Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Mr. Collins moved that the Assembly bill entitled "An act making an appropriation to provide for a deficiency in the appropriation for the repairs and maintenance of the cauals during the fiscal year commencing on the first day of October, 1866," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Platt moved that the bill entitled "An act to facilitate the construction of the Plattsburgh and Whitehall Railroad," be referred to the first committee of the whole, not full.

On motion of Mr. Collins, said bill was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

By unanimous consent, the rule was suspended and the Clerk ordered to return said bill to the Assembly immediately, with a message informing that the Senate have concurred in the passage of the same, without

After some time spent therein, the President resumed the chair, and Mr. Barnett, from said committee, reported in favor of the passage of the two first named bills, without amendment, which report was agreed to and said bills ordered engrossed for a third reading.

Mr. Barnett, from the same committee, reported that they have made some amendments to the last named bill, and amended the title so as to read: "An act to provide for removing fences along certain plank roads during winter," and as amended, recommend its passage, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Sessions, from the committee on finance, to which was referred the petition of citizens of New York, for relief of destitute Roman Catholic children in the city of New York, reported by bill entitled "An act for the relief of the Society for the Protection of Destitute Roman Catholic Children in the city of New York," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Sessions, from the committee on finance, to which was referred the petition of Children's Aid Society for relief, reported by bill entitled 'An act for the relief of the Children's Aid Society of the city of New York, and in aid of the industrial schools thereof," which was read the first time, and by unanimous consent was also read the second time and committed to the committee of the whole.

Mr. Sessions, from the committee on finance, to which was referred the petition of Elmira Female College for relief, reported by bill entitled "An act to aid the Elmira Female College," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

proceeded to the consideration of general orders, being the bill entitled as follows:

"An act to authorize the construction of a railroad in Christopher street and other streets and avenues in the city of New York."

After some time spent therein, the President resumed the chair, and Mr. C. G. Cornell, from said committee, reported progress on said bill, and asked and obtained leave to sit again.

On motion of Mr. Pierson the Senate adjourned.

Mr. White presented a petition from citizens of Skaneateles, for an amendment of the charter of said village; which was read and referred to the committee on municipal affairs.

Mr. Campbell presented a memorial of the New York State Agricultural Society, by its standing committee on flax, asking instructions from the Legislature; which was read and referred to the committee on agriculture.

Mr. E. Cornell presented four remonstrances of citizens of Binghamton, against city charter; which were read and referred to the committee on municipal affairs.

Mr. Crowley presented a petition of Henry F. Cady and ninety other citizens of Lockport, for the repeal of the canal contract system; which was read and referred to the committee on canals.

Mr. Low presented a petition of citizens of Port Jervis, for a bridge over the Delaware and Hudson canal; which was read and referred to the committee on canals.

Mr. Chambers presented a petition of inhabitants of the town of Halcot, for an appropriation to tunnel Pine Hill; which was read and referred to the committee on finance.

Mr. Low, from the committee on railroads, to which was referred the bill entitled "An act to amend an act entitled 'An act to authorize the construction of railway and track in the towns of West Farms and Morrisania,' passed May 2, 1863," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Pierson, from the committee on commerce and navigation, to which was referred the bill entitled "An act to amend an act entitled 'An act regulating the use of certain boats and vessels within the limits of the Metropolitan Police District,' passed April 10, 1866," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Pierson, from the committee on municipal affairs, to which was referred the petition of citizens of Brooklyn for the improvement of Bedford avenue, reported by bill entitled "An act to provide for the improvement of Bedford avenue, in the city of Brooklyn," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Kline, from the committee on manufactures, to which was referred the bill entitled "An act to amend an act entitled 'An act to authorize the formation of corporations for manufacturing, mining, mechanical or chemical purposes,' passed February 17, 1848," reported in favor of the passage of the same, and said bill was committed to the committee of the whole. By unanimous consent, Mr. Kline offered the following resolution: Resolved, That Senate bill No. 32, entitled "An act to amend the charter of the village of Johnstown, and the several acts amendatory thereto," be recommitted to the committee on municipal affairs, with power to report complete.

"An act authorizing the Canal Board to appoint a canal boat inspector at Whitehall, in the county of Washington," which was read the first time and by unanimous consent was also read the second time, and referred to the committee on canals.

"An act to amend the act entitled 'An act to authorize certain towns in the counties of Oneida, Herkimer, Madison, Otsego and Chenango, to issue bonds and take stock in the Utica, Chenango and Susquehanna Valley Railroad,' passed April 4, 1866," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

"An act to establish the office of receiver of taxes and assessments in the town of Westchester, in the county of Westchester, New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns and counties.

"An act to amend an act entitled 'An act to incorporate the Masonic Hall Association of the city of Buffalo,' passed May 1, 1866," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to amend an act entitled 'An act to amend article 2d, title 5th, chapter 6th, part 3d of the Revised Statutes, entitled 'Of executions against property,' passed May 2, 1835," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to amend an act entitled 'An act to incorporate the city of Poughkeepsie,' and the acts amendatory of the same," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

"An act to amend an act entitled 'An act to amend an act entitled 'An act to organize the State Lunatic Asylum, and more effectually to provide for the care, maintenance and recovery of the insane,' passed April 7, 1842,' passed April 16, 1860, chapter 450," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to authorize School District No. 1, of the town of Poughkeepsie, in the county of Dutchess, to borrow money for the purpose of completing a school building in said district, and to provide for the payment thereof," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature. "An act to authorize the Third Avenue Railroad Company to lay a switch in 130th street," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

"An act to incorporate the 'Safe Deposit Company' of the city of Utica," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary. Mr. Low, from the committee on railroads, to which was referred the the bill entitled "An act to secure the safe construction and management of railroads," reported that they have made some amendments thereto, and amended the title so as to read "An act to- secure the safe construction and management of railroads, and to aid in building railroads," and as amended, report the same to the Senate for its consideration; said bill was committed to the committee of the whole.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the bill entitled "An act to amend an act entitled 'An act for the preservation of the fish called Otsego lake bass, in the Otsego lake,' passed March 9, 1867," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the bill entitled "An act authorizing the trustees of the First Methodist Episcopal Church of Cazenovia, Madison county, to raise money by assessment of its pews and sittings," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

By unanimous consent, Mr. Sessions asked and obtained leave to introduce a bill entitled "An act to incorporate the village of Mayville, in the town of Chautauqua, county of Chautauqua, and to repeal its present charter," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

By unanimous consent, Mr. O'Donnell asked and obtained leave to introduce a bill entitled "An act to amend the jurisdiction of the court of special sessions of New York city," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.
