11th. That the House concur in striking out on page six, lines four to nine inclusive, in relation to the towing-path in Rochester.

12th. That the House concur in amendments of lines twelve, thirteen, fourteen and fifteen, on page six, reducing the appropriation for locks at West Troy to $100,000. Also in the amendment striking out the paragraph, lines twenty-two to twenty-seven inclusive, on page six, in relation to survey of Oswego river.

Also, on page six, line twenty, striking out the words "lock No. 2." 13th. That the House concur in the portion stricken out on lines thirty, thirty-one and thirty-two, and to the word "thousand," in line thirtythree, and amending the same by inserting in place thereof the following:

"And to reconstruct the abutments to, and superstructure of a bridge at Watkins, and a tow-path bridge on the Chemung canal, as directed in certain acts of the Legislature, provided said work is not within the repair contract, the sum of ten thousand dollars."

14th. That the House concur in amendments, lines forty-one and fortytwo, on page six, inserting $8,000 in lieu of $11,532.

15th. That the House concur in amendments in lines four and five, on page seven, inserting $10,000 in lieu of $14,500.

16th. That the House concur in amendments striking out the paragraph, lines seven to sixteen inclusive, on page seven, in relation to moneys to be paid Edward A. Mills and Ward and McVicker.

17th. That the, House concur in the amendment at the end of line six, on page eight, in the words following:

"Said dam shall be built between the spring and fall of 1867, if prac

ticable."

18th. That the House concur in the amendment at the end of line twenty-six on page eight, by amending the same so as to read as follows:

"And the work shall be let to the lowest bidder, and the proposals shall be sent to the Auditor of the Canal Department, and opened in the presence of the Canal Board, and the work awarded by the same." That the Senate recede

2d. From amendment striking out from line four to seven inclusive, on page five, in relation to pay to contractors for work done between Tonawanda and Buffalo.

4th. From amendment striking out paragraph on page five, lines thirty-two to thirty-six inclusive, in relation to Emery R. Seward.

5th. From amendment striking out from line thirty-four to line forty inclusive, on page seven, except as to the words "and fifty" in the fortieth line, and the words "at the present session of the Legislature," in the thirty-seventh and thirty-eighth lines, in the striking out of which words the House concur, reducing the amount appropriated to $100,000. 6th. The Senate recede from their amendment in lines five and six, page one, by restoring the words "and the Canal Board." And in line twentynine, by restoring the words "the Canal Board."

And by restoring lines from ten to thirty-two inclusive, on page four,

excepting as to the words "to Charles J. Degraw twenty-four thousand dollars.

Mr. Humphrey moved to concur in the report of the committee, except so far as relates to the Genesee Valley canal.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

The President put the question whether the Senate would agree to the report of the conference committee, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, with a message informing that the Senate have agreed to the report of the committee of conference.

Mr. Low, from the conference committee, submitted the following report:

The committee of conference appointed upon the differences between the two houses upon the Assembly bill entitled "An act to enable the board of supervisors of the county of New York to raise money by tax for the

use of the corporation of the city of New York, and to provide for the auditing and payment of unsettled claims against said city," met, and agreed to report as follows:

1. That the appropriation for wharves, slips and piers shall be two hundred and fifteen thousand dollars.

2. That the Senate recede from its amendment striking out section eight, in so far as relates to the following words: "The terms of office of the persons now constituting the board of councilmen of the city of New York, are hereby extended to the first Monday of January, 1869, and hereafter the term of councilmen elected shall be for the full period of two years;" and that the House concur in the addition of the Senate to said eighth section.

3. That the committee of both houses agree that in the first line of section nine the names of Benjamin W. Bonney and Lewis B. Woodruff be added as members of the board of audit.

That the House concur in the Senate amendment, added at the end of line thirty, page nine.

That the House concur in the Senate amendment, added at the end of line seventeen, page ten, restricting the accounts to be heard by the

board of audit.

That the Senate recede from all other amendments referring to the Audit Board, except as herein stated.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bill entitled as follows:

"An act to authorize the construction of an underground railway in the city of New York," &c.

After some time spent therein, the President resumed the chair, and Mr. Godard, from said committee, reported in favor of the passage of the same, with amendments.

Mr. O'Donnell moved to recommit said bill to the committee on railroads.

The President put the question whether the Senate would agree to said motion of Mr. O'Donnell, and it was decided in the negative, as follows:

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to regulate the sale of intoxicating liquors within the Metropolitan District of the State of New York,' passed April 14, 1866," reported the same back to the Senate for its consideration, as directed, and said bill was committed to the committee of the whole.

Mr. Pierson moved to lay the order of business motions and resolutions upon the table.

The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the affirmative, as follows:

The Assembly returned the bill entitled "An act authorizing the directors of the Cherry Valley and Mohawk River Railroad Company to connect said road with the Albany and Susquehanna railroad, in the county of Schoharie," with a message that they have passed the same, with the following amendments (reference to engrossed bill):

Line 3, after "Seward" insert "Carlisle, Esperance," and after "Cobleskill" insert "or any or either of them."

Section 4, after "Schoharie" insert "of the towns of Root and Charleston, in the county of Montgomery. Lines 5 and 6, strike strike out all after "Schoharie" down to and including "Montgomery."
