4 of good moral character, as, in their judgment, the 5 public good may require, to be sellers of alcohol and 6 wine, for the purposes specified in the preceding sec7 tion, such licenses not to extend over one month be8 yond the term of office of said selectmen, or mayor 9 and aldermen.

SECT. 3. Every person, on applying for a license, 2 under this act, before receiving the same, shall sub3 scribe the following declaration :—

4 "I, [here insert the name,] being licensed to be a 5 seller of alcohol in [here insert the town or city,] in 6 the Commonwealth of Massachusetts, do hereby prom7 ise, that I will not purchase, nor knowingly sell, nor 8 permit to be sold under me, any alcohol, rum, brandy, 9 gin, wine, or other spirituous or intoxicating liquors, 10 to be used as a beverage, or for other purposes than 11 permitted by the laws of this Commonwealth ;" which 12 subscribed declaration shall be kept on file by said 13 selectmen, or mayor and aldermen, granting the li

14 cense.

SECT. 4. Every licensed seller of alcohol shall put up, in or about his premises, in some conspicuous 3 place, the words

LICENSED TO SELL ALCOHOL ;

5 and shall keep a book open to public inspection, in 6 which he shall record all sales by him made, with the 7 date, and name of the purchaser.

1 SECT. 5. Every licensed seller of alcohol, who 2 shall knowingly offend against any of the foregoing 3 provisions, shall forfeit not less than twenty dollars,

4 nor more than fifty dollars, and his license, which shall 5 not be renewed for the space of one year; but no 6 person, whose license shall be so forfeited, shall there7 by be discharged from any indictment or complaint, 8 under this section, pending against him.

SECT. 6. Every purchaser of alcohol, who shall, 2 designedly, by false pretences, or false description of 3 his name or the purpose for which the liquor is 4 bought from any licensed seller thereof, obtain alcohol, 5 rum, brandy, gin, wine, or other spirituous or intoxi6 cating liquor, to be used as a beverage, or for other 7 purposes than permitted by the laws of this Com8 monwealth, shall forfeit twenty dollars for every such 9 offence.

SECT. 7. If any person, without license, shall sell, 2 or offer for sale, or have in his possession, with intent 3 to sell, any intoxicating liquor, he shall forfeit, for 4 each offence, twenty dollars.

1 SECT. 8. If any person shall be more than once 2 convicted under any of the foregoing provisions, he 3 shall, in addition to the aforementioned penalties, on 4 the second conviction, be imprisoned in the county 5 jail or house of correction, not less than ten nor more 6 than thirty days; and, on the third conviction, not 7 less than thirty, nor more than ninety days; and, on 8 the fourth conviction, he shall be adjudged a common 9 and notorious offender, and be committed to the county 10 jail or house of correction for any term not less than 11 one year.

SECT. 9. No person shall knowingly let, or know2 ingly suffer to be used, any building for the sale of 3 intoxicating liquor, contrary to the provisions of this 4 act, on pain of forfeiting not less than fifty dollars nor 5 more than five hundred dollars. And whenever a 6 building shall be so used, the lease, at the option of 7 the lessor, shall be void, and the lessee may be ejected, 8 without notice, according to the one hundred and 9 fourth chapter of the Revised Statutes.

SECT. 10. Every justice of the peace, and every 2 court before whom any person may be convicted of 3 drunkenness, or of being a common drunkard, shall, 4 within ten days after sentence is pronounced, certify 5 the same to the clerk of the town or city where such 6 convict resides; and it shall be the duty of such clerk, 7 forthwith, to cause written notice of such conviction 8 to be given to all licensed sellers of alcohol in such 9 town or city; and if such licensed seller, or any other 10 person, with knowledge of such conviction, shall 11 thereafter give or sell, to any such convict, any intoxi12 cating liquor, he shall, for every such offence, forfeit 13 one hundred dollars.

1 SECT. 11. The several courts and justices of the 2 peace, pending any complaint or indictment, under 3 the sixth or seventh section of this act, may, on a 4 complaint, under oath, issue a search-warrant against 5 the place suspected, if the defendant has been already 6 arrested, or, if not, may insert the appropriate clause 7 in the warrant for his arrest, commanding that all 8 intoxicating liquors, and the casks or other vessels 9 containing the same, and implements used in the

10 traffic, found upon the premises, be seized, and held 11 to be used as evidence on the trial of the defendant; 12 and, in addition to the other penalties herein before 13 provided, to be forfeited, in case of conviction, and 14 disposed of, under the direction of the court, to li15 censed dealers only.

1 SECT. 12. All forfeitures under this act may be 2 recovered by indictment to the use of the Common3 wealth; and when the same does not exceed twenty 4 dollars, the prosecution may be had before a justice of 5 the peace or police court, subject to the right of ap6 peal, as in other cases: provided, however, that, in 7 cases of conviction, under section ten of this act, if it 8 shall be made to appear, on representation to the 9 court, that the party to whom the intoxicating liquor 10 was sold has a wife in needy circumstances, the court 11 may, upon her application, order that the forfeiture, 12 not including the costs, be paid to such wife for her 13 sole and separate use.

SECT. 13. The words "alcohol" and "intoxicat2 ing liquor," as used in this act, shall severally be con3 strued to include rum, brandy, gin, wine, and all other 4 liquors, part of which is spirituous or intoxicating.

SECT. 14. All acts, and parts of acts, inconsistent 2 with this act, are hereby repealed, saving all rights of 3 prosecution for offences previously committed.

SECT. 15. This act shall go into operation on the 2 first day of July next; but licenses may be granted 3 under it during the months of May and June next, to

4 take effect simultaneously therewith; and no licenses, 5 granted under the forty-seventh chapter of the Re6 vised Statutes, shall authorize the sale of intoxicating 7 liquors after said day.
