$2. The said John W. Howe, as such collector, shall, within one week after the first day of March next, pay over to the treasurer of the said county of Collector to Livingston the amount of such taxes, with the inter- treasurer, est collected by him; and in case he shall not be able to collect any of said taxes or the interest thereon, he shall deliver to said county treasurer an account of the taxes and interest so remaining due, in pursuance of the provisions of section nineteen, article one, chapter thirteen, title three, part one of the Revised Statutes, and upon such return being made, he shall be credited by said county treasurer with the amount thereof.

$3. But before exercising any powers or rights under this act, the said John W. Howe shall, as such collector, give a bond to the supervisor of the said Bond of town of York, in the form prescribed by law for the bonds of town collectors, and in such sum (but not less than double the amount of the said tax remaining uncollected, and one year's interest thereon), and with such number of sureties (not less than two) as shall be required by the said supervisor. In case of the absence or disability of the said supervisor, the town clerk of said town shall act in his stead. And in case the said John W. Howe shall not give the said bond when required thereto by the said supervisor, the board of town auditors of said town. may appoint some person in his place, upon such

person giving the said bond, to the satisfaction of the said supervisor or the said town clerk. And the person so appointed shall possess all the powers, and be subject to all the liabilities conferred and imposed by this act upon the said Howe, or by any provision of law upon a town collector of taxes. S4. This act shall take effect immediately.

Chap. 3

AN ACT to amend an act entitled "An act to supply the village of Middletown with water for public and private purposes," passed April third, eighteen hundred and sixty-six.

Passed January 17, 1867; three-fifths being present. The People of the State of New York represented in Senate and Assembly, do enact as follows:

SECTION 1. For the purpose of defraying the cost of supplying the village of Middletown with water, the said village is hereby empowered to issue, in addition to the amount authorized by the act entitled "An act to supply the village of Middletown with water for public and private purposes," passed April third, eighteen hundred and sixty-six, notes, scrip, or certificates of debt to an amount not exceeding the sum of fifty thousand dollars, provided the said notes, scrip or certificates of debt shall be issued by the same authority and in the same manner as provided for in said act.

S2. The county court of the county of Orange is hereby invested with all the powers conferred by said act on the supreme court of the second judicial district, and shall be always open for the transaction of any business or the making of any application contemplated by said act.

S3. This act shall take effect immediately.

AN ACT to repeal an act entitled "An act prohibiting the issue of Free Passes on the railroads of this State."

Passed January 17, 1867.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Chapter seven hundred and ninetyeight of the laws of eighteen hundred and sixty-six, entitled "An act prohibiting the issue of Free Passes on the railroads of this State." is hereby repealed. § 2. This act shall take effect immediately.

AN ACT to approve the action of the Commissioners appointed in pursuance of chapter six hundred and sixty-six, Laws of eighteen hundred and sixty-six, to locate the Hudson River Asylum for the Insane.

Passed, January 22, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The action of the commissioners appointed to locate the Hudson River Asylum for the Insane, in pursuance of chapter six hundred and sixty-six of the Laws of eighteen hundred and sixtysix, in accepting a site of two hundred and six acres, near the city of Poughkeepsie, tendered as a gift by the citizens of Dutchess county, is hereby approved. § 2. This act shall take effect immediately.

AN ACT in relation to the Normal School located at Potsdam, in the county of St. Lawrence pursuant to chapter four hundred and sixty-six, Laws of eighteen hundred and sixty-six, and to levy taxes for the purposes thereof.

Passed January 23, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The board of supervisors of the county of St. Lawrence is hereby directed and required to levy and collect upon the taxable property of said county, in the manner provided by law for the collecamount, &c. tion of taxes, the sum of twenty-five thousand dollars together with interest, at seven per cent per annum, as hereinafter provided, to be so levied and collected, in five equal annual installments; the first installment, with interest on the full sum remaining unpaid, to be included in the tax for the present year, and one of the remaining installments, with interest as aforesaid, to be included in the tax for each and every year thereafter until the full sum of twenty-five thousand dollars, with interest as aforesaid, is levied and collected, the said moneys to be expended as hereinafter provided.

$ 5. Bloomfield Usher, T. Stratfield Clarkson, 2d, Hiram H. Peck, Henry Watkins, Erasmus D. Brooks and Charles Cox, are hereby appointed a commission to prepare and improve the said lands and premises, and provide suitable buildings thereon, and to furnish proper apparatus, books and furniture for the said normal and training school at Potsdam, a majority of whom shall constitute a quorum for the transaction of business. Such commission shall have power to appoint from their number a chairman, secretary and Governor, treasurer of said commission, and in the absence of
