$8. The corporation hereby created, shall be subject to all general laws affecting benevolent societies or institutions, so far as they may be applicable, and to the provisions of title three, chapter eighteen of part first of the Revised Statutes.

$9. This act shall take effect immediately,

Chap. 113.

AN ACT to amend an act entitled "An act to organize the State lunatic Asylum for insane convicts," passed April eighth, eighteen hundred and fifty-eight.

Passed March 23, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section four of the act entitled "An act to organize the State lunatic asylum for insane convicts," passed April eighth, eighteen hundred and fifty-eight, is hereby amended so as to read as follows:

4. The other officers in said asylum shall be an assistant superintendent, and not exceeding six attendants for the male department, and two female attendants for the female department, who shall be recommended by the medical superintendent, and if approved of by the board of inspectors of State prisons, shall be appointed as such by said board of inspectors, and shall be paid as follows: The assistant superintendent shall receive thirty dollars per month, payable monthly, and shall also be boarded in and at the expense of said asylum; and the said attendants shall each receive twenty dollars per month, and be boarded in said asylum..

S2. The Inspectors of State prisons shall cause any female convict in the State prison at Sing Sing, who now is or may hereafter become insane, to be removed to and retained in the female department of the State lunatic asylum for insane convicts, in the

manner provided, and subject to the provisions of the above mentioned act. And all the provisions of said act shall apply to the cases of convicts so removed, except that whenever any such female convict shall have become restored to reason, she shall be transferred to and again received into the female State prison at Sing Sing.

$3. This act shall take effect immediately.

Chap. 114.

AN ACT to amend an act entitled "An act to amend 'An act incorporating the village of Little Falls,'" passed April tenth, eighteen hundred and fifty, and to provide for the election of a police justice in said village.

Passed March 23, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section eight, of chapter one hundred and fifty-nine, of the Laws of eighteen hundred and sixty-six, is hereby amended so as to read as follows:

8. In lieu of fees in criminal cases, the said police justice shall receive an annual salary of eight hundred dollars, which sum shall be allowed and paid by the board of supervisors, during his term, to said police justice, on the presentation of his account of fees, as aforesaid, duly verified. Said salary shall be apportioned by said board, as town and county charges are allowed and paid.

S2. This act shall take effect immediately.

Chap. 115.

AN ACT in relation to the Common Schools of the City of Utica.

Passed March 23, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The first section of the act entitled An act in relation to common schools in the city of

Utica," passed March sixteenth, eighteen hundred and fifty, as the same was amended by chapter two hundred and fifty-eight of the laws of eighteen hundred and fifty-two, and as said amended section was amended by the second section of chapter three hundred and forty-eight of the laws of eighteen hundred and fifty-four, is hereby amended so that the same shall read as follows, viz. :

1. The board of school commissioners of the city of Utica shall annually prepare an estimate of the amount of money necessary to be raised in the said city, for the then ensuing year, for the payment of teachers' wages (exclusive of the money now required or which may hereafter be required by law to be appropriated or apportioned from the State school money for the use of common schools in said city), and present the same to the common council of said city; and said common council shall cause the same to be levied and collected in the said city, in the same manner as other city taxes are levied and collected; but the sum to be raised by virtue of this section, shall not in any year exceed three times the sum appropriated or apportioned to the city for the last year (eighteen hundred and sixty-six) by virtue of the law in reference to common schools.

S2. Subdivision four of section eight of the act entitled "An act in relation to common schools in the city of Utica," passed April seventh, eighteen hundred and forty-two, and the several enactments amending the same, are hereby amended so as to read as follows, viz.:

4. To procure fuel and defray the contingent expenses of the common schools, and the expenses of the district library of said city, which shall be in addition to the amount of school moneys now or hereafter appropriated or provided by law to be raised for common schools in said city; provided, nevertheless, that such tax shall not be laid oftener than once in each year, and that the whole amount to be raised shall not, in any one year, exceed the sum of ten thousand dollars.

$ 3. It shall be the duty of the treasurer of the city of Utica, immediately upon the receipt by him of any

money appropriated, raised or designed for the use of the common schools of said city, to deposit the same in the bank or banks in which he is required to deposit the moneys of the said city; and to cause the same to be immediately entered and continually kept in and by accounts separate and distinct from the general account and all other accounts of the city treasurer; and he shall cause all money which shall be raised (and be received by him) for the purpose of buying sites and building school houses in said city, to be kept, in manner aforesaid, in and by a separate account, distinct from the other moneys designed for school purposes. And the said moneys for the use of the said schools herein mentioned shall not be used, paid out or transferred by said treasurer, or in any way whatever, except upon the order of the commissioners of common schools in said city, in the manner now provided by law.

$4. The ninth subdivision of section thirteen of said act entitled "An act in relation to common schools in the city of Utica," passed April seventh, eighteen hundred and forty-two, is hereby amended so as to read as follows, viz.:

9. To defray the necessary contingent expenses of the board, including an annual salary to the clerk which shall not exceed two hundred and fifty dollars, provided that the accounts of said necessary expenses shall first be audited and allowed by the common council,

Chap. 116.

AN ACT to amend an act entitled "An act to amend article second, title fifth, chapter sixth, part third of the Revised Statutes, entitled, Of executions against property," passed May second, eighteen hundred and thirty-five.

Passed March 23, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

act to amend article second, title fifth, chapter sixth, part third of the Revised Statutes, entitled, 'Of executions against property,'" passed May second, eighteen hundred and thirty-five, hereby amended, shall read as follows:

§ 1. In all cases where any sale of real estate has been or shall hereafter be made under execution, and a certificate thereof given to the purchaser, or his assignee, but no deed executed pursuant to the provisions of article second, title fifth, chapter sixth, part third of the Revised Statutes, it shall be the duty of the sheriff making such sale, and in case of his death or removal from office, of his under sheriff, to execute a deed of the estate so sold and remaining unredeemed, to any person or persons to whom such certificate shall be or shall have been duly issued, or shall be or shall have been duly assigned, or to any person who shall have duly redeemed the said real estate, other than the execution debtor, or his heirs or assigns, the executors or administrators of any deceased assignee, or of the person who shall have so redeemed the same. In case of the death or other disqualification of both said sheriff and under sheriff before any deed shall be executed, as above provided, it shall be the duty of the deputy sheriff who made the sale, or any successor in office of said sheriff, to execute said deed. Every deed executed pursuant to the provisions of this section, shall have the same force and effect as if executed by the sheriff making such sale.

S2. This act shall take effect immediately.

Chap. 117.

AN ACT to release to Agnes D. Clement the title of the people of the State of New York acquired by escheat in and to certain real estate.

Passed March 23, 1867; by a two-thirds vote. The People of the State of New York, represented in Senate and Assembly, do enact as follows:
