Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate the Continental Land and Mining Company of the city of New York," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on insurance, to which was referred the Assembly bill entitled "An act for the relief of the Yonkers and New York Fire Insurance Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to amend the charter of the Union Avenue Association of the village of Saratoga Springs," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

The Assembly bill entitled "An act making appropriations for certain public and charitable institutions," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a two-thirds of all the members elected to the Senate voting in favor thereof, as follows:

Ordered, That the Clerk return said bill to the Assembly with a message informing that the Senate have concurred in the passage of the same, with amendments.

The Assembly bill entitled "An act to provide ways and means for the support of Government; to authorize a tax of one and one-fourth mills per dollar of valuation for purposes of the General Fund; threefourths of a mill for the support of common schools; one-eighth of a mill for the redemption of State indebtedness; and three mills for county purposes," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in the passage of the same, with amendments.

Mr. Andrews moved that the Senate resolve itself into a committee of the whole upon the Assembly bill entitled as follows:

"An act to enable the board of supervisors of the county of New York to raise money by tax for the use of the corporation of the city of New York, and in relation to the expenditure thereof; and to provide for the auditing and payment of unsettled claims against said city, and in relation to actions at law against said corporation."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of said entitled bill.

After some time spent therein, the President resumed the chair, and Mr. White, from said committee, reported in favor of the passage of said bill, with amendments.

Mr. Low moved to recommit said bill to the committee on municipal affairs, with instructions to amend the same, as follows:

"And whenever the comptroller of the said city has reason to believe that any judgments now of record against the mayor, aldermen and commonalty of the city of New York, or which may hereafter be obtained against them, are founded upon illegal claims or contracts or have been illegally obtained, he is hereby directed to take all proper and necessary

means to open and reverse such judgments, and to employ counsel therefor, and to use the name of the said mayor, aldermen and commonalty for such purpose; and the county in which said judgments are obtained are directed to open the same and allow the defendants to defend the same, and such defense may be made by said comptroller by any counsel he may employ for that purpose."

The President put the question whether the Senate would agree to said motion of Mr. Low, and it was decided in the negative.

Mr. T. Murphy renewed the amendment offered by him in committee of the whole, as follows:

Section 1, line 79, insert after the word "dollars" the words "to be expended by and under the direction of the commissioners of the Central Park; and the bureau in the office of the street commissioner, heretofore having charge of lands and places, is hereby abolished, and its powers and duties so far as they relate to the matters embraced in this appropriation, are transferred to said commissioners."

The President put the question whether the Senate would agree to said motion of Mr. T. Murphy, and it was decided in the negative, as follows:

Section 1, line 71, at the end add the words: "to be expended by and under the direction of the commissioners of the Central Park."

Section 1, line 83, strike out "street commissioner" and insert "commissioners of the Central Park."
