FOURTH SUPPLEMENT TO HOUSE No. 62.

[The amendment, moved by Mr. Hilliard, of Roxbury, as a substitute for the bill reported by the committee on the license law, and adopted by the House, and ordered to a 3d reading.]

Commonwealth of Massachusetts.

In the Year One Thousand Eight Hundred and FortyEight.

AN ACT

Regulating the Sale of Alcohol, and Prohibiting Intoxicating Drink.

BE it enacted by the Senate and House of Representatives, in General Court assembled, and by the authority of the same, as follows:

SECT. 1. All those provisions of the forty-seventh 2 chapter of the Revised Statutes, which authorize the 3 licensing of innholders, common victuallers, and re4 tailers, with authority to sell wine, brandy, rum, or

5 other spirituous liquors, are hereby repealed, with the 6 following provisoes and exceptions, to wit:-The li7 censes referred to in said chapter may be granted in 8 the manner, at the times, and by the authorities, 9 therein specified, but shall be so expressed, as to au10 thorize the sale of the above-named liquors for me11 chanical, medicinal, or sanitary purposes only.

SECT. 2. All sales of such liquors in a less quan2 tity than twenty-eight gallons, and that delivered and 3 carried away all at one time, made without license, as 4 aforesaid, shall be subject to the same penalties and 5 forms of prosecution, as are provided in said chapter 6 for the unlicensed sale of such liquors.

SECT. 3. Said licenses shall not describe the per2 sons therein named, as innholders, common victual3 lers or retailers, but only as sellers of such liquors for 4 the purposes above named.

SECT. 4. All the provisions of said chapter, and 2 of all other acts in addition thereto, not inconsistent 3 with this act, and the nature and form of license 4 herein provided, are hereby affirmed and declared in 5 force; and all the provisions of said chapter, and all 6 other acts and parts of acts, inconsistent herewith, 7 are hereby repealed, saving, however, the rights of all 8 persons under licenses heretofore granted, and all 9 rights of prosecution to final judgment and execution, 10 under the laws granting such licenses.

SECT. 5. No prosecution for a violation of any 2 law relating to the sale of such liquors shall be post

3 poned or suspended, upon the ground of any promise 4 by the defendant, without sufficient sureties that he 5 will not repeat the offence; but all such prosecutions 6 shall be disposed of in the regular course of criminal 7 business.

SECT. 6. Nothing herein contained, shall be so 2 construed as to interfere with the revenue laws, or 3 any provision of the constitution of the United States.

To incorporate the Long Island Company.

BE it enacted by the Senate and House of Representatives, in General Court assembled, and by the authority of the same, as follows:

1 SECT. 1. Benjamin Smith, Thomas Smith, S. 2 Hillman Barnes, their associates and successors, are 3 hereby made a corporation, by the name of the Long 4 Island Company, with power to purchase and hold, in 5 fee simple, or otherwise, all, or any part, of that tract 6 of land lying in Boston Harbor, and known as Long 7 Island, and all flat, rights, easements, privileges, and 8 appurtenances, thereto belonging.
