The Assembly sent for concurrence a resolution, in the words following:

By Mr. Adler:

Resolved (if the Senate concur), That the Temporary President of the Senate, the majority leader of the Assembly, and the minority leaders of the Senate and Assembly shall be ex-officio members of all joint committees of the Legislature heretofore or hereafter appointed or continued, and that such Temporary President and such leaders shall be entitled to vote upon all questions to determined by such committees; and the chairman of each joint committee shall notify them of each meeting of his committee.

Mr. Knight moved that said resolution be amended to read as follows:

Resolved (if the Senate concur), That the Temporary President of the Senate, the Speaker and majority leader of the Assembly, and the minority leaders of the Senate and Assembly shall be exofficio members of all joint committees of the Legislature heretofore or hereafter appointed or continued, and that such temporary President, such Speaker of the Assembly and such leaders shall be entitled to vote upon all questions to be determined by such committee; and the chairman of each joint committee shall notify them of each meeting of his committee.

Mr. Webb moved that the committee on finance be discharged from the consideration of Senate bill (No. 77, Int. No. 78) entitled "An act to amend chapter nine hundred of the Laws of nineteen hundred and twenty-three, entitled 'An act to provide for the construction of a highway bridge across the Hudson river at Poughkeepsie, between the counties of Dutchess and Ulster, and for the construction of approaches thereto, and making an appropriation therefor,' in relation to the construction of certain retaining walls in connection with such work," and that said bill be amended, reprinted and recommitted to the committee on finance.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Dick moved that the committee on finance be discharged from the consideration of Senate bill (No. 32, Int. No. 32) entitled "An act to amend the Judiciary Law, in relation to the compensation of the attendants of the Appellate Division in the Fourth Department, and making an appropriation therefor," and that said bill be amended, reprinted and recommitted to the committee on finance.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

By unanimous consent, Mr. Knight moved to reconsider the vote by which, on the 11th day of January, 1926, a resolution authorizing the appointment of a committee of eleven to report to the Senate a plan for the reorganization of the State government, was adopted.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Knight offered a resolution, in the words following: Resolved, That a committee of fifteen be appointed to report to the Senate a plan for the reorganization of the State government, pursuant to the provisions of article five of the Constitution, as amended by vote of the people November third, nineteen hundred and twenty-five, and for the appropriate assignment of all civil, administrative and executive functions of the State government to the several departments provided in section two of said article.

By unanimous consent, Mr. Knight moved to reconsider the vote by which, on the 11th day of January, 1926, a resolution authorizing the appointment of a committee of eleven to report to the Senate a plan of legislative reapportionment, was adopted. Mr. Downing offered a resolution, in the words following: Whereas, Federal judges in the various Federal judicial districts of the State have held it to be within their jurisdiction to appoint receivers for local public utility corporations and to issue injunctions restraining local authorities from administering and enforcing State laws and the provisions of franchises and contracts to which the community is a party.

Whereas, The people of the localities affected thereby consider such judicial action to be contrary to the intent and purpose of sound theories of government and an improper encroachment by Federal authorities on the right of the State of New York to administer its own affairs according to its own laws.

Whereas, The judicial control and supervision of utilities operating mainly in a locality should be properly left to the courts duly constituted in such locality.

Resolved (if the Assembly concur), That the Congress of the United States be and the same is hereby respectfully memorialized to enact with all convenient speed such appropriate legislation as will so limit the jurisdiction of the Federal courts and of the judges thereof as will exclude them from power and authority to act in the above recited matters in all cases in which local judicial authorities are vested with jurisdiction sufficient and competent to enforce substantial justice.

Be it further Resolved (if the Assembly concur), That a copy of this resolution be transmitted to the Clerk of the House of Representatives and the Clerk of the Senate and to each member of Congress and to each Senator elected from New York State.

Ordered, That said resolution be referred to the committee on finance.
