Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Fassett, Int. No. 53, entitled "An act to authorize executors, guardians and trustees to make investments outside of the State of New York, within the United States," reported adversely thereto, which report was agreed to, and said bill rejected.

Mr. Ellsworth, from the committee on the judiciary, to which was referred the bill introduced by Mr. Gilbert, Int. No. 90, entitled "An act to repeal certain portions of the Revised Statutes, and certain other statutes," reported the same for the consideration of the Senate, and said bill committed to the committee of the whole.

On motion of Mr. Ellsworth said bill was recommitted to the committee on cities.

No. 95, entitled "An act to revise part 2 of the Revised Statutes and the subsequent acts relating to property and private rights," reported the same for the consideration of the Senate, and said bill committed to the committeee of the whole.

On motion of Mr. Ellsworth said bill was recommitted to the committee on the judiciary.

Mr. Coggeshall, from the committee on miscellaneous corporations, to which was referred the bill introduced by Mr. Comstock, Int. No. 62, entitled "An act to amend chapter 641 of the Laws of 1867, entitled 'An act for the relief of the Co-operative Iron Founders' Association of Troy,' passed April 23, 1867," reported in favor of the passage of the same, which report was agreed to, and

On motion of Mr. Comstock, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and printed.

Mr. Arkell, from the committee on villages, to which was referred the bill introduced by Mr. Arkell, Int. No. 81, entitled "An act to amend chapter 303 of the Laws of 1881, entitled 'An act to amend and consolidate the charter of the village of Johnstown,' and the several acts amendatory thereof," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Lansing, from the committee on finance, to which was referred the bill introduced by Mr. Lansing, Int. No. 55, entitled "An act making an appropriation for the salaries and expenses of the Commissioners of the Board of Claims; for the salaries and actual expenses of the clerk, stenographer and messenger of said board; for the contingent fund of said board, and for interest upon sums advanced for said board," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

No. 77, entitled "An act to prevent life insurance companies from interposing the defense of suicide, in certain cases," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

No. 48, entitled "An act to amend chapter 171 of the Laws of 1881, entitled 'An act to amend chapter 362 of the Laws of 1880, entitled An act to provide for the formation of county co-operative insurance companies,"" reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Baker, from the committee on insurance, to which was referred the bill introduced by Mr. Robb, Int. No. 65, entitled "An act to authorize marine mutual insurance companies to change to capital stock insurance companies," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Otis introduced a bill entitled "An act to amend an act entitled 'An act for the preservation of moose, wild deer, birds, fish and other game,' passed June 20, 1879," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on game laws.

Mr. Murphy introduced a bill entitled "An act to amend chapter 410 of the Laws of 1882, entitled 'An act to consolidate into one act and to declare the special and local laws affecting public interests in the city of New York,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Mr. Kiernan introduced a bill entitled "An act for supplying the city of New York, Brooklyn and other cities and villages of the Hudson River valley with pure water," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Daly introduced a bill. entitled "An act to incorporate the New York Cancer Hospital," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on miscellaneous corporations.

Mr. Campbell introduced a bill entitled "An act to amend an act relating to courts, officers of justice and civil proceedings, passed June 2, 1876, and known as the Code of Civil Procedure,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Gilbert introduced a bill entitled "An act in relation to the study of physiology and hygiene in the public schools," which was read. the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

Mr. Davidson introduced a bill entitled "An act to amend section 1 of chapter 205 of the Laws of 1883, entitled 'An act to abolish the office of Canal Appraiser and the Board of Audit and establish a Board of Claims and define its powers and duties,"" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.

Mr. Thomas introduced a bill entitled "An act to amend chapter 6 of the Laws of 1881, entitled 'An act to organize and establish a police force for the city of Binghamton,'" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Also, a bill entitled "An act to amend an act entitled 'An act to prevent the adulteration of milk, and to prevent the traffic in impure and unwholesome milk," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public health.

Also, a bill entitled "An act to regulate the issue of stock by corporations and joint-stock associations," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on miscellaneous corporations.

The Assembly bill entitled "An act to authorize and empower the supervisor of the town of Queensbury, county of Warren, to issue a warrant for the collection of taxes for the year 1883 and extend the time for collecting the same," was read the third time.

The Presidentput the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate have concurred in the passage of the same. Mr. Baker offered the following:

Resolved (if the Assembly concur), That there be printed and bound. in cloth within thirty days of the passage of this resolution, 3,000 copies of the Report of the Board of Railroad Commissioners for the year ending September 30, 1883, to be distributed under the direction of that board according to law; also, ten copies of said report for each Senator and Member of Assembly of the present Legislature, the whole expense thereof to be refunded to the treasury of the State by

an equitable assessment by the Comptroller upon the several railroad companies of this State.

Ordered, That said resolution be referred to the committee on public printing.

The Assembly returned the bill entitled "An act in relation to the election of trustees of the Ithaca Academy, the transfer and disposition of its funds and property, and the dissolution of said corporation," with a message that they had passed the same with the following amendment :

Sections 2 and 3, line 3, engrossed bill, after the word "meeting," insert the words "representing a majority of the stock of such corporation."

Mr. Esty moved to non-concur in said amendment, and that a committee of conference be appointed, and a like committee requested on the part of the Assembly.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Messrs. Esty, Gilbert and Titus were appointed as such committee. Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate have non-concurred in their amendment, have appointed a committee of conference, and request a like committee on their part.

Mr. Lansing offered the following:

Resolved, That the committee on finance be discharged from the further consideration of Senate bill entitled "An act to exempt property, real and personal, of the German Hospital and Dispensary in the city of New York from taxation, and that the same be referred to the committee on taxation and retrenchment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Mr. Thomas offered the following:

Resolved, That the proper officer be requested to erect a screen at the west door entrance of the Senate leading to the cloak room, and that meantime such door be kept locked.

Mr. Baker introduced a bill entitled "An act to amend chapter 463 of the Laws of 1853, as amended by chapter 485 of the Laws of 1879, entitled 'An act to provide for the incorporation of life and health insurance companies and casualty insurance companies, and in relation to agencies of such companies," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on insurance.

Mr. Gibbs introduced a bill entitled "An act to establish district police magistrate's courts of the city of New York, and for the purpose of securing the better administration of justice therein," which

was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

Also, a bill entitled "An act in relation to the Court of Special Sessions of the Peace in and for the city and county of New York, and to provide for the election of justices thereof by the people," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bill entitled as follows:

Assembly. "An act to authorize the extension of the time for the collection of taxes in the several towns of this State."

After some time spent therein the President resumed the chair, and Mr. Campbell, from said committee, reported in favor of the passage of the above-named bill, which report was agreed to.

By unanimous consent, the rules were suspended and said bill read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths being present, as follows:

The Assembly sent for concurrence the following entitled bills: "An act to provide for a commission to examine into the operation of the contract labor system in the prisons, penitentiaries and reformatories of the State," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on State prisons.
