On what conditions time to be extended.

Chap. 10.

AN ACT authorizing the extension of the time for the collection of taxes in the several towns and cities of this State, for the year eighteen hundred and sixty-seven.

Passed January 30, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. If any collector of taxes in any of the towns or cities of this State shall have, within the time which is now, or which shall hereafter be provided by law, paid over all the moneys collected by him (which fact shall be proved by his affidavit), and shall, within fifteen days after the passage of this act, renew his bond with sureties to the satisfaction, in towns, of the supervisor, or in case of his absence or disability, of the town clerk, and in any city, in the manner in which collector's bonds are now approved therein, in a penalty not less than double the amount remaining uncollected by virtue of his warrant, such approval to be expressed in writing upon, or attached to, said bond, and which bond shall be filed and have the effect of a collector's bond, as provided by law, and shall also, within the time aforesaid be delivered to the county treasurer of his county, if a collector of taxes in any town, and to the city treasurer or other official authorized to receive taxes from such collector of his city, if a collector of taxes in any city, a copy of such bond and approval duly certified or authenticated by the officer, or board, or authority taking and approving the same, then the time for collecting the taxes and making the returns thereof may be extended to a period not later than the first day of April, eighteen hundred and sixty-seven, which period shall, in the towns, be fixed and limited by the supervisor of such town, or in case of his absence or inability, by the town clerk, and in cities by the common council.

2. This act shall not extend to the cities of New York, Albany, Brooklyn, Troy, Buffalo, and Rochester or any other city of this State wherein the taxes are collected under a special law; but the same shall apply to the city of Oswego.

53. It shall be the duty of the Secretary of State to cause this act to be printed immediately upon slips, to inclose to each county treasurer a sufficient number of such slips, and it shall be the duty of each county treasurer to forward one of said slips to each collector of taxes of his county.

34. This act shall take effect immediately.

Chap. 11.

AN ACT to amend an act entitled "An act to create a Board of Public Instruction in the city of Albany; to establish Free Schools therein, and amendatory of the several acts relating to the District schools in said city," passed April seventh, eighteen hundred and sixty-six.

Passed January 31, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section three of chapter four hundred and forty-four of the Laws of eighteen hundred and sixty-six, is hereby amended so as to read as follows: The members of the said board shall hold their first meeting on the first day of June, one thousand eight hundred and sixty-six, at four o'clock in the after100 of that day, or as soon thereafter as may be, for the purpose of organization. They shall thereupon appoint one of their number president, who shall exercise all the powers usually incident to such office; a member of their body, superintendent of schools they shall also appoint a suitable person, other than for the city of Albany, east of Perry street, who shall by virtue of his office act as secretary of the board and shall exercise all such powers, and shall discharge all such other duties as the board shall from time to me direct, and shall be allowed such compensation

for his services as the said board may at any time

determine, not, however, to exceed, in rate, the su of two thousand dollars per annum.

S2. This act shall take effect immediately.

Chap. 12.

AN ACT to amend the act passed February si teenth, eighteen hundred and fifty-seven, entitle "An act to amend an act entitled 'An act authorize the formation of corporations for ma ufacturing, mining, mechanical or chemical poses,' passed February seventeenth, eightee hundred and forty-eight."

Passed January 31, 1867. The People of the State of New York, represented Senate and Assembly, do enact as follows:

SECTION 1. The second section of the act pass February sixteenth, eighteen hundred and fifty-seve entitled "An act to amend an act entitled 'An act authorize the formation of corporations for manufa turing, mining, mechanical or chemical purposes,' passed February seventeenth, eighteen hundred an forty-eight," is hereby amended so as to read as fo lows:

"2. Whenever any company, formed under sa act, shall have fixed the duration of its corpora existence for a less period than it was privileged do by the first section of said act, it may by a vote the stockholders representing a majority of the stoc and upon executing and acknowledging a new amended certificate under its corporate seal, sigue by the president and two-thirds of its directors, trustees, and filing the same in the county where i business shall be carried on, and in the office of the Secretary of State, extend the term of its corpora existence from time to time, to a period not longer the aggregate than it could have originally fixed th same, and shall thereupon possess all the powers an privileges, and be subject to all the liabilities mer tioned in said act, during such extension of its exis ence."

Chap. 13.

AN ACT to amend an act entitled "An act to incorporate Vassar Female College," passed January twenty-eighth, eighteen hundred and sixty-one.

Passed February 1, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The corporate name of "Vassar Female College," a college incorporated by chapter two of session Laws of eighteen hundred and sixty-one, is hereby changed to "Vassar College," by which name it shall hereafter be called and known.

$2. This act shall in nowise affect said act of incorporation, except in the name; nor shall it affect any rights or powers of the Vassar Female College; nor shall it impair or affect any claim or demand against it, or any of its liabilities.

33. This act shall take effect immediately.

Chap. 14.

AN ACT authorizing the town of Cortlandt, in the County of Westchester, to borrow money and to levy taxes for the payment of the same.

Passed February 1, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The board of town auditors of the town of Cortlandt, are hereby authorized, on the faith and credit of said town, to borrow three thousand five hundred dollars, and to execute either bonds or promissory notes, therefor, in such manner as may be provided by resolution of said board. The said sum, or any part thereof, may be borrowed by the said board of town auditors, from any person or persons, banking or savings institution, on the best terms that the same can be obtained, at an interest not exceeding

The board of supervisors, of the county o Westchester, are hereby authorized and directed to cause to be levied and collected in and by said tow of Cortlandt, the said sum of three thousand fiv hundred dollars and the interest thereon, at the tim and in the manner of the collection of the genera tax for the year eighteen hundred and sixty-seven and the same shall be paid over to the supervisor of said town, who shall apply the same to the paymen of said bonds or notes and the interest thereon. S4. This act shall take effect immediately.

Chap. 15.

AN ACT to authorize the Supervisors of the county of Albany to borrow money on the credit of the county.

SECTION 1. The treasurer of the county of Albany is hereby authorized, under the direction of the board of supervisors of said county, to borrow on the credit of Amount of said county, a sum not exceeding two hundred and

fifty thousand dollars for each of the years eighteen hundred and sixty-seven, eighteen hundred and sixtyeight and eighteen hundred and sixty-nine, and to issue the bonds of said county in such manner and form as the said board may prescribe or may have prescribed for the payment of the same, with interest, payable as the said board shall direct. Such bonds shall be issued in the name and under the seal of said county, shall be signed by the treasurer of said county and by the chairman of said board.
