sioners of the Land Office to grant and release to the city of New York certain lands under water in the Atlantic ocean, in the boroughs of Brooklyn and Queens, to provide for the protection of adjacent uplands, the improvement of such lands under water and uplands, and the acquisition of property for any such purpose, by such city, and to prescribe the method for defraying the cost,' in relation to the authority to lay out on the map or plan of the city of New York public beaches to be acquired for such purposes, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Thompson introduced a bill (Int. No. 534) entitled "An act to amend the Conservation Law, in relation to marine fisheries," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on conservation.

Also, a bill (Int. No. 535) entitled "An act to amend the Conservation Law, in relation to transplanting oysters and taking scallops," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on conservation.

Mr. Webb introduced a bill (Int. No. 536) entitled "An act to amend the Town Law, in relation to application of certain provisions to Dutchess county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. Kirkland introduced a bill (Int. No. 537) entitled "An act to amend the Farms and Markets Law, in relation to quarantine on animals or premises," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on agriculture.

Mr. Westall introduced a bill (Int. No. 538) entitled "An act to amend the Judiciary Law and the Code of Criminal Procedure, in relation to the fees and mileage of trial and grand jurors in Westchester county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Bouton introduced a bill (Int. No. 539) entitled "An act to amend the General Municipal Law, in relation to payments to injured volunteer firemen or their representatives in event of death," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Gibbs, from the committee on the judiciary, to which was referred the Senate bill introduced by Mr. Wales (No. 500, Int. No. 482) entitled "An act to legalize a special town meeting held in and for the town of Conklin, Broome county, on the twentieth day of October, nineteen hundred and twenty-five, authorizing the issuance of bonds of said town for the purpose of raising twentyfive hundred dollars for the purpose of purchasing a site and erecting thereon a town house in and for the said town, together with the proceedings relating to such authorization, and to authorize the issuance of bonds of said town of Conklin for such purpose," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Gibbs, from the committee on the judiciary to which was referred the Senate bill introduced by Mr. Wales (No. 501, Int. No. 483) entitled "An act to legalize the acts and proceedings of the town of Conklin, Broome county, its town board, its officers and agents, had and taken prior to September thirtieth, nineteen hundred and twenty-five, relative to the purchase of a site and erection thereon of a town house in such town," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Westall, from the committee on affairs of villages, to which was referred the Senate bill introduced by Mr. Westall (No. 63, Int. No. 64) entitled "An act to amend chapter two hundred and seventy-seven of the Laws of nineteen hundred and twentytwo, entitled 'An act relating to the construction, reconstruction, improvement and reimprovement of streets and other highways in the village of Port Chester, and relating to the payment of the expense thereof,' in relation to including sidewalks as a part of highway improvements," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

No. 197) entitled "An act in relation to the application and time. of application of certain acts of the years nineteen hundred and twenty, nineteen hundred and twenty-one, nineteen hundred and twenty-two, nineteen hundred and twenty-three and nineteen hundred and twenty-four, relating to defences in actions based upon unjust, unreasonable and oppressive agreements for rent of

premises occupied for dwelling purposes in certain cities, and to actions and proceedings to recover the possession of real property in certain cities," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Nicoll, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Westall, from the committee on affairs of villages, to which was referred the Senate bill introduced by Mr. Thompson (No. 170, Int. No. 170) entitled "An act authorizing the village of Cedarhurst, Nassau county, to issue bonds for ornamental street lights and to levy taxes for the payment thereof," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Westall, from the committee on affairs of village, to which was referred the Senate bill introduced by Mr. Westall (No. 64, Int. No. 65) entitled "An act to provide for the construction and maintenance of a dam and its appurtenances over the Byram river in the village of Port Chester, Westchester county, and in the town of Greenwich, Fairfield county, Connecticut, and to provide means for the payment therefor," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. H. D. Williams moved that the committee on internal affairs of towns, counties and public highways be discharged from the consideration of Senate bill (No. 450, Int. No. 436) entitled "An act to amend chapter six hundred and thirty-nine of the Laws of nineteen hundred, entitled 'An act to make the office of supervisor in the county of Monroe a salaried office and to regulate the sessions of the board of supervisors in said county,' in relation to increasing the salaries of the said supervisors," and that said bill be amended, reprinted and recommitted to the committee on internal affairs of towns, counties and public highways.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Senate bill (No. 476, Int. No. 2) entitled "An act granting the consent of the State of New York to the acquisition by the United States of certain land for lighthouse purposes lying and being in the town of Hyde Park, Dutchess county, State of New York, and ceding jurisdiction over the same," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, two-thirds of all the Senators elected voting in favor thereof, as follows:

The Assembly bill (No. 214, Rec. No. 5) entitled "An act to amend chapter two hundred and sixty-three of the Laws of nineteen hundred and five, entitled 'An act authorizing the town board of the town of Cortlandt to appropriate certain moneys to the Helping Hospital Association of Peekskill, New York,' in relation to authority and power to raise by taxation moneys to be paid to the Peekskill Hospital for the care and maintenance of indigent patients of the town of Cortlandt," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:
