Mr. Lent presented a petition of Abner L. Ely and others, real estate brokers of the city of New York, for the repeal of the law relative to commissions on brokerage; which was read and referred to the committee on the judiciary.

Mr. Sutherland presented a petition of resident tax-payers of the town of Westchester, Westchester county, for the passage of an act establishing the office of receiver of taxes for said town; which was read and referred to the committee on internal affairs of towns and counties.

Mr. O'Donnell presented a remonstrance of Charles Brown and others, against receiver's bill for Westchester county; which was read and referred to the committee on internal affairs of towns and counties.

Mr. Folger presented a petition of citizens of Geneva, for harbor at Geneva and breakwater at Watkins, and enlargement of locks on canals; which was read and referred to the committee on canals.

Mr. Gibson, from a majority of the committee on the judiciary, to which was referred the bill entitled "An act for the regulation of public cemeteries," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Gibson, from a majority of the committee on the judiciary, to which was referred the Assembly bill entitled "An act in relation to salaries of the justices of the justices' court of the city of Albany," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to increase the salaries of the justices of the justices' court of the city of Albany," and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to incorporate The Soldiers' Business, Messenger and Dispatch Company," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to incorporate the New York Yacht and Jockey Club," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to enable the Madison Club to purchase and hold real estate, and to execute bonds and mortgages in payment thereof," and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend the act entitled 'An act for the incorporation of companies formed to navigate the ocean by steamships," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to amend an act entitled 'An act for the incorporation of companies formed to navigate the ocean by steamships or vessels using caloric engines,' passed April 12, 1852," [SENATE JOURNAL.]

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act in relation to the minutes and records of the surrogate's court of Albany county," reported in favor of the pas sage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to provide for the security and pay-ment of certain indebtedness of the town of Onondaga, in the county of Onondaga," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the bill entitled "An act to change the name of the Ladies' Educational Union, to continue such corporation, and declaring its objects," reported, and ask to be discharged from the further consideration thereof, and that the same be referred to the committee on finance; which report was agreed to, and said bill so referred.

Mr. E. Cornell, from the committee on banks, to which was referred the bill entitled "An act to amend the charter of the Citizens' Savings

Bank," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. E. Cornell, from the committee on banks, to which was referred the bill entitled "An act to amend an act entitled 'An act to incorporate the Germans' Savings Bank in the city of New York,' passed April 9, 1859," reported adversely thereto, which report was agreed to, and said bill rejected.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the petition of directors of the Waterloo and Fayette Plankroad Company, in relation to tolls on said road, reported by bill entitled "An act in relation to tolls on the Waterloo and Fayette Plankroad," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the bill entitled "An act in relation to plankroads and turnpike-roads," reported adversely thereto, which report was agreed to, and said bill rejected.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the bill entitled "An act to amend an act entitled 'An act authorizing Wm. C. Bronson to convey certain water, by means of pipes, along the highways of the town of Erwin,' passed May 2, 1864," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Gibson, from the committee on the judiciary, to which was referred the bill entitled "An act to amend chap. 459 of the Session Laws of 1862, as to animals running at large," reported that they have made some amendments thereto, and amended the title by adding thereto the words: "and to create a shut bar to actions arising under said act," and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Pierson, from the committee on commerce and navigation, to which was referred the bill entitled "An act authorizing the construction of a breakwater or pier at Bay Ridge, New Utrecht, in the bay of New York," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

Mr. La Bau, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows:

"An act to amend an act entitled 'An act to incorporate the village of Edgewater,' passed March 22, 1866."

"An act to amend an act entitled 'An act to incorporate the village of Warsaw,' passed March 17, 1860, so as to enable the trustees thereof to fix and prescribe fire limits therein."

Mr. White, from the committee on literature, to which was referred the bill entitled "An act to change the name of the Rutger's Female Institute, to the Rutger's College of New York," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to change the name of the Rutger's Female Institute to the Rutger's Female College," and as amended, report the same to the Senate for its consideration; said bill was committed to the committee of the whole.

Mr. Low, from a majority of the committee on railroads, to which was referred the bill entitled "An act to incorporate the Metropolitan Railway Company," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole. Mr. Low, from the committee on railroads, to which was referred the bill entitled "An act to authorize the Manhattan Railway Company to

construct certain railway tunnels of New York city;" also the bill entitled "An act to authorize the construction of an underground railway in the city of New York," reported adversely thereto.

Mr. Folger moved that the Senate disagree with the report of the committee, and that said bills be referred to the committee of the whole. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the bill entitled "An act to provide for the mode of selecting town and other officers, at the annual elections to be held in and for the several towns in the county of Richmond," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the bill entitled "An act authorizing the town of Hempstead, Queens county, to sell their common lands," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

chapter 455 of Laws of 1847, concerning highways," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. E. Cornell, from the committee on banks, to which was referred the bill entitled "An act to incorporate the National Savings Bank in the city of New York," reported adversely thereto, which report was agreed to and said bill rejected.

Mr. Sessions, from the committee on finance, to which was referred the Assembly bill entitled "An act in relation to raising moneys in the town of Cortlandville, for the purpose of aiding in the erection and furnishing of a Normal School building in said town," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Sessions, from the committee on finance, to which was referred the the bill entitled "An act for the relief of George Pettys, and to release to the heirs-at-law of August Pegunnot, late of the town of Palermo, and county of Oswego, deceased, the interest of the State of New York, in and to certain surplus moneys," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Gibson gave notice that he would, at an early day, ask leave to introduce a bili to incorporate the Pneumatic Dispatch Company.

Mr. Sutherland gave notice that he would, at an early day, ask leave to introduce a bill to provide for the construction of a free bridge over Harlem river.

Mr. Platt gave notice that he would, at an early day, ask leave to introduce a bill for the relief of Wm. Lengfield, and legalize his acts as justice of the peace.

Mr. T. Murphy gave notice that he would, at an early day, ask leave to introduce a bill to amend an act entitled "An act to incorporate the Market Savings Bank of New York," passed May 5, 1863.

Also, a bill to incorporate the Merchants' and Manufacturers' Loan and Trust Company.

Also, a bill to amend chapter 573, Laws of 1866, entitled "An act to incorporate the National Safe Deposit Company, and confer additional powers on said corporation."

Mr. Folger gave notice that he would, at an early day, ask leave to introduce a bill in relation to nuncupative wills.

Mr. T. Murphy gave notice that he would, at an early day, ask leave to introduce a bill in relation to the powers and duties of the Central Park Commissioners.

Also, a bill to incorporate the St. Gabriel's Temperance Benevolent Society of New York.

In pursuance of previous notice, Mr. Pierson asked and obtained leave to introduce a bill entitled "An act for the relief of Alfred M. Wood, late collector of taxes in the city of Brooklyn," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.
