Also, a bill (Int. No. 407) entitled "An act making an appropriation for the payment by the State in the first instance of the Federal government's share of the cost of construction and improvement of rural post roads within the State, pursuant to an act of Congress, entitled 'An act to provide that the United States shall aid the States in the construction of rural post roads, and for other purposes, '"' which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Kirkland moved that the Senate do now adjourn until 10 A. M., January 30th.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Whereupon, the Senate adjourned.

Mr. Byrne introduced a bill (Int. No. 408) entitled "An act to confer jurisdiction upon the Court of Claims to hear, audit and determine the claim of William J. Dietz against the State for damages for personal injuries alleged to have been sustained while an inmate of Sing Sing prison while at work on a sheet iron press, alleged to have been caused through the negligence of the State, its officers and employees, and to render judgment therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on general laws.

Mr. J. F. Williams moved that the Senate do now adjourn. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Whereupon, the Senate adjourned until Monday, February 1st, at 8:30 P. M.

No. 411) entitled "An act to amend the Education Law, relative to medical inspection and health service in the public schools," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public education.

Shearer against the State for damages for personal injuries alleged to have been sustained while an inmate of Auburn prison, caused through the alleged negligence of the State, its officers and employees, in failing to provide proper guards on a certain power machine used for grinding food, in failing to have a man in attendance, in permitting the floor to become and remain wet and slippery and in permitting such machine to be operated by a belt on a stationary pulley, and to render judgment therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on general laws.

Mr. Knight introduced a bill (Int. No. 415) entitled "An act to amend the Conservation Law, in relation to impounding skunk caught while injuring property," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on conservation.

Mr. Thompson introduced a bill (Int. No. 416) entitled "An act making an appropriation for the payment of legal services rendered to the board of trustees of the State Institute of Applied Agriculture on Long Island during the year nineteen hundred and twentytwo, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

The Assembly sent for concurrence the bill (No. 344, Rec. No. 7) entitled "An act to amend the Highway Law, relating to highway improvement with Federal aid, generally," which was read the first time, and by unanimous consent was also read the second time. On motion of Mr. Ferris, and by unanimous consent, said bill was substituted for Senate bill (No. 208, Int. No. 83), now in the committee of the whole.

Leave of absence was granted Mr. Dunnigan on account of the death of his brother.

Mr. Knight moved that the Clerk be directed to extend to Senator Dunnigan the condolence of the Senate.

Mr. Hewitt moved that the committee on finance be discharged from the consideration of Senate bill (No. 428, Int. No. 420) entitled "An act to provide for the acquisition of land in the city of Albany, for a State office building, for clearing such lands of the structures thereon and initiating the construction of such building, and authorizing a State debt and making an appropriation therefrom for such purpose, and making an appropriation from the general fund for incidental expenses.

On motion of Mr. Hewitt, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading. Said bill was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the necessity for the immediate passage of the same having been certified by the Governor, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:
