"An act making provision for the improvement of the park in Mission place, in the sixth ward in the city of New York," which was read the first time, and by unanimous consent was also read the second time.

Mr. Murphy moved that said bill be referred to the first committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Assembly returned the following entitled bills with messages that they had concurred in the passage of the same, respectively:

Mr. Thacher presented a communication from the workingmen employed upon the New Capitol asking for an appropriation to continue work on the New Capitol; which was read and referred to the committee of the whole.

Mr. Otis, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows:

"An act to amend the act entitled 'An act for the incorporation of benevolent, charitable, scientific and missionary societies," passed April 12, 1818."

Mr. Ellsworth, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to release to Ellen Travers and Johanna Corcoran the right, title and interest of the people of the State of New York in certain real estate in the city of Auburn, Cayuga county, State of New York," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Thacher, Int. No. 122, entitled "An act to amend the Code of Criminal Procedure," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thomas, from the committee on railroads, to which was referred the bill introduced by Mr. Daly, Int. No. 6, entitled "An act in relation to the issuing of bonds and stock upon any railroad," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thomas, from the committee on railroads, to which was referred the bill introduced by Mr. Baker, Int. No. 280, entitled "An act to provide for the construction, maintenance and operation of street surface railroads in cities, towns and villages," reported the same for the consideration of the Senate, and said bill committed to the committee of the whole.

On motion of Mr. Baker it was ordered that said bill, when printed, be recommitted to the committee on railroads.

Mr. Gilbert, from the committee on internal affairs, to which was referred the bill introduced by Mr. Robinson, Int. No. 174, entitled "An act to regulate the fees for the granting of licenses by the commissioners of excise of cities, villages and towns, to sell intoxicating liquors, wines, ale and beer, to be drank on the premises," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gilbert, from the committee on internal affairs, to which was referred the bill introduced by Mr. Davidson, Int. No. 32, entitled "An act to regulate and fix the tare on hops, the weight of hop baling, and a standard weight of bales of hops," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Vedder, from the committee on taxation, to which was referred the bill introduced by Mr. Baker, Int. No. 278, entitled "An act in relation to the collection of taxes in Monroe county, and to authorize and provide for the sale of property for unpaid taxes in said county, reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Esty introduced a bill entitled "An act relative to the drain or ditch constructed pursuant to chapter 372 of the Laws of 1867 through certain towns of Sencca county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs.

Mr. Daly introduced a bill entitled "An act to amend the act entitled 'An act to improve the public health in the city of New York by prohibiting the manufacture of cigars or the preparation of tobacco in any form in the tenement-houses of said city,' passed March 12, 1883, and to amend the title of said act," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public health.

Mr. Daggett introduced a bill entitled "An act to amend the Code of Civil Procedure," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.
