powers and duties,' reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Titus, Int. No. 137, entitled "An act to amend section 695 of the Code of Criminal Procedure," reported in favor of the passage of the same, with amendments, and the title amended so as to read "An act to amend the Code of Criminal Procedure," which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Comstock, Int. No. 31, entitled An act in relation to the sureties of executors, administrators, trustees and guardians and the practice in Surrogates' Courts," reported in favor of the passage of the same, with amendments, and the title amended so as to read "An act to amend the Code of Civil Procedure," which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. McCarthy, Int. No. 89, entitled "An act to amend the Code of Criminal Procedure," reported adversely thereto, which report was agreed to, and said bill rejected.

Also, a bill entitled "An act making legal notices printed or published in a newspaper printed or published on the first day of the week lawful," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Also, a bill entitled "An act to amend an act entitled 'An act to revise and consolidate the general acts relating to public instruction,' passed May 2, 1864," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

Also, a bill entitled "An act to amend the Penal Code," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Also, a bill entitled "An act to limit the liability of dealers in newspapers for the libelous matter contained therein," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Cullen introduced a bill entitled "An act relating to actions brought by the mayor, aldermen and commonalty of the city of New York to recover penalties for violation of corporation ordinances, and the collection thereof," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Also, a bill entitled "An act to amend chapter 410 of the Laws of 1882, entitled 'An act to consolidate into one act and to declare the special and local laws affecting public interests in the city of New York,' ," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities. Mr. Cullen moved that the two last-named bills be printed. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, as follows:

Mr. Robb introduced a bill entitled "An act to amend the act entitled 'An act for the incorporation of benevolent, charitable, scientific and missionary societies,' passed April 12, 1848," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on miscellaneous corporations.

Mr. Esty called for the consideration of the concurrent resolution heretofore offered by him in the words following:

Whereas, Several embankments have been made across the outlet of Cayuga lake, and the channel of Seneca river by the State railroad companies, and public and incorporated bridge companies; and

Whereas, There are no established levels or marks to determine the effect from year to year of these works upon the relative water level of Cayuga lake and its outlet; now, therefore, be it

Resolved (if the Assembly concur), That the State Engineer be, and he is hereby, directed to run a line of continuous levels from Cayuga lake to Cross lake, establishing bench-marks along the line of said levels, as follows:

Bench-mark No. 1 to be established on the lower mitre-sill of the lock at the entrance of the Cayuga branch of the Cayuga and Seneca canals, which will show the level of Cayuga lake.

Bench-mark No. 2 shall be established on the lower mitre-sill of what is known as Mud lock, at junction of the Seneca branch with the Cayuga branch of said canals.

Bench-mark No. 3 shall be established on the central pier of the Erie Canal aqueduct, at the crossing of the Seneca river.
