Excerpt: ...been a time since the promulgation of the decree of December 10, in reference to the asphalt controversy, when the operation of that instrument could not have been temporarily suspended as a matter of comity and courtesy to the Government of the United States. Practically the decree, so far as the question of disturbing the possession of the New York and Bermudez Company, for the time apparently has been suspended, presumably as the result of protests from Washington. It has seemed to me that this should have been done in a gracious and generous manner. I tiiink the plain disposition here is to have the matter determined by the courts, as you suggest. The original intention, so far as it could be ascertained, did not contemplate a determination of title by the courts prior to the dispossession of the New York and Bermudez Asphalt Company. Wnat is known in commercial parlance as a "quick transaction" appears to have been desired. Resort to the courts is almost sure to bring its chain of embarrassments. It seems likely that either the Wanier-Quinlan people or the New York and Bermudez Company will be wholly dissatisfied with the finding of the court, and seek"some further determination of the matter. The courts here often labor under grave disadvantages. Confidential.
