The Senate proceeded to consider the report; and

On motion by Mr. Fessenden,

Resolved, That the Senate concur therein.

Ordered, That the Secretary notify the House of Representatives thereof.

Mr. Pugh, from the second committee of conference on the disagreeing votes of the two houses on the bill (H. R. 865) making appropriations for the current and contingent expenses of the Indian Department, and for fulfilling treaty stipulations with various Indian tribes, for the year ending the 30th of June, 1862, made the following report:

"The committee of conference on the disagreeing votes of the two houses on the amendments to the bill (H. R. 865) making appropriations for the current and contingent expenses of the Indian Department, and for fulfilling treaty stipulations with various Indian tribes, for the year ending June 30, 1862, having met, after full and free conference, have agreed to recommend to their respective houses as follows:

"That they adopt the report of the former committee of conference on the disagreeing votes on the amendments to said bill, except as to numbers 5, 6, and 19 of said amendments; and, as to said amendment No. 19, they recommend that the House recede from their disagreement thereto and agree to the same with the following amendment: Strike out the whole amendment and in lieu thereof insert the following: For payment to the Choctaw nation or tribe of Indians on account of their claim under the eleventh and twelfth articles of the treaty with said nation or tribe, made the 22d of June, 1855, the sum of five hundred thousand dollars; two hundred and fifty thousand dollars of which shall be paid in money, and for the residue the Secretary of the Treasury shall cause to be issued to the proper authorities of the nation or tribe, on their requisition, bonds of the United States, authorized by law at the present session of Congress: Provided, That in the future adjustment of the claim of the Choctaws, under the treaty aforesaid, the said sum shall be charged against the said Indians.

"That the House recede from their disagreement to the fifth and sixth amendments of the Senate, and agree to the same with the following amendment to each: Provided, That the said sum may be paid,

at the discretion of the Secretary of the Treasury, in bonds of the United States, authorized by law at the present session of Congress."

Mr. Douglas, from the second committee of conference on the disagreeing votes of the two houses on the bill (S. 10) to amend "An act in addition to an act to promote the progress of the useful arts," made the following report:

"The committee of conference on the disagreeing votes of the two houses on the amendments to the bill (S. 10) entitled "An act in addition to an act to promote the progress of the useful arts," having met, and, after a full and free conference thereon, agreed to report and do report as follows: Strike out all after the word "that," in the sixteenth section, and insert the following: All patents hereafter granted shall remain in force for the term of seventeen years from the date of issue, and all extension of such patents is hereby prohibited.

The Vice-President signed the enrolled bill (H. R. 852) for the relief of certain Chippewa, Ottawa, and Pottawatomie Indians, and it was delivered to the committee to be presented to the President of the United States.

Mr. Bingham reported from the committee that they had examined and found duly enrolled the following bills and joint resolutions:

S. 19. An act legalizing certain entries of lands on Leavenworth Island, in the State of Missouri.

S. 459. An act for the relief of Commander Thomas J. Page, United States Navy.

S. 524. An act authorizing the Secretary of the Treasury to issue a

register to the schooner Perseverance, of Ogdensburg, State of New York.

S. 561. An act for the relief of Daniel B. Hibbard.

S. 565. An act for the relief of Lewis Warrington, paymaster United States Navy.

S. 567. An act donating to the States of Minnesota and Oregon certain lands reserved by Congress for the Territories of Minnesota and Oregon for university purposes.

S. 568. An act for the relief of Leslie Combs and Robert H. Crittenden, sureties of the late A. J. Mitchell, purser in the United States Navy.

S. 45. Resolution authorizing the issue of the same quota of arms to the State of California for the years 1850 and 1851 as was issued to that State for the year 1852.

S. 64. Resolution for the appointment of regents for the Smithsonian Institution.

A message from the House of Representatives, by Mr. Forney, its Clerk:

Mr. President: The House of Representatives has agreed to the report of the committee of conference on the disagreeing votes of the two houses on the bill (H. R. 865) making appropriations for the current and contingent expenses of the Indian department and for fulfilling. treaty stipulations with various Indian tribes for the year ending the 30th of June, 1862.

The Speaker of the House of Representatives having signed two enrolled bills (H. R. 899) and (H. R. 923) and an enrolled resolution, (H. R. 59,) I am directed to bring them to the Senate for the signature of its President.

Mr. Bingham reported from the committee that they this day presented to the President of the United States the following enrolled bills:

S. 149. An act making appropriations to supply a deficiency in the appropriations for the completion of the geological survey of Oregon and Washington Territories.

S. 270. An act for the relief of John H. Wheeler.

S. 501. An act for the relief of Henry Rice.

S. 562. An act to provide a temporary government for the Territory of Dakota, and to create the office of surveyor general therein. S. 563. An act to organize the Territory of Nevada.

H. R. 971. An act making appropriations for the service of the Post Office Department during the fiscal year ending the 30th of June, 1862.

H. R. 1007. An act declaring the value of the new silver florin of Austria.

On motion by Mr. Bigler, that the Senate proceed to the consideration of the resolution submitted by him the 28th of February to suspend the 26th rule of the Senate so far as it relates to bills or joint resolutions proposing amendments to the Constitution of the United States,

It was determined in the affirmative; and,

On the question to agree to the resolution,

A point of order was made by Mr. Hale, to wit: That no motion or resolution proposing a suspension of a rule of the Senate was in order. The President (Mr. Fitch in the chair) decided that the resolution was in order.

From this decision Mr. Hale appealed.

On the question, Shall the decision of the Chair stand as the judgment of the Senate?

It was determined in the affirmative.

So the decision of the Chair was sustained.

On motion by Mr. Hale, to amend the resolution by striking out the word "suspended," and in lieu thereof inserting repealed,

It was determined in the affirmative.

On the question to agree to the resolution as amended,
