Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act in relation to excise moneys collected in Montgomery county," reported in favor of the passage of the same.

On motion of Mr. Kline and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Folger moved that the committee on canals be discharged from the further consideration of the Assembly bill entitled "An act to extend powers of the Sodus Canal Company," and that the same be referred to the committee of the whole.

Mr. White moved to lay the same on the table.

The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the negative.

Mr. White moved to refer the subject to the Constitutional Convention.

Mr. H. C. Murphy raised the point of order that it is not competent for this body to refer matters of local legislation to the Constitutional Convention, and only such as concerns the general interests, and the motion pending being out of ordor, the Senator from the 22d is consequently also out of order.

The President decided the point of order well taken, as the bill did not involve an appropriation, and relating to local interests only was not a proper subject of reference to the Constitutional Convention, and therefore the Senator was not in order.

Mr. White moved that the subject be indefinitely postponed.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:

The committee of conference on the part of the Senate and Assembly, appointed to consider the amendments made by the Senate to the Assembly bill entitled "An act making appropriation for certain expenses of government, and for supplying deficiencies in former appropriations," report that they have met and agreed upon the following recommendations, namely:

That the Senate shall recede from their amendments in relation to Cornelius S. Underwood, on page 2 of the engrossed bill. Also, in their appropriation on page 5, to William H. Moore. Also, on page 9, striking out the appropriation for the survey of the Hudson river and the Oneida Lake canal. And on page 19, making an appropriation for the purchase
