11 which have been or shall be passed, relative to rail12 road corporations.

1 SECT. 2. Said company may locate, construct, and 2 maintain a railroad with one or more tracks from 3 some convenient point at or near the village of Pitts4 field, by the most convenient route to some point at 5 or near the Housatonic River, in the easterly part of 6 the town of Lenox; thence by the most feasible 7 route through the town of Lee to Becket; thence to 8 Otis, following the valley of the Farmington River 9 through the towns of Tolland and Sandisfield, to the 10 north line of the state of Connecticut at Colebrook : 11 provided, if the Stockbridge and Pittsfield railroad 12 corporation do locate and construct their road within 13 the time limited [by] their act of incorporation, then 14 the northern terminus of the Pittsfield and New Haven 15 railroad shall be at the intersection with said Stock16 bridge and Pittsfield road, in the town of Lee or 17 Lenox.

SECT. 3. The capital stock of this company shall 2 consist of not more than nine thousand shares, the 3 number of which shall, from time to time, be deter4 mined by the directors of said company, and no 5 assessment shall be laid thereon, of a greater amount 6 in the whole, than one hundred dollars on each 7 share, and said company may invest and hold such 8 part thereof in real and personal estate, as may be 9 necessary and convenient for the purposes of their 10 incorporation.

1 SECT. 4. Said company may enter upon and unite

2 their railroad by proper turnouts and switches with 3 the Western railroad at some convenient point, at or 4 near the village of Pittsfield, and use the same under 5 the provisions and restrictions of the laws relating to 6 railroads.

Said company may enter upon and unite 2 their railroad by proper turnouts and switches with 3 the railroad authorized to be constructed by the 4 Stockbridge and Pittsfield Railroad Company, at some 5 convenient point in the town of Lee or Lenox, and 6 use the same under the provisions and restrictions of 7 the laws relating to railroads, and as provided for in 8 the sixth section of the act of incorporation of said 9 Stockbridge and Pittsfield Railroad Company.

SECT. 6. The legislature may, after the expira2 tion of five years from the time when the said railroad 3 shall be opened for use, from time to time reduce the 4 rates of tolls and other profits upon said road: but 5 the same shall not be so reduced, without the consent 6 of said company, as to produce, with said profits, less 7 than ten per centum per annum.

1 SECT. 7. If said company shall not have been 2 organized, and the location of the route of said road 3 filed with the county commissioners of the counties 4 of Berkshire and Hampden, within two years from 5 the passage of this act, or if said company shall fail 6 to complete said road within four years from the 7 passage of this act, then this act shall be void.

SECT. 8. This act shall take effect from and after 2 its passage.

RESOLVE

On the Petition of the Overseers of the Poor of the Town of Chelsea.

Resolved, for reasons set forth in said petition, that there be allowed and paid out of the treasury of the Commonwealth, to the treasurer of the town of Chelsea, the sum of ninety-five dollars and nine cents, in full discharge of all claims by said town, for the support of state paupers for the year eighteen hundred and forty-six; and that a warrant be drawn accordingly.
