Ninth Annual Report of the Court of Claims of the State

DEAR SIR.-Herewith I have the honor to transmit to you, for the Legislature of the State of New York, the ninth annual report of the Court of Claims of the State of New York, as required by law.

REPORT.

To the Legislature of the State of New York:

The statute requires that the Court of Claims "at the commencement of each session of the Legislature and at such other times during the session as it may deem proper, or as the Senate or Assembly may request," report "to the Legislature the claims upon which it has finally acted, with a statement of the judgment in each case." (Section 271, Code of Civil Procedure.)

The Court, in accordance with the requirements of the statute, submits its ninth annual report.

For the purposes of this report, the claims heard and decided during the year 1905 are divided into five classes, as follows:

First. General canal claims.

This class embraces all claims under section 37, chapter 338 of the Laws of 1894, known as the General Canal Law, excepting the socalled canal improvement claims in the second class.

First-B. Barge canal claims.

This class embraces all claims filed under chapter 147 of the Laws of 1903, filed on account of the $101,000,000 canal improvement, and known as Barge Canal claims.

Second. Claims filed on account of the $9,000,000 canal improve

ment.

The liability of the State in these claims is fixed by the General Canal Law, but the claims arose during the progress and on account of the canal improvement work.

Third. Claims other than canal claims filed under special acts of the Legislature.

The claims in this class are known as general claims, and arose in

other ways than on account of the canals. They were sent to this Court under special acts of the Legislature.

Fourth. General claims not under special acts.

These claims do not arise on account of the canals and are not filed

under special acts.
