The Assembly returned the bill entitled "An act to authorize the construction of an iron bridge over the Oswego canal on Broadway street, in the village of Fulton, in the county of Oswego," with a message that they had concurred in the passage of the same, with the following amendments: Add at the end of section 2, the following: "and shall furnish to the Auditor of the Canal Department a statement of the difference in cost between the construction of said iron bridge and the construction of said bridge on the original plan; and the cost of rebuilding said bridge on the original plan, shall be charged to the contractor for repairs on said section." Add as section four: § 4. This act shall take effect immmediately. The President put the question whether the Senate would agree to conconcur in the amendments of the Assembly to said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows: Ordered, That the Clerk return said bill to the Assembly, with a mes sage informing that the Senate have concurred in their amendments. The Assembly returned the bill entitled "An act making appropriations for certain expenses of Government, and for supplying deficiencies in former appropriations," with a message that they had consented to the appointment of a committee of conference, and appointed as such committee on their part, Messrs. D. P. Wood, H. Smith, Roberts, Selkreg and Lord. Ordered, That the Clerk return said bill to the Assembly. Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act for a free bridge over the Mohawk river, at St. Johnsville," reported in favor of the passage of the same. On motion of Mr. Kline, and by unanimous consent, the rules were suspended, and said bill recommitted to the committee, with power to report complete. Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to incorporate the Merchants' Joint Stock and Security Company," reported adversely thereto, as instructed by the Senate. The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the Assembly bills entitled as follows: "An act to increase the compensation authorized by the act entitled 'An act to provide for the care and education of indigent deaf mutes under the age of twelve years,' passed April 25, 1863." "An act for the relief of the legal representatives of Walter Bissell, deceased." "An act to authorize the construction of enlarged locks upon the Erie and Oswego and Cayuga and Seneca canals, and to provide the means to pay the expense thereof." After some time spent therein, the President resumed the chair, and Mr. Barnett, from said committee, reported in favor of the passage of the two first named bills, without amendment, which report was agreed to and said bills ordered to a third reading. Mr. Barnett, from the same committee, reported progress on the last named bill, and asked leave to sit again. Mr. Gibson moved to recommit said bill to the committee on canals, to insert a provision for enlarging locks on Champlain canal. Mr. Humphrey moved to lay the question on the table. The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the negative, as follows: Mr. Low moved to amend, that the whole subject be referred to the Constitutional Convention. Mr. Williams gave notice that he would, at an early day, move to suspend so much of rule 48 of the Senate as prohibits a question being reconsidered more than once, in order to allow him to move a reconsideration of the vote on the final passage of the Assembly bill to facilitate the construction of the Southern Central Railroad, &c. A message from the Assembly was received and read, in the words following: The majority of the committee of conference on matters in difference upon the bill entitled "An act to encourage and aid the building of rail roads," report that they disagree. The Assembly returned the bill entitled "An act to amend an act entitled 'An act to simplify and abridge the practice, pleadings and proceedings of the courts of this State,' passed April 12, 1848," with a message that they non-concur in the amendments of the Senate thereto, and have appointed Messrs. Hiscock, H. Smith, Ballard, Develin and Weed, as a committee of conference, and request a like committee on the part of the Senate. Mr. Folger moved that a committee of conference be appointed on part of the Senate. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Messrs. Folger, Gibson and Crowley were appointed as such committee. Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have consented to a conference committee. Mr. Barnett moved to take from the table the amendments of the Assembly to the bill entitled "An act to secure the navigation of the Oneida Lake canal, and to provide for the expenses thereof." The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the negative. The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled. as follows: "An act to amend an act entitled 'An act to establish a Capital Police district, and to provide for the government thereof,' passed April 22, 1865. Assembly, "An act in relation to the navigation of the Cayuga and Seneca canal." Assembly, "An act to provide for rebuilding the bridge across the State ditch at Jack's Reefs." After some time spent therein, the President resumed the chair, and Mr. Bennett, from said committee, reported progress on the first named bill and asked and obtained leave to sit again. Mr. Bennett, from the same committee, reported in favor of the passage of the two last named bills, without amendment, which report was agreed to and said bills ordered to a third reading. A message from the Assembly was received and read, in the words following: The committee of conference appointed on the part of the Assembly and Senate, to settle the questions of difference between the two Houses relating to the Assembly bill entitled "An act to release the title to certain lands to the children of Mary Furie and to Anne F. C. Williams,” met, and after due consideration agreed upon the following report: Strike from the title of the act the words "to the children of Mary Furie and " In section one, strike out, in line five, after the word released, the words "to the children of Mary Furie, a half sister of the said Daniel N. Dugan, subject to the dower in said lands." Add at the end of the first section the following: 'The release of the interest of the people of this State to said real estate is upon the condition that the said Anne F. C. Williams pay to the Attorney General of this State all the costs of the people of this State in certain proceedings to foreclose one or more mortgages upon the said real estate, or a part thereof, and upon the payment of the same the said Attorney General is hereby directed to consent to a discontinuance of said proceedings, and shall receipt the payment of said costs, and acknowledge the execution of such receipt before a commissioner of deeds, and the register of the city and county of New York is hereby authorized to record the said receipt in his office, if properly authenticated; and upon the further condition that she pay to the executor of the estate of Mary Furie, deceased, the sum of $8,250, within sixty days after the passage hereof, and upon the payment of said sum of money to the executor, he shall receipt for and certify the payment thereof, and acknowledge the same before a commissioner of deeds, and the register of the city and county of New York is hereby authorized to record such receipt, if properly authenticated, in his office as and for a conveyance of real estate." Strike out section three, and insert the following: "§ 3. This act shall be a law upon its passage, but shall not take effect as a release of the interest of the people in the said real estate until the said receipts shall each be filed or recorded."
