incidental to the Spanish American War the doctrine of American freedom was carried into the Orient and a new republic was created in Cuba and the right of people to govern themselves given new inspiration.

Resolved, That when the Senate adjourn tonight, it do so in honor of the brave sailors and marines who lost their lives in the destruction of the battleship Maine twenty-eight years ago tonight; and be it further

Resolved, That a copy of this resolution be transmitted by the Clerk to the Secretary of the Navy and to the State Commander of the Spanish American War Veterans of New York State.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Webb offered a resolution, in the words following: Whereas, Divine Providence in his infinite wisdom has removed from our midst Edward J. Westcott, Adjutant General of the military forces of the State of New York; and

Whereas, General Westcott, by his long and faithful service to the State has held high the ideals and traditions of the State Military forces; and

Whereas, His splendid character and fidelity have endeared him to the host of patriotic sons who have won for the State of New York a record of glorious achievements; and

Whereas, In the death of General Edward J. Westcott the State suffers a distinct and irreparable loss.

Be it Resolved, That the Clerk of the Senate be and he hereby is directed to send to the bereaved family the condolences of the Senate, and

Be it further Resolved, That this resolution be spread upon the Journal of the Senate and when the Senate adjourn, it do so out of respect to the memory of Edward J. Westcott.

Mr. Kirkland offered a resolution, in the words following:

Whereas, A monument to the memory of Captain John Ericson is to be unveiled in the city of Washington, District of Columbia, on the twenty-ninth day of May, nineteen hundred and twenty-six; and

Whereas, Captain Ericsson was undoubtedly one of the greatest factors in the preservation of the Union, by his invention and construction of the Monitor which defeated the Merrimac at Hampton Roads on the ninth day of March, eighteen hundred and sixty-two, of which service to the Union the national government has taken cognizance by the appointment of a commission for the erection of such monument and the appropriation of a substantial sum toward the payment of the cost of the same, and the further fact that the President of the United States of America will deliver an address at such unveiling; and

Whereas, Captain Ericsson was a resident of the city of New York and State of New York, where the Monitor was built;

Therefore, be it Resolved (if the Assembly concur), That a joint legislative committee is hereby created consisting of two Senators, to be designated by the Temporary President of the Senate, and three members of the Assembly, to be designated by the Speaker of the Assembly, to attend said unveiling of said monument as representatives of the State of New York; and

Be it further Resolved (if the Assembly concur), That the expense of such committee, not exceeding one thousand dollars, be paid out of the contingent fund of the Legislature on vouchers approved and ordered as provided by law.

Ordered, That said resolution be referred to the committee on finance.

The Senate bill (No. 554, Int. No. 315) entitled "An act to amend chapter one hundred and thirty-six of the Laws of eighteen hundred and eighty, entitled 'An act to incorporate the American Jersey Cattle Club for improving the breeding of Jersey cattle in the United States,' in relation to the amount of real and personal estate which such corporation is authorized to hold, mortgage, transfer and convey, was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

No. 31) entitled "An act making appropriations for the maintenance and repair of improved State and county highways, including necessary bridge construction and repair, roads and bridges on Indian reservations, and other special construction and repair work as enumerated herein, was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

No. 32) entitled "An act making an appropriation for the State's share of construction or reconstruction of rural post roads within the State, pursuant to certain acts in Congress which provide that the United States shall aid in the construction of rural post roads and for other purposes; State and county highways, and the construction, reconstruction, alteration or repair of highway bridges," was read the third time.
