Thomas, late of Wyoming county, deceased," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Titus, by request, introduced a bill entitled "An act relating to the Buffalo East Side Street Railway," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Mr. Ellsworth introduced a bill entitled "An act to amend the Code of Civil Procedure," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Thacher introduced a bill entitled "An act in addition to and amendatory of the several acts relating to a supply of water in the city of Albany," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities. The bill entitled "An act to amend chapter 303 of the Laws of 1881, entitled 'An act to amend and consolidate the charter of the village of Johnstown,' and the several acts amendatory thereof," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

Strike out all after the enacting clause and insert the following: "SECTION 1. The Superintendent of State Prisons and the agent and warden of the respective State prisons in this State are hereby prohibited from making any new contract, or of renewing or extending any existing contract for the employment of the labor and services of the convicts confined in any State prison in this State.

"§ 2. This act shall take effect immediately."

Amend the title so as to read as follows:

"An act to prohibit the employment of convicts confined in the several State prisons in this State upon contracts."

Whereas, The people of the State of New York, by a majority almost unprecedented, have expressed themselves as opposed to the system of contract prison labor; therefore,

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

"SECTION 1. The Superintendent of State Prisons is hereby prohibited, hereafter, from making any new contract, or renewing or extending any old contract for the employment of labor in any prison or reformatory or in any penal institution in the State."

The undersigned, appointed by the Senate and Assembly as a committee of conference, relative to the matters of difference arising between the two houses upon the concurrent resolution for printing the Annual Report of the Board of Control of the New York Agricultural Experiment Station, report that they have duly conferred upon said matters and agreed to recommend as follows:

That the Senate do recede from its amendment, and that the Senate do concur in the resolution as passed by the Assembly.

Mr. Lansing introduced a bill entitled "An act making an appropriation for continuing work on the Capitol during the current year; for the purchase of material therefor, and for the payment of pending contracts therein," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Cullen introduced a bill entitled 'An act relating to public markets in the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Mr. Coggeshall introduced a bill entitled "An act to amend chapter 247 of the Laws of 1883, entitled 'An act to amend chapter 203 of the Laws of 1881, entitled An act to authorize the burial of the bodies of any honorably discharged soldier, sailor or marine, who shall hereafter die without leaving means sufficient to defray funeral expenses,"" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on militia.

Mr. McCarthy introduced a bill entitled "An act to amend chapter 268 of the Laws of 1882, entitled 'An act to provide for the incorporation of the alumni of colleges and universities in the State of New York," which was read the first time, and by unanimous consent was ålso read the second time, and referred to the committee on miscellaneous corporations.

Mr. Comstock introduced a bill entitled “An act in relation to convict labor," which was read the first time, and by unanimous consent was also read the second time.

Mr. Comstock moved that said bill be committed to the first committee of the whole not full.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Thacher introduced a bill entitled "An act to amend an act entitled 'An act to provide for the better administration of justice in the town of Watervliet, in the county of Albany,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Coggeshall moved that the Senate do now adjourn.

Mr. Baker moved that the Senate do now resolve itself into a committee of the whole upon the bill entitled "An act in relation to convict labor."

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bill entitled as follows:

After some time spent therein, the President resumed the chair, and Mr. Murphy, from said committee, reported progress on the abovenamed bill, and asked leave to sit again.

Mr. Comstock moved to discharge the committee of the whole from the further considération of said bill, and that the same be ordered engrossed for a third reading.

Mr. Titus moved to add to the motion of Mr. Comstock the following and that said bill be amended by adding to the first section the words, under the present system of contract labor in prisons.'

The Senate, in open executive session, confirmed the nomination of certain persons as notaries public, after which the Senate resumed legislative business.
