$14. The treasurer, before entering upon the Bond of duties of his office, shall execute a bond to the village of Palatine Bridge in the sum and with such sureties as the board of trustees may approve, conditioned that he will faithfully execute the duties of his office, and honestly and faithfully account for and pay over all moneys received by him by virtue of said office, which bond shall be submitted to the trustees, and if by them approved, the clerk shall indorse such approval on the bond, and file the same in his office. $15. tion and request, all the moneys, books, papers, records, property and effects of every description in his possession or under his control, belonging to the corporation or appertaining to his office, he shall forfeit and pay for the use of the corporation the sum of twenty-five dollars for each and every day he shall so refuse, and also all damages caused by such neglect or refusal; and in case the said officer shall refuse to give up such money or books, as aforesaid, forthwith to his successor, or pay the said fine so imposed day by day, he shall be imprisoned until such fines and such papers or books shall be given up, and it shall be the duty of the president of the board of trustees to see that such person so offending shall be so arrested and imprisoned.

18. The board of trustees shall have the sole over streets, control and management of all the finances and of all the real and personal estate of the corporation, and of the drainage of the roads, avenues, streets and public places of the village, and shall audit and order paid all accounts chargeable against the corporation; they shall also have power within the village to declare and define the duties of all the officers of the corporation, whose duties are not especially prescribed by this act, and to fix their respective compensation, subject to the limitation of this act, as herein prescribed. All officers appointed by the trustees shall respectively hold office during the pleasure of the said board; they shall provide for the care, custody and preservation of all the property, records and papers of the corporation; they shall have power to keep the roads, avenues, streets and public buildings and places of the village in good repair, order and condition; to construct sewers, culverts and drains; to compel the drainage of private property by the owners thereof, when such drainage is considered necessary by the board for the public health, and to fill up all places which

they, the trustees, may consider necessary; to make and repair all bridges which may be necessary or convenient; to regulate and prescribe the width and grade of all streets and sidewalks; to lay out and open new streets and roads; to widen, alter, change the grade of or otherwise improve roads, avenues and streets and sidewalks; to prohibit and remove all obstructions, incumbrances and nuisances from the roads, avenues, streets, public buildings and places; to plant, protect and remove trees in the roads, avenues, streets and public places; to compel the owner or occupant of any premises to keep their sidewalks and gutters in order and clean.

$19. $20. $23. The board of trustees shall have the sole control and management of the fire department within the limits of the said village; shall order annual elections for chief engineer of fire department; shall have power to purchase engines, apparatus and fixtures for the same, provided the purchase of said articles shall have been authorized by a majority vote of the inhabitants of said village, at a meeting regularly called, to authorize the raising of a fire company, or disband any company disobeying the orders of the chief engineer, or board of trustees, and to regulate all matters connected with said fire department.

S24. The trustees shall have power to lay out and open new streets, and widen streets, alleys and highways in said village, (provided, however, that in no case shall any street be laid out, opened, altered or widened, when the damages to be assessed shall exceed that for benefits to be apportioned to an amount greater than the sum of one thousand dolCommuta- lars), and also to commute for damages which may accrue to any person or persons, in consequence of such laying out, opening, altering or widening any of the streets of said village, and also to apportion said damages, or any part thereof, upon persons owning lots which are benefited by such widening, altering or laying out, and opening any of the streets, alleys or highways of said village, and in case of a disagreement between the said trustees and the person or persons aforesaid, either as to the amount of damages or the apportionment of the same upon the owners of lots so benefited as aforesaid, then in that case, the county court of the county of Montgomery, on notice of not less than ten days to all parties interested in or owning lands to be affected by said proceedings, to be served in such manner as said court shall direct, shall have power to select three disinterested freeholders as commissioners, who being duly sworn, shall hold an examination for the inquiry of damages in the premises, and administer

the necessary oaths to witnesses, and shall deliver their certificates in writing, to the trustees, and to the person or persons claiming damages and also shall apportion the amount of such damages to be paid by the owner or owners of lots benefited by the opening and improvement of such streets, alleys and highways; a certificate of such apportionment shall also be delivered to the trustees, and a copy of the same filed with the clerk of the village. The balance of such damages, if any, together with the fees of the commissioners, shall be levied and collected of the taxable inhabitants of said village, in like manner as other incidental expenses are collected in said village; provided, however, that any person conceiving him- Appeal self or herself aggrieved by such assessment or ment apportionment, may appeal to the county judge of the county of Montgomery, and the decision of said court on said appeal shall be final and conclusive in the matter; but no appeal shall be heard unless the parties whose interests are to be affected by a change in the apportionment or assessment, shall have had six days notice thereof, nor unless notice of such appeal shall be served on the clerk of said village, within thirty days after personal notice in writing of such assessment or apportionment.
