interest and principal, as the same shall become due as aforesaid.

$ 4. Delos De Wolf, Samuel B. Johnson, George Ames and John B. Edwards, with the mayor of said city, ex officio, are hereby appointed commissioners to carry into effect the provisions of this act, with power to contract for the construction of said bridge, with a draw for the passage of vessels, provided the common council of the city of Oswego authorize the same by resolution to be entered upon their journal, and to negotiate the bonds herein mentioned, and to expend the funds thereby realized in the construction of said bridge; but before said bonds shall be issued to said commissioners, they shall execute to the said city their joint and several bond, conditioned for the just and faithful performance by them of the duties by this act imposed upon them, with two or more sufficient sureties, who shall together justify before a justice of the supreme court in the sum of sixty thousand dollars, the form and sufficiency of which bond shall be approved by the said justice in writing thereon. Any vacancies caused by the death, resig nation or refusal to act of any of the persons hereinbefore named as commissioners under this act, shall be supplied by the common council of said city, by a vote of not less than a majority of all the members thereof.

$5. The Comptroller is hereby authorized to loan, upon the bonds of the city of Oswego, issued as hereinbefore provided for, from the common school fund, or from any other moneys which he is authorized by law to invest, a sum not exceeding the sum of sixty thousand dollars.

S6. The canal commissioner in charge of the Oswego canal is hereby authorized and required to construct and maintain an iron bridge over the Oswego canal on Utica street, in the city of Oswego, of the same dimensions as to width and height, and of the same style and plan, as the commissioners named in the fourth section of this act shall adopt for the bridge over the Oswego river on said Utica street, and to connect the same therewith on the line which bounds the Oswego canal on the west side

thereof. The Treasurer shall pay, on the warrant of the Auditor, the sum of eight thousand dollars, to pay the expense of constructing the bridge authorized by this section to be constructed, out of any moneys appropriated, or to be appropriated, for extraordinary repairs of the canals.

$ 7. The bridge to be constructed, as herein before provided for, shall be and the same is hereby declared a public highway.

8. This act shall take effect immediately.
