6 ties, liabilities and restrictions, contained in the for7 ty-fourth chapter of the Revised Statutes, and in that 8 part of the thirty-ninth chapter of said statutes which 9 relates to railroad corporations, and in all general 10 laws which are now, or may be hereafter, in force re11 lating to railroad corporations in this commonwealth.

SECT. 2. The capital stock of said company shall 2 not exceed two thousand five hundred shares, the 3 number of which shall be determined from time to 4 time, by the directors thereof; and no assessments 5 shall be laid thereon, of a greater amount in the 6 whole than one hundred dollars on each share; and 7 said company may purchase and hold such real and 8 personal estate as may be necessary for the purposes 9 of their incorporation.

SECT. 3. The said company may locate, construct 2 and maintain a railroad, with one or more tracks, 3 from some convenient point in the town of Amherst, 4 within half a mile of Amherst College, through the 5 town of Hadley, to some point on the Connecticut 6 River Railroad in Northampton, or in the southerly 7 part of Hatfield; and said company are empowered, 8 for the purposes of said railroad, to construct and 9 maintain a bridge across the Connecticut River, at 10 any point between the Northampton Bridge and the 11 site of the old Hatfield Bridge.

SECT. 4. The said company may enter upon and 2 unite their railroad with the Connecticut River Rail3 road, at any point within the town of Northampton, 4 or in the southerly part of Hatfield, as provided in

5 the third section of this act, not interfering with the 6 depot buildings of said Connecticut River Railroad, 7 and use the same, or any part thereof, upon such 8 terms as may be mutually agreed upon between the 9 said corporations, or as are, or may be, prescribed by 10 law.

SECT. 5. If the said company be not organized, 2 and the location of their said road filed, according to 3 law, within the year one thousand eight hundred and 4 forty-nine, and if said railroad be not completed and 5 opened for use within eighteen months thereafter, 6 then this act shall be void.

1 SECT. 6. The legislature may, from time to time, 2 alter or reduce the rate of tolls or other profits on 3 said road; but said tolls or other profits shall not, 4 without the consent of said company, be so reduced 5 as to produce less than ten per cent. per annum on 6 their capital stock.

SECT. 7. The company hereby established, by a 2 vote of its stockholders, at a meeting called for that 3 purpose, may become united with the Connecticut 4 River Railroad Company: provided, that the stock5 holders of the Connecticut River Railroad Company, at 6 a meeting called for that purpose, shall agree to the 7 same. And when such union shall have been made, 8 said corporations so united shall have, possess, and 9 hold all the property, rights, privileges and franchises, 10 and be subject to all the duties, restrictions and lia11 bilities which said corporations so united had enjoyed

12 and been subject to under their respective charters, 13 and shall bear the name of the Connecticut River 14 Railroad Company.

SECT. 8. This act shall take effect from and after 2 its passage.

AN ACT

Concerning the Hampshire and Franklin Railroad Corporation.

BE it enacted by the Senate and House of Representatives, in General Court assembled, and by the authority of the same, as follows:

SECT. 1. The time fixed for the construction of 2 the road, by the original act incorporating the said 3 Hampshire and Franklin Railroad Corporation, is 4 hereby extended one year from the first day of Feb5 ruary next.

SECT. 2. This act shall be void, unless it shall be 2 accepted by a majority of the stockholders in said 3 corporation, at a meeting legally held for that purpose, 4 within ninety days from the passage of this act.

1 SECT. 3. This act shall take effect from and after 2 its passage.
