cording to the Custom of the Manor of W. in the County of E. of one Copyhold, or Cuftoma< ry Meffuage or Tenement, called C. with a Garden and Orchard thereunto belonging, now in the Tenure or Occupation of the faid F. M. &c. holden by Copy of Court-Roll, of the aforefaid Manor of W. all which Copyhold or Cuftomary Premiffes, the greater Part of the abovenamed Commiffioners by the faid Commiffion authorized, have caused to be viewed and arrented, and the refpective Eftates of the faid F. M. of and in the fame, to be appraised to the beft Value they may; and accordingly the fame have been viewed, arrented and appraised by J. K. and R. F. Men of fufficient Skill and Judgment for the Doing thereof, in Manner and Form following, (that is to fay,) the aforefaid Meffuage or Tenement called • C. and the Garden and Orchard thereunto be

longing, in the Occupation of the faid F. M. fituate, lying and being at W. aforefaid, to be let for the yearly Rent of five Pounds of lawful Money of Great Britain, and the Eftate of the faid • F. M. therein, worth to be fold for ninety Pounds, of like lawful Money, &c. The faid S. E. E. T. and J. F. with the Confent, and at the Request of the Creditors of the faid F. M. for and in Confideration of the Sum of 897 1. of lawful Money of Great Britain unto the faid S. E. E. T. and J. J. by the faid RW. R. B. D. M. E. C. and W. E. to the Ufe, Benefit and Behalf as well of themselves, as alfo of all other the Creditors of the faid F. M. that have fued C forth, and have joined, and that fhall hereafter join in the Profecuting of the faid Commiffion, as much as in them the faid S. E. E. T. and J. M. holden by Copy of Court-Roll of the forefaid Manor of W. &c. together with all Woods, Underwoods, Commons, Paftures, Feedings, Ways, Watercourfes, Eafements, Profits, Commodities and Appurtenances whatfoever, unto all and every the faid Copyhold, or Cuftomary Premiffes thereby granted, and every Part and Parcel thereof, belonging or in any wife appertaining, or therewithal ufually letten, occupied or enjoyed, and all the Eftate, Right, Title, Intereft, Ufe, Poffeffion, Reverfion and Reverfions, Remainder and Remainders, Claim and Demand whatsoever of the faid F. M. of, in and to all and fingular the Premiffes hereby granted, and of every Part and Parcel thereof, with the Appurtenances; To have and to hold all the faid Copyhold, or Cuftomary Meffuage or Tenement, called, &c. and every Part and Parcel thereof, with all and every the Appurtenances, unto the faid R. W. R. B. D. M. E. C. and W. E. their Heirs and Affigns, to their own proper Ufe and Behoof for ever, according to the Custom of the faid Manor, whereof the fame be refpectively holden as aforefaid; And to have and to hold all and fingular the faid Clofe or Pasture Ground, called H. and the faid Clofe of arable Land thereunto adjoining, and every Part and Parcel thereof, with all and every the Appurtenances, unto the faid R. W. R. B. D. M. E. C. and × W. E. and their Affigns, to their own proper Ufe and Behoof, for and during the natural Life of the faid F. M. according to the Custom of the Manor of A. aforesaid, yielding, paying,

performing and doing unto the faid feveral Lords of the feveral Manors before-mentioned, of whom the Copyhold, or Customary Premiffes hereby granted are refpectively holden, all and every the Fines, Rents, Duties and Services, of Right ufed and accustomed to be yielded, payed, performed and done for the fame. Bar, A Custom for a Copyholder, Tenant in Tail, to make a Leafe for Years without Licence, to commit a Forfeiture, on purpose to bar the Entail, and to transfer the Lands over to another, is a good Custom, and is but in the Nature of a Surrender or Common Recovery. 2 Saund. 422. Of Copyhold Lands.

HIS Indenture made, &c. between 7. R. of, &c. on the one Part, and M. L. of, c. on the other Part, witneffeth, that the faid J. R. in Confideration of the Sum of 500 l. c. whereof, &c. hath bargain'd and fold, and by these Presents, &c. unto the faid M. L. and his Heirs, one Meffuage or Tenement, being Cufto

mary or Copyhold Land, belonging to the Manor of L. in the County of D. with a Curtilage, and the Gardens thereunto adjoining, commonly called, &c. all which Premiffes were fome Time the Lands and Tenements of A. B. and are now in the Tenure and Occupation of the faid M. L. or his Affigns, by Virtue of a Leafe to him thereof granted by the faid J. R. by Licence of the Lord, for divers Years yet to come: And the faid J. R. covenanteth, &c. That he the faid J. at the enfealing and delivering of these Presents, is lawfully feiled thereof in good and perfect Estate in Fee-fimple, of the Nature of Copyhold, according to the Cuftom of the faid Manor of L. of all and fingular the Premiffes, with the Appurtenances, as defcended and come by Cuftom of the faid Manor unto the faid J. R. from W.R. deceased, Father of the faid . difcharged, or otherwife faved harmless, of and from all former Bargains, Sales, Surrenders, Forfeitures and Incumbrances what foever, had, made, committed or done by the faid W. R. (the Leafe above-mention'd always excepted;) and for that the Premiffes are holden of the faid Manor by Copy of Court-Roll, That he the faid 7. before the Feast of, &c. at the Cofts and Charges of the faid M. his Heirs, Executors and Adminiftrators, fhall and " will furrender the Premiffes into the Hands of the Lord of the faid Manor for the Time being, in fuch Sort as by the faid M. L. his Heirs and Affigns, or his or their Counsel learned in the Law, fhall be devised or required, to the Intent that the faid Surrender may be prefented by the Homage of the faid Manor; and that the Lord of the faid Manor for the Time being, may, at his Pleasure, grant the Premiffes to the faid M. L. and his Heirs, to hold the fame by Copy of Court-Roll, according to the Custom of the faid

Manor; and that he the faid J. R. and his Heirs, fhall and will, at the Cofts and Charges of the faid M. L. his Heirs, Executors and Administrators, from Time to Time, acknowledge, i perform, do and execute, and fuffer to be done, performed, acknowledged and executed, all such ⚫ reasonable Act and Acts, Thing or Things, which by the faid M. his Heirs or Affigns, or his or their Counsel learned in the Law fhall be reafonably devised, advised and required, for the lawful and better Affurance and Conveyance of all and fingular the Premiffes to the faid M. and his Heirs, according to the Cuftom of the faid Manor, and according to the true Intent and Mean⚫ing of these Presents. Provided always, That the faid J. R. fhall not, by Reafon of any Covenant or Article herein contained, for the Paffing of any • Affurance or Affurances of the Premiffes, or of any Part or Parcel thereof, be enforced or compelled to travel out of the faid County of D. Moreover, that the faid J. R. covenanteth, &c. To deliver, C or caufe to be delivered to the faid M. L. his Heirs or Affigns, within the Space of feven Years next enfuing, upon reasonable Requeft, all fuch Copies, Licences and Evidences whatsoever, concerning the Premiffes only, or only any Part or • Parcel thereof as be in his own Hands, or in the Hands of any other to his Ufe, which he may obtain or come by without Suit at Law. Laftly, The faid 7. R. doth covenant, &c. that he the faid M. L. his Heirs and Affigns, and every of them, fhall and may lawfully and peaceably pofsess, have and enjoy all and fingular the Premiffes, ' with their Appurtenances, without any Manner of lawful Let, Disturbance or Eviction of the faid J. R. and of K. R. Mother of the faid F. and of their Heirs, or all, either, or any of them; and alfo, that the Premiffes fhall be discharged, or
