Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act to authorize towns of Jefferson county to raise money to aid in the erection of a monument to commemorate the services of the soldiers who have been killed or died of wounds received, or of disease contracted, during the late rebellion, and for other purposes," reported in favor of the pass age of the same.

On motion of Mr. O'Donnell and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act to enable the electors of the town of Verona, Oneida county, to vote by districts for town officers," reported in favor of the passage of the same. On motion of Mr. Campbell and by unanimous consent, the rule was suspended, and said bill recommitted to the committee with power to report complete.

Mr. Williams moved to take from the table the motion to reconsider the vote upon the Assembly bill entitled "An act to encourage the construction of the Southern Central railroad, and to exempt for a limited time the town, village and city bonds from taxatiou, made or hereafter to be made, in pursuance of an act entitled 'An act to facilitate the construction of the Southern Central railroad, and to authorize towns to subscribe to the capital stock thereof,' passed April 7, 1866."

The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the affirmative.

On motion of Mr. Crowley and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend an act entitled 'An act to provide for the enrollment of the militia, the organization and discipline of the national guard of the State of New York, and for the public defense,' passed April 23, 1862, designated as the

Military Code of the State of New York," was recommitted to the committee on militia and public defense, with power to report complete.

On motion of Mr. Stanford and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to reduce the number of directors of the Schoharie Valley Railroad Company," was recom mitted to the committee on railroads, with power to report complete.

Mr. Gibson, from the committee on claims, to which was referred the bill entitled "An act to amend chapter 485 of the Laws of 1864, entitled 'An act for the relief of the heirs of Matthew Sayre, deceased,'" reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Low, from the committee on railroads, to which was referred the Assembly bill entitled "An act to reduce the number of directors of the Schoharie Valley Railroad Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. White, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act amendatory of and supplementary to an act entitled 'An act to provide for the draining and filling up of the old channel of Onondaga creek, between the south bounds of the city of Syracuse and Onondaga street in said city, and for straightening and deepening the channel of said creek, between said Onondaga street and the Onondaga lake in said city and the town of Geddes, and for the removing encroachments on and obstructions in said channel,' passed March, 1867," reported in favor of the passage of the same.

On motion of Mr. White and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Sessions moved that the Senate resolve itself into a committee of the whole upon the Assembly bills entitled as follows:

"An act to provide ways and means for the support of Government; to authorize a tax of one and one-fourth mills per dollar of valuation for purposes of the General Fund; three-fourths of a mill for the support of common schools; one-eighth of a mill for the redemption of State indebtednes; and three mills for county purposes."

"An act in relation to the valuation of the property of railroad companies in school districts, for the purpose of taxation."

"An act making appropriations for certain public and charitable institutions."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the Assembly bills above named.

After some time spent therein, the President resumed the chair, and Mr. Parsons, from said committee, reported that they have made some amendments to the first named bill, and amended the title thereof by striking out the words "three-fourths" and inserting in lieu thereof the words one and one-fourth," and as amended, recommend its passage, which report was agreed to and said bill ordered to a third reading.

Mr. Parsons, from the same committee, reported in favor of the passage of the second named bill, without amendment, which report was agreed to and said bill ordered to a third reading.

On motion of Mr. La Bau, and by unanimous consent, the rule was suspended, and said bill recommitted to the committee with power to report complete.

Mr. Low moved that the committee on the judiciary be instructed to report adversely upon the bills entitled as follows:

"An act to incorporate Merchants' Joint Stock Insurance Company." "An act to incorporate the Fidelity Loan Trust and Deposit Company of the city of New York."

Assembly, "An act to incorporate the Manhattan Warehousing Loan and Insurance Company."

Strike out the word "the" at the end of second line sec. 2, engrossed bill, and insert the word "one."

Strike out the words "were in existence" in the third line of sec. 2. Add at the end of section two, the following: "and shall furnish to the Auditor of the Canal Department a statement of the difference in cost between the construction of said bridge on the original plan, and the cost of rebuilding said bridge on the original plan shall be charged to the contractor for repairs on said section."

Strike out all in the 3d section after the word "repair," in the 6th line. Mr. Campbell moved that the Senate concur in said amendments. The President put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

The Assembly returned the bill entitled "An act to authorize the town of Queensbury, in the county of Warren, to issue bonds to aid in the construction of a railroad from the village of Glens Falls, to intersect the Saratoga and Whitehall railroad," with a message that they have concurred in the passage of the same, with the following amendment:

Section 3, line 11, after "whatever," insert "For the completion of said road and the expenditure of the sum so devoted by said town, said Cooperstown shall give full and adequate security to said companies."

The President put the question whether the Senate would agree to to concur in the amendment of the Assembly to said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

The Assembly returned the bill entitled "An act to secure the navigation of the Oneida Lake canal, and to provide for the payment of the expenses thereof," with a message that they have passed the same, with the following amendments:

Section 2, line 3, strike out "seven" and insert "eight."
Insert as sections 7 and 8 the following:

§ 7. The commissioners of the Canal Fund and the Comptroller are hereby anthorized to invest in said tax any moneys in their control, or in the control of either of said commissioners or said Comptroller, belonging to either of the sinking funds. All the moneys thus obtained shall be applied, and the same are hereby appropriated to pay for the work authorized by this act, and shall be paid for such purposes by the Treasurer upon the warrant of the Auditor of the Canal Department, as required. And so much of the moneys arising from said tax as may be necessary, shall be applied to reimburse the said sinking funds for the amount invested in said tax, and for the interest thereon, not exceeding five per cent. per annum, from the time of the investment to the day of payment. § 8. In case it shall become lawful by any change in the Constitution, before the said tax shall have been levied and collected, to borrow on the credit of the State, the moneys, or any part thereof necessary for the payment of the work authorized by this act, or the reimbursement of any funds authorized to be used for the purposes of this act, or in case funds ample for such objects shall be otherwise provided and appropriated before the time aforesaid, for levying the said tax, then the said tax, or so much thereof as shall thus be otherwise provided for, shall not be levied and collected.

Mr. Barnett moved to lay said amendments on the table.

The Assembly returned the bill entitled "An act to amend the amended charter of the Adriatic Fire Insurance Company of New York, so as to authorize a reduction of its capital stock," with a message that they had passed the same with the following amendments: Section 1, line 5, engrossed bill, strike out one " and insert two." Same line, strike out "and fifty." Line 6, strike out "six" and insert "eight." Add at the end of the section, as follows: "the company to pay for fractional shares at the rate of fifty per cent. on the par value thereof."

The President put the question whether the Senate would agree to concur in the amendments of the Assembly to said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:
