The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

The Assembly returned the bill entitled "An act to amend an act entitled 'An act to amend an act entitled 'An act to constitute the village of Lowville, in the county of Lewis, a separate road district,' passed March 28, 1862, and to amend the charter of said village,' passed March 26, 1866," with a message that they had passed the same with the following amendment:

Sec. 1, line 20, engrossed bill, after the word "situated" insert the following:

"Provided that any person may complain to the trustees in writing for any violation of this section, and on the recovery and collection of any such penalty therefor, the said trustees shall pay to the person or persons so first complaining, the one-half of the penalty so recovered and collected, and the trustees of said village shall have the authority to employ and pay an attorney or attorneys to prosecute action for the recovery of such penalties.".

The President put the question whether the Senate would agree to concur in said amendment, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendment. The Assembly sent for concurrence the following resolution: Resolved, (if the Senate concur,) That when the Legislature adjourn on Friday the 15th instant, it shall be to Monday evening, Feb. 25th, at 7 o'clock.

Ordered, That said resolution be laid on the table.

Mr. Wolcott gave notice that he would, at an early day, ask leave to introduce a bill giving consent of the State to the construction of a ship canal around the Falls of Niagara, by the National Government or by any company chartered for the purpose either by this State or by Congress.

Mr. Crowley gave notice that he would, at an early day, ask leave to introduce a bill to authorize the common council of the city of Lockport to build a house for the Hydrant Hose Company of that city.

In pursuance of previous notice, Mr. Andrews asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act for the preservation of the fish called Otsego lake bass, in the Otsego lake,' passed March 9, 1866," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

In pursuance of previous notice, Mr. Bennett asked and obtained leave to introduce a bill entitled "An act authorizing the trustees of the First Methodist Episcopal Church of Cazenovia, Madison county, to raise money by assessment upon its pews and sittings" which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

In pursuance of previous notice, Mr. C. G. Cornell asked and obtained

leave to introduce a bill entitled "An act to facilitate travel to the Central Park by authorizing the extension of certain railroads in Lexington avenue, and certain other streets and avenues in the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

By unanimous consent, Mr. La Bau asked and obtained leave to introduce a bill entitled "An act in relation to Metropolitan Police for the town of Newtown," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Pierson asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act to incorporate the German Savings Bank, in the city of New York,' passed April 9, 1859," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

In pursuance of previous notice, Mr. Lent asked and obtained leave to introduce a bill entitled "An act to incorporate the Clinton Savings Institution of the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

The bill entitled "An act to incorporate the New York Bridge Company, for the purpose of constructing and maintaining a bridge over the East river, between the cities of New York and Brooklyn," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Mr. Low moved to take from the table the motion to reconsider the vote upon the bill entitled "An act to facilitate the construction of the New York and Oswego Midland Railroad, and to exempt from taxation town and city bonds used in the construction thereof."

Mr. Parsons offered the following resolution:

Resolved, That the bill entitled "An act providing for the enlargement of the Erie canal locks, and making provision to pay for the same," be made the special order on Thursday 28th instant, immediately after the reading of the journal.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Williams moved that the Assembly bill entitled "An act to amend the act entitled 'An act to authorize the formation of railroad corporations, and to regulate the same,' passed April 2, 1850," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

By unanimous consent, Mr. Barnett moved to take from the table the concurrent resolution, in the words following:

Resolved, (if the Senate concur,) That when the Legislature adjourn on Friday the 15th instant, it be to Monday evening, Feb. 25th instant, at 7 o'clock.

Mr. Gibson offered the following resolution:

Resolved, That the State Engineer be and is hereby requested to report to the Senate the supplemental report of Samuel McElroy, the engineer having special charge of the survey of the Hudson river improvement and Champlain canal enlargement, from tide water to Whitehall.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. O'Donnell offered the following resolution:

Resolved, That when the Senate adjourns to-day, it adjourn to meet tomorrow morning at 10 o'clock.

Mr. E. Cornell called for the consideration of the concurrent resolution, in the words following:

Resolved, (if the Senate concur,) That a joint committee consisting of five members of the House, and three from the Senate, be appointed in pursuance of the recommendation contained in the special report of the trustees of the New York State Inebriate Asylum, to investigate the past management and present condition of said asylum, and for that purpose, that such committee visit said asylum at Binghamton, and be authorized to send for persons and papers, and that they report at an early day, during the present session of the Legislature.

Mr. Pierson moved to amend said resolution by inserting after the word "committee" the words "if they deem it necessary."

The President put the question whether the Senate would agree to said motion to amend, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said resolution as amended, and it was decided in the affirmative. Ordered, That the Clerk return said resolution to the Assembly, with a message informing that the Senate have concurred in the passage of the same, with an amendment.

By unanimous consent, Mr. Collins, from the committee on canals, to which was referred the bill entitled "An act to amend the act and the title thereof, entitled 'An act authorizing the Canal Commissioners to open the stone drain along the berme bank of the Erie canal, from the north side of East street in the village of West Troy to the culvert next south of the same,' passed April 4, 1866," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

By unanimous consent, Mr. Collins, from the committee on canals, to which was referred the Assembly bill entitled "An act making an appropriation to provide for a deficiency in the appropriation for the repairs and maintenance of the canals during the fiscal year commencing on the first day of October, 1866," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act relating to the powers and duties of the commissioners of the Central Park."

Assembly, "An act to repeal an act entitled 'An act to authorize the rector, church wardens and vestrymen of the Church of the Intercession, in the county and city of New York, to take and hold real estate by devise, and to fix the value of real and personal estate to be held by said corporation,' passed April 16, 1864."

Assembly, "An act to revive and amend the act to incorporate Oswego Waterworks Company."

After some time spent therein, the President resumed the chair, and Mr. Williams, from said committee, reported in favor of the passage of the first named bill, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Williams, from the same committee, reported in favor of the pas

sage of the second named bill, without amendment, which report was agreed to and said bill ordered to a third reading.

Mr. Williams, from the same committee, reported in favor of the passage of the last named bill, without amendment.

Mr. Wolcott moved that said bill be now read a third time.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Said bill was then read a third time.

By unanimous consent, the rule was suspended and said bill ordered returned to the Assembly immediately, with a message informing that the Senate have concurred in the passage of the same, without amendment.

Mr. Gibson moved that the bill entitled "An act to provide for a convention to revise and amend the Constitution," be made the special order to-morrow morning, under head of special orders.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act authorizing the trustees of the Reformed Protestant Dutch Church of Caughnawaga, in the village of Fonda, Montgomery county, to raise money upon its pews and sittings."

Assembly, "An act to fix the number and to provide for the election of aldermen in the city of Rochester."

"An act to amend an act entitled 'An act to incorporate the city of Elmira,' passed April 7th, 1864, and the acts amendatory thereof."

After some time spent therein, the President resumed the chair, and Mr. T. Murphy, from said committee, reported in favor of the passage of the first named bill, without amendment, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. T. Murphy, from the same committee, reported in favor of the passage of the second named bill, without amendment, which report was agreed to and said bill ordered to a third reading.

Mr. T. Murphy, from the same committee, reported in favor of the passage of the last named bill, with amendments, which report was agreed to. On motion of Mr. Nicks, said bill was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:
