Chap. 32.

AN ACT to amend chapter one hundred an thirty-six, Laws of eighteen hundred and fifty seven, and chapter two hundred and fifty-sever of the Laws of eighteen hundred and fifty three, in relation to Savings Banks.

Passed February 13, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section six of chapter one hundred an thirty-six, Laws of eighteeen hundred and fifty-sever shall read as follows:

6. Each savings bank or institution for savings shall pay five dollars towards defraying the expense incurred in the performance of the duty herel imposed, and the residue of such expenses shall paid by them in proportion to the amount deposits held by them severally, and the sums thu contributed shall be paid into the treasury of th State; but when the deposits of any such saving bank or institution for savings are less than fi hundred dollars, it shall be exempt from such co tribution. If any savings bank or institution f savings shall, after due notice, refuse or neglect pay its proper share of charges so allotted, then t said Superintendent may maintain an action again such savings bank or institution for savings, for ti recovery of such charges.

2. Upon the organization of any savings bar or institution for savings, it shall be the duty of ti secretary, or some officer thereof, before receivi any deposits, to transmit to the Superintendent the Banking Department, a list of the officers of su savings bank or institution for savings, with the post-office address and the location of such savin bank or institution for savings.

3. Section five of chapter two hundred and fift seven, Laws of eighteen hundred and fifty-three hereby amended by striking out the words followi

to wit: "nor a larger amount than three millions of dollars, in the aggregate amount of deposits, exclusive of its banking house."

4. This act shall take effect immediately.

Chap. 33.

AN ACT to authorize the county of Dutchess to borrow money, to pay for lands to be given to the people of the State of New York, by said county and the city of Poughkeepsie, as a site for the Hudson River Asylum for the Insane. Passed February 14, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The action of the board of supervisors of the county of Dutchess, in the adoption of the resolutions passed by said board, on the twentyseventh day of December, eighteen hundred and sixty-six, authorizing the raising, upon the bonds of said county, of two-fifths of such sum as may be necessary to purchase the Davies and Roosevelt farms, near the city of Poughkeepsie, to be given to the people of this State, as a site for an asylum for the insane, such sum not to exceed the sum of thirty-four thousand dollars, and authorizing the chairman and clerk of said board to carry said resolutions into effect, is hereby ratified and confirmed, and declared valid and as effectual as if said board had previously been authorized by law to take such action.

32. The chairman and clerk of the board of supervisors are hereby authorized to borrow, upon the credit of the said county of Dutchess, a sum not exceeding the sum of thirty-two thousand dollars, to pay two-fifths of the amount necessary to purchase the said Davies and Roosevelt farms, near said city of Poughkeepsie, to be given by said city and the said county, to the people of the State of New York, as a site for the Hudson River Asylum for the Insane. 33. the said county, to the amount of thirty-four thousand dollars, in the name and under the seal of said. county, to be signed by the chairman and clerk of said board of supervisors, in such amounts, at such rates (not exceeding the legal rates), and payable at such times as they may deem proper.

$ 4. Due provision by tax shall be made in each year, by the said board of supervisors, for the payment of the interest and principal falling due on said bonds, as the same shall become due or mature; and such interest and principal shall be assessed, levied and raised in the same manner as any other public or general tax of said county, and in conjunction with the general taxes of said county.

Chap. 34.

AN ACT making an appropriation to provide for a deficiency in the appropriation for the repairs and maintenance of the Canals during the fiscal year, commencing on the first day of October, eighteen hundred and sixty-six.

Passed February 15, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The sum of three hundred and nine thousand four hundred and ninety dollars is hereby appropriated out of the revenues of the State canals, for the fiscal year commencing on the first day of October, one thousand eight hundred and sixty-six, to pay the expense of such ordinary repairs of the public works during the said year as are not embraced within and covered by the repair contracts, and to make good a deficiency in the appropriation of one million forty-seven thousand six hundred and six dollars by the act, chapter seven hundred and ninetyone of the Laws of eighteen hundred and sixty-six; and the said sum hereby appropriated, shall be distributed, assigned and appropriated in the first

instance to the three divisions of the canals as now constituted as follows:

To the middle division of the canals, the sum of one hundred and sixty-four thousand dollars.

$2. All the provisions of the act, chapter seven hundred and ninety-one of Laws of eighteen hundred and sixty-six, in relation to the application and disposition of the moneys appropriated by that act, shall be applicable to the appropriations made by this act, except that no moneys appropriated by this act shall be paid for work done by a contractor for repairs, or to any other person for repairs done upon what is called a change of plan, nor shall any of the moneys hereby appropriated be paid to any person or persons whatever, for services as superintendents, inspectors or engineers.

$3. This act shall take effect immediately.

Chap. 35.

AN ACT to amend an act entitled "An act to erect the village of Middleburgh into a separate road district," passed April seventh, eighteen hundred and fifty-nine.

Passed February 15, 1867. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section one of the act entitled "An act to erect the village of Middleburgh into a separate road district," passed April seventh, eighteen hundred and fifty-nine, is hereby amended so that the same shall read as follows:

$1. The village of Middleburgh, in the county of Schoharie, commencing at the northerly bounds of the farm of David Zeh, and running thence through said village to the Hunter's land road,

thence up said road to the easterly side of the entrance of the Middleburgh cemetery, and also commencing at the turnpike in said village and running up the Clauver Wye road to the south bounds of the premises of Lewis Fox, is hereby declared to be, and is hereby constituted, a separate road district; and all the highway labor assessed upon the inhabitants of said village, residing within said district, shall be applied in said district in grading the streets, repairing the roads, constructing stone sidewalks and planting trees along said walks; and the said inhabitants, so residing as aforesaid, shall be exempt from working in any other road district in said town.

$ 2. This act shall take effect immediately.

Chap. 36.

AN ACT to authorize the laying out of a highway in the village of Waverley, town of Otto, county of Cattaraugus.

Passed February 15, 1867; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The commissioners of highways of the town of Otto, in the county of Cattaraugus, are hereby authorized and directed to lay out and establish a highway in the said town, as follows: Commencing at the southeast corner of land, deeded to Mary Rogers, on the street running east and west through the village of Waverley, in said town; thence north two and one-quarter degrees east, three chains, fifty-one links, to the bank of the creek; thence north sixty-three and three-quarter degrees east, one chain and ninety links; thence north seventy degrees east, two chains, eighty-four links; thence north seventy-six and one-half degrees east, four chains and fourteen and one-half links; thence south two and one-quarter degrees west, six chains fifty-four links, to a point in the center of the highway leading to Ellicottville; ten chains thirty-seven and one-half
