AN ACT making an appropriation for expenses of the commission to confer with committees of congress in relation to Indian affairs.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of five thousand dollars ($5.000), or so much thereof as may be necessary, is hereby appropriated for expenses of the commission to confer with committees of congress in relation to Indian affairs created by chapter five hundred and ninety of the laws of nineteen hundred and nineteen. The moneys hereby appropriated shall be paid out by the state treasurer on the warrant of the comptroller upon the certificate of the chairman of such commission.

§ 2. This act shall take effect immediately.

AN ACT making an appropriation for camps and schools of instruction, maneuvers, exercises and field training, drill and instruction of the New York guard.

§ 2. The amount hereby appropriated, or so much thereof as shall be sufficient to accomplish the purposes designated, is authorized to be paid upon the orders of the governor directing the mobilization and exercise of said troops, and the proper vouchers of the adjutant general of the state covering the expenditures in connection therewith.

3. This act shall take effect immediately.

Chap. 666.

AN ACT to amend the canal law and the executive law, in relation to the salaries of certain state officials, and making appropriations for additional compensation.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Sections thirty and thirty-two of chapter thirteen $ 30, 32 of the laws of nineteen hundred and nine, entitled "An act relating to canals, constituting chapter six of the consolidated laws," are hereby amended to read as follows:

§ 30. Superintendent of public works. The superintendent of public works shall be paid an annual salary of ten thousand dollars1 and all traveling expenses necessarily and actually incurred 1 Formerly "six thousand dollars."

Before entering on the duties of his office, he shall execute an official undertaking in the sum of fifty thousand dollars, to be approved by and filed in the office of the comptroller, and to be renewed as often as the governor requires. The sureties on such undertaking and on the under taking of the assistant superintendents and deputy superintend ents shall be freeholders of this state.

§ 32. Deputy superintendent. The superintendent of public works may appoint a deputy to hold office during his pleasure, and may fix his compensation not to exceed six thousand five hundred dollars per year which deputy may perform any or all of the duties of the superintendent except those imposed upon him as a member of the canal board or of the capitol commission. Before entering on the duties of his office he shall execute an undertaking in the sum of twenty-five thousand dollars, to be approved by and filed with the comptroller and renewed as often as the governor may require.

70. Salary and expenses. The state engineer and surveyor may be known as the state engineer, and shall be paid an annual salary of ten thousand dollars and his reasonable expenses when necessarily absent on public business pertaining to the duties of his office.

§ 4. The sum of four thousand dollars ($4,000) is hereby appropriated for the payment of the increase of the salaries of the secretary of state, the comptroller, the state engineer and surveyor and the treasurer as provided by this act for the period of time from January first to and including June thirtieth, nineteen hundred and twenty-one.

AN ACT to amend the tax law, in relation to the compensation of members of the state tax commission, and making an appropriation therefor.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section one hundred and seventy of chapter sixtytwo of the laws of nineteen hundred and nine, entitled "An act in relation to taxation, constituting chapter sixty of the consolidated laws," as last amended by chapter three hundred and seventeen of the laws of nineteen hundred and fifteen, is hereby amended to read as follows:

§ 170. State tax department. There is hereby created a state tax department the head of which shall be the state tax commission. The commission shall consist of three commissioners appointed by the governor by and with the advice and consent of

the senate, one of whom shall be designated by the governor as president of the commission. Upon the appointment of a successor to the president of the commission the governor shall designate such successor or other member of the commission as president. The commissioners first appointed shall hold office for one, two and three years from January first, nineteen hundred and fifteen. Their successors shall be appointed for full terms of three years from the expiration of the terms of their predecessors in office. If a vacancy shall occur otherwise than by expiration of term it shall be filled by appointment for the unexpired term. Each commissioner shall devote his entire time to the duties of his office. Any commissioner may, after notice and an opportunity to be heard, be removed by the governor for inefficiency, neglect of duty or misconduct in office.

The president of the commission shall receive an annual salary of eight thousand five hundred dollars,2 and each of the other commissioners shall receive an annual salary of eight thousand dollars.3
