No Perfon fball build or erect any Cottage for Habitation, or convert any Building Houfe to that End, unless he do lay four Acres of his

Freehold Inheritance near to the faid Cottage, to be occupied therewith, upon Pain to forfeit to the King 10l. for every fuch Offence, and 40s. a Month for the Continuance. 31 Eliz. cap. 7•

And for Inmates fball forfeit 10 S. a Month to the Lord of the Leet. 3. Eliz cap. 7 See Cottage. Every Surveyor neglecting his Office, and making Default, forfeits 20 s. 2 & 3 Ph. & M. cap. 8.

For neglecting to fend a Team, &c. 10s. a Day. Ibid. And Cottager not working forfeits 1 s. a Day, and the Defaulters to be fin'd at the Difcretion of the Steward. Ibid.

To be fined at the Difcretion of the Jury.

< And now, Gentlemen, I beg Leave to put in Mind of the Court-Baron, and what Things you are to inquire into and present relating thereto, and they are either between Lord and Tenant, or between Tenant and Tenant, as I mentioned before.

And first, you ought to inquire of all Perfons that do owe Suit to this Court, and at this Day have made Default, and present them, for all fuch Perfons as hold of the Lord by Suit of Court, of what Age foever, or of what Diftance in dwelling, fuch Tenant ought to appear and do his Suit and Service, or elfe be amerced.

Likewife you ought to inquire if any Tenant be dead fince the laft Court, or at any Time before, and his Death not yet prefented; for it is 'your Business to inquire what Lands he held of this Manor, and how they were holden, and what Advantage the Lord fhall have by his Death, as Relief, Efcheat, or other Profits, and who is next Heir, and of what Age.

You fhall alfo inquire if there be any that do conceal or occupy any of the Lord's Lands without his Licence; what Lands and Tenements they are, of what yearly Value, and how Jong they have been detained.

You fall alfo inquire if there be any Rents, Cuftoms or Services with-held from the Lord of this Manor, and what the fame are, by whom withdrawn, and in what Bailiff's Time, and how long they have been detained.

Alfo you fhall inquire what Tenants of the Lord are dead without Heirs, General or Special; for in fuch Cafe the Lord fhall have the Lands by Efcheat.

If any Tenant feifed in Fee be Attainted of < Felony, by Verdict or otherwife; for in fuch Cafe the King fhall have Year, Day and Waste, and afterward the Lord fhall have the Lands by • Efcheat.

If any Bastard hath purchased any Lands within this Manor, and hath died without Iffue of his Body; for in fuch Cafe the Lord fhall have his Lands by Escheat.

You are to inquire of Eftrays; as where any ftrange Beast comes into this Lordship, and is ૐ not claimed within a Year and a Day, it falls to the Lord of the Manor as an Estray.

You fhall inquire if any Tenant of this Manor do furcharge the Common, by putting in more Cattle than by the Rate of his Tenure he ought; or if any having meerly Common Appendant, and not Common Appurtenant, doth put on the Common, Cattle not Commonable, as Hogs and and Goats; or if any doth break the Lord's Soil, unless it be for Gravel for Repairing the Highways, making up the Breach again.

Alfo you fhall inquire whether any Tenant of this Manor hath made any Feoffment, Gift,

Grant,

Grant, or Alienation of his Lands in Mortmain, (viz.) To a Bishop, Parfon, Vicar, Corporation, < Guild or Fraternity, and their Succeffors, without Licence of the King and the Lord of the • Manor; the Lord may enter and take fuch Lands · as a forfeit within a Year and a Day.

In like Manner you fhall enquire, whether any Freeholder hath alienated his Freehold Lands or Tenements, or any Parcel of them, and not "given Notice thereof to the Lord, and the Alienee hath not done Fealty to the Lord, nor Suit of 'Court, that the Lord may know who is his Tenant; for this is prefentable, fo that the Lord may know upon whom to make Avowry, and of whom to have his Services and Escheat.

You fhall enquire, whether any Tenant for Term of Life, or Years, or any Copyholder of this Lordship hath done any Waste in any House, Lands, Woods or Gardens, and present the fame.

You fhall enquire, whether any have committed any Trefpafs in the Lord's Demefnes, whether the fame be Land, Meadow, Pafture, Wood or Water, or if any have fifhed in the Lord's Rivers, or Waters, or hunted in the Lordship, and present it.

Likewife you are to enquire, whether any Bailiff or Officer hath made any Diftrefs for Rent, Custom, or Service due to the Lord, and Refcous hath been made to him, you fhall present the Names of those who made the Refcous, and where and when it was made.

If any Distress hath been put into the Lord's Pound, and hath been taken out of the fame without lawful Authority; this is Pound-Breach, • &c. and enquirable.

Also it is an indifpenfable Duty upon you to enquire, whether any Perfon hath removed or taken away any Meer-Stones, Boundaries, or H 4 • Stakes,

Stakes, between this Lordfhip and any other next C adjacent, or between Tenant and Tenant, and prefent the fame.

If any Tenant of this Manor hath (without the Licence and Confent of the Lord) inclosed any Lands, and keeps the fame in Severalty which ought to lie open; this alfo is inquirable.

And particularly you ought to inquire, whether any Perfon doth keep to himself, with-hold or conceal, any Evidences, Court-Rolls, Rentals, for other Writings or Records belonging to the Lord of this Manor, and prefent the same.

You fhall alfo inquire whether any Pain or Penalty formerly impofed at any Court heretofore fet for this Manor, to be performed or done, hath not hitherto been done or performed, and in whom the Default is, and prefent his Name.

If any Copyholder hath at any Time, contrafry to the Custom of the Manor, demifed or let by Leafe, all or any of his Meffuages, Cottages, Lands, Tenements or Hereditaments which are customary, and holden of this Manor by Copy of Court-Roll, for any longer Time than a Year and a Day, without Licence, it is a Forfeiture of his Eftate, and you must present the fame.

If any Copyholder or Tenant of any cuftomary Meffuages, Cottages, Lands or Tenements holden of this Manor by Copy of Court-Roll, hath at any Time, contrary to the Cuftom of the Manor, alienated his faid cuftomary Lands or Tenements, or any Part or Parcel thereof, unto any Perfon or Persons whatfoever, by Deed of Leafe and Releafe, Bargain and Sale inrolled, Feoffment with Livery of Seifin thereupon, or otherwife, without Surrender, according to the Custom of the Manor; this is alfo a Forfeiture of his Copyhold Eftate, to the Lord of the Manor, and here in-. f quirable,,
