Mr. Hewitt offered a resolution, in the words following:

Whereas, By resolution adopted on March 18, 1925, the special joint committee appointed to consider the question of the elimination of grade crossings was directed to report to the Legislature on or before February 15, 1926; and

Whereas, Further time is needed by the committee to consider questions which have arisen in certain cities of the State.

Resolved (if the Assembly concur), That the committee be continued with all the powers and duties imposed upon it and that it be directed to make its report to the Legislature on or before April 1, 1926.

Resolved (if the Assembly concur), That the further sum of $6,700.00, or as much thereof as may be necessary, be paid from the contingent fund of the Legislature for the expenses of said committee, upon vouchers approved and audited as provided by law.

Whereas, Experience has taught that the concurrent power of Congress and the several States to enforce the Eighteenth Amend

ment to the Federal Constitution has produced disorder, conflict, invasion of private rights and double jeopardy to individuals.

Resolved (if the Assembly concur), That the Congress be and the same hereby is momorialized to initiate an amendment to the Federal Constitution eliminating from the Eighteenth Amendment the provision conferring on the States concurrent power to enforce the same.

Resolved (if the Assembly concur), That a copy of this resolution be forwarded to each Senator and representative in Congress from the State of New York.

Ordered, That said resolution be referred to the committee on finance.
